AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, !FLORIDA, RELATING TO ANY PERSONS, PARTIES, FIRMS OR CORPORATIONS HOLDING THEMSELVES OUT TO BE EXTERMINATORS OF TERMITES, OR ENGAGED IN THE OCCUPATION OF TERMITE EXTE INATION, ITMIE CORPORATE LIMITS OF THE ITY OF ZEPHYRHILLS, FLORIDA; PRESCRIBING . .N OCCU- PATIONAL LICENSE TAX FOR SUCH BUSINESS; PRESCRIBING CERTAIN REGULATIONS FOR SAID BUSINESS; REPEALING ALL ORDINANCES. OR PARTS "OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING A PENALTY FOR THE VIOLATION OF ANY OF THE TERMS OR PROVISIONS OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS , FLORIDA, as follows: SECTION 1. Definitions. Termite Exterminator, as herein used, shall mean any person, party, firm or corporation!, holding himself or itself out as an exterminator of termites, or other woodboring insects, within the corporate limits of the City of Zephyrhills , Florida, regardless of what methods, means , or devices said person, party, firm- or corporation,shall ' use or employ in the destruction or extermination, or attempted destruction or extermination of such termites, or other wood- boring insects, who shall charge a fee_ for their services, or . agree to charge a fee for such services, or solicit this type of business for compensation. Provided, however, this term shall not apply to duly licensed builders or contractors with- in the City of Zephyrhills. The word Termites, as herein used, shall mean ter- mites or other woodboring insects, or wood-decaying insects. SECTION 2. . It shall be unlawful for any termite exterminator_, ashekein defined, to practice, or engage in his business or occupation of termite exterminator, unless -1- r . c he •shall first obtain a license and permit from the City Clerk of the City of Zephyrhills , Florida, which said license and permit shall be in substantially the same form as that provided for other occupational licenses within the City of Zephyrhills , Florida; and the said City Clerk shall receive therefor a license tax of FIFTEEN AND N0/100 DOLLARS (415.00) per year, beginning October lst, and ending September 30th of each year; that the same yearly license fee shall be charged for any fractional part of any year where said license is issued prior to October lst of any year, all of which said licenses shall expire on the 30th day of September of each year hereafter. SECTION 3. It is hereby created and constituted in the City of Zephyrhills , Florida, the office of Termite Inspector, who shall be appointed by the Mayor of the City of Zephyrhills , Florida, and shall serve for a term of one (1) year from the date cf his appointment, but shall receive no compensation other than fees and charges herein set forth, for such inspec- tion. Said Termite Inspector shall serve as such until his successor is duly qualified and appointed. Provided further, that in the event of the absence or disqualification of Termite Inspector, the City Clerk shall act as said Termite Inspector, and shall receive fees for such inspection, as hereinafter set forth. SECTION 4. It shall be unlawful for any termite ex- terminator to exterminate or attempt to exterminate termites from any building, or other structure, within the corporate limits cf the- City of Zephyrhills , Florida, unless said Ter- -2- mite Inspector shall first have inspected said building or other structure, and notified the owner of such building or structure, as to the need for termite extermination in such building or other structure. Said Termite Exterminator shall pay an inspection fee to said Inspector in the amount of TWO AND N0/100 DOLLARS (42.00) , for each and every inspection made by said Termite Inspector. PENALTY CLAUSE: Any person violating any of the Provisions of this Ordinance, shall, upon conviction, be pun- ished by a fine of not more than ONE HUNDRED AND NO/100 DOLLARS ($100.00) , or by imprisonment in the City Jail for a term of not more than sixty (60) days , or by both such fine and imprisonmen, , at the discretion of the Municipal Judge of the said City of Zephyrhills, Florida. REPEALING CLAUSE: All Ordinances or parts of Ordi- nances of the City of Zephyrhills, Florida, in conflict herewith be, and the same are hereby repealed. SAVING CLAUSE: If any section, sub-section, sentence, clause, phrase, or word of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions o this Ordinance; and it shall be construed to have been the leg- islative intent to pass this Ordinance without such unconstitutional -3- inoperative or invalid parts therein; and the remainder of this Ordinance, after the exclusion of such part or parts, shall be deemed and held to be valid as if such excluded parts had not been included herein; or, if this Ordinance or any provision thereof shall be held inapplicable to any person, groups of per- sons, property, kind of property, circumstance, or act of cir-. cumstances, such holding shall not affect the applicability thereof to. any other person, .property :or circumstance.
