ORDINANCE NO 170
AN ORDINANCE OF THE CITY OF ZEPHYR}IILL-S, FLORIDA,
PROHIBITING THE PASSING OF ANY MATERIAL ARTICLE
FROM ANY PERSON, EITHER DIRECTLY OR INDIRECTLY,
TO ANY PRISONER SERVING A SENTENCE OR BEING HELD
IN CUSTODY BY THE CITY OF ZEPHYRHILLS, FLORIDA;
PROVIDED, HOWEVER, THAT THE PROVISIONS OF THIS
ORDINANCE SHALL NOT APPLY TO THE POLICE OFFICERS
OF THE CITY OF ZEPHYRHILLS, FLORIDA, OR TO THE
CLERK OF THE CITY OF ZEPHYRHILLS, FLORIDA; PRO-
VIDING THE PENALTY FOR THE VIOLATION OF THIS
ORDINANCE AND REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHY-RILLS,
F ORIDA, as follows, to- wit:

F That it shall be unlawful for any er son to pass any
material article either directly or indirectly to any prisoner or
p�rson held in custody by the City of Zephyrhills, Florida. PROVIDED,
n wEVER, that the provisions of this ordinance shall not apply to the
police officers of the City of Zephyrhills, Florida, or to the
C erk of the city of Zephyrhills, Florida.

( ` ` Any person on conviction of violation of any of (the prom
visions of this ordinance) shall be punished by fine of not more
than moo-. DOLLARS (�6/OD,_�!) , or by
imprisonment in the city jail for not more than ç 1i
days, or both such fine and imprisonment at the discretion of the
14 licipal Judge of the said City of Zephyrhills, Florida.
REPEALING CLAUSE: All ordinances, or parts of ordinances
of the City of Zephyrhills, Florida, in conflict herewith be, and
the same are hereby repealed.

SAVING CLAUSE: If any section, sub-section, sentence,
cause, phrase or word of this ordina oe is for any reason held or

declared to be unconstitutional, inoperative or void,\ such holding
o invalidity shall not affect the 1ernaining portion of this
o dinance; and it shall be construed to have been the legislative
i itent to pass this ordinance without such unconstitutional, in
operative, or invalid parts therein; and the rertiainder of this
o dinance, after the exclusion of such part or parts, shall be
d emed and held to be valid as if such excluded parts had not.been.
Included herein; or, if this ordinance or any provision thereof
shall be held inapplicable to any person, groups of persons,
property, kind of property, circumstance, or act of circumstances
s ch holding shall not affect the applicability thereof to any other
p rson, property or circumstance.
The foregoing Ordinance No. "10 _ was read and passed on
its first reading by the City Council of Zephyrhills, Florida, on
t e 8th day of July , A. D. 1940.
