Nv 4 ORDINANCE NO. 72 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, REGULATING THE MANN E OF CALLING, CONDUCTING,- CANVASSING AND MAKING RETURNS OF ALL ELECTIONS HEREAFTER HELD IN THE CITY OF ZEPHYRHILLS, FLORIDA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OP ZEPHYtlHILL S;, FLORIDA, as follows: 1. A general election for the choosing of officers of said 'I City shall be held on the first Tuesday after the first Monday in of each year,l and officers elected shall qualify aid take office within three (3) days after election; and such special e ections shall be held from time to time as may be authorized by ordinance. 2. The City Hall located in the City of Zephyrhills, Florida, b , and the same is hereby designated as the sole and only polling p ace in said city for said elections. 3. Every male and female person over the age of twenty-one ! ( i) years, who shall have been a citizen of the United States and shall have resided in the State of Florida twelve months and in the C ty of Zephyrhills six months, and who shall have registered in tae City Registration_ Book as hereinafter required, and who shall n t be disqualified as an elector by the laws of the State, shall O? a qualified elector in any election held in and for the city n t requiring of electors a property qualification. 4. The Clerk of the City of Zephyrhills shall be the Registration Officer for all elections held in the City of Zephyrhills , and shall keep and maintain a book which shall contain a list of all qualified electors who have registered with the said Clerk as hereinafter provided in the City of Zephyrhills, Florida. 5. Every person who, except for the registration herein-' above required, is qualified to vote in said dity elections , shall, on or before five o' clock P. M. of the day immediately preceding the holding of any election in the City of Zephyrhills, I Florida, apply to said Clerk to have his name registered in said Registration Book; and said applicant shall then and there maker an affidavit before the City Clerk that he or she has been a resident and citizen of the United States and of the State of Florida for a period of twelve (12 ) months , and of the City of Zephyrhills for a period of six (6 ) months ; and that he or she is over the age of twenty-one (21) years, and is qualified as an elector by the laws of the State of Florida; and upon said affidavit being made as aforesaid, the City Clerk shall then enter the name of said elector in the Registration Book of the City of Zephyrhills , Florida, provided further, however, that all duly qualified electors who have heretofore registered with the said City Clerk as aforesaid, shall be entitled to vote in city elections without registration until such time as the said Cityi�of Zephyrhills shall, by ordinance, require the re-registration of �all electors. 6 Voting in all elections of the city shall be by ballot, tf either written or printed, and the form of said ballot shall be -2- ' I All candidates for any elective office of the City of Zephyrhills , Florida, shall at the time of nomination as herein provided, be duly qualified electors of said City and freeholders therein; said candidates shall be nominated in a caucus of the duly qualified'electors of the City of Zephyrhills , `Florida, which t said caucus shall be held not less than twenty (20) days before the date of any general or special election to be held for the elec- • tion of the candidates so nominated, which said caucus shall be called by the Mayor of the City of Zephyrhills , Florida. Provided further, however, that any nomination so made, to be valid, shall be supported by a petition requesting the nomination of such can- • didate,. signed by not less than twenty-five (25) of the duly qul- ified electors of said City, and which said petition shall be filed with the City Clerk upon or before the meeting of said caucus. 8. .All candidates nominated at said caucus by the duly qual- ified electors of the City of Zephyrhills, Florida, as aforesaid, shall be, within three (3) days of such nomination, notified in writing of such nomination by the Clerk of the City of Zephyrhills , Florida. 9. Said candidates shall, within three (3) days after reH ceiving said notice, advise the Clerk of the City of Zephyrhills', Florida, in writing, whether or not such candidate accepts said nomination. If no reply is received by said Clerk within three (3 ) days as aforesaid, it will be presumed that said candidate has rejected said nomination and the name of such candidate shall not a be placed upon the ballot to be used in said eledtlon] Provided, however, that the City Council shall not cause theyname of any person to be printed on any ballot as a candidate for any municipal office U' I unless such candidate be a qualified elector of the City and the, -4- caner of real property taxable by said City. of Zephyrhills, and shall ave paid to the City Clerk, at the time of his acceptance of the nom- ination, the sum of THREE DOLLARS ($3.00) as and for a qualifying -fee. ' Be it further provided, that the name of no candidate for any munici- paloffice shall be printed on any ballots by the City Council unless said candidate shall have been duly nominated at the caucus in the m nner as hereinabove provided for. Provided further, that the pro- m eds of such qualifying fees shall be used to defray the expenses of said election, and the balance, if any, shall be paid into the general find of said City. 10. Any duly qualified elector of the City of Zephyrhills , Florida may vote in any municipal election) other than an election re- quiring the elector' s property qualification2 by absentee ballot , if said i elector shall be absent from the State of Florida on the occasion of s id election, or if said elector by reason of illness shall be unable „�✓ ; to go to the polling place hereinabove provided for on the occasion of s id election; and provided further that said elector, desiring to !cast an absentee vote shall first make an affidavit in substantially thle f llowing form: SATE ( DISTRICT) OF C LINTY OF I, the undersigned, do hereby solemnly swear that I am a citizen of the United States ; ' that I am a legal resident of the State of F orida, and have been such for one year last past, and of the County of City or Town of , for six months last pest ; that I am a duly qualified elector under the laws of the State of F orida; that I have not voted in any state other than the State of Florida within the last twelve months; that I am not a registered toter ix any state other than the State of Florida; (that because of illness I cannot go to. the polling place provided for) . . . (that I expect to be absent from the pta3li�g.:`pl'ace'�. ': : . ® . ®on the occasion of 'the city elec- -5- . tion to be held in Zephyrhills on the day of A. D. 19 ; that I will have no opportunity to vote: thereat per- sonally, will not attempt to do so, and request that I be allowed to vote an absentee ballot on this day of , 19 Elector Sworn to and subscribed before me this day of A. D. 19 . . I Upon the making of said affidavit , the City Clerk shall issue an official ballot to such voter, who shall vote for the candidate of his or her choice in secret., and enclose said ballot in a sealed envelope, which said sealed envelope shall be delivered in person. to the Clerk of the City of Zephyrhills , Florida., on or before five o' clock P. M. , of the day immediately preceding, the day of the holding of said election. The City clerk shall not break the 4 seal on said envelope , but shall deliver the same to the election board upon closing the polls on election day, at which time the seal shall be broken in the presence of the election board by the City Clerk, and the ballots therein contained counted in the same manner as though said votes had been cast in the regular manner at said election 11. The Mayor of the City of Zephyrhills , .N'lorida, shall ap- point two (2) inspectors and one (1) clerk to supervise the holding of said election. 12. Any duly qualified elector of the City of Zephyrhills , Florida, may challenge the vote of any person voting at the polls �.. in any election provided for in the manner following: by stating -6- • I to the clerk or one or both of the inspectors of said election that he challenges the vote of such person then attempting to vote. Whereupon, the election officials shall require that the person challenged shall execute an affidavit in substantially the follo ing form before being allowed to vote in such election: STATE OF FLORIDA : COUNTY OF PASCO Before me, the undersigned authority, on this day personally appeared ho, upon being by me first duly sworn, deposes and says: That his right to vote in the City election of the City of Zephyrhills, Florida, held this day of A. D. 19 , has been challenged by That affiant is a duly qualified elector of the City of Zephyrhills , Florida; that affiant is a citizen of the United State and a legal resident of the State of Florida, and has been such for one year last past, and of the County of Pasco and City of Zephyrhills , Florida, for six months last past. I That affiant is a duly qualified voter in the City of Zephyrhills , Florida, and is a qualified elector under the laws of the State of Florida; that affiant has not voted in any state other than the State of Florida within the last twelve months, and is not a registered voter in any state other than the state of lorida; that affiant has duly registered as a voter in said City of Zephyrhills , Florida, in full compliance with the law and ordinances in such cases made and provided. That affiant is over the age of twenty one (21) years, ! and has all the necessary qualifications requisite to voting in he election this day in said City. (In the event property qualifications are required for such election, affiant shall also then state that he possesses such qualifications), - Sworn and subscribed to before me this day of A. D. 19 . The City Council shall receive the returns of all city ` elections and canvass the same within forty—eight (48) hours after s id returns are received by them and shall declare the results t ereof which shall be spread upon their minutes. 14. Except as herein otherwise provided, the said elections shall be held as nearly as practicable to conform with the genera]1 ejection laws of the State of Florida. REPEALING CLAUSE: All ordinances or parts of ordinance of the City of Zephyrhills, Florida, in conflict herewith be and the same are hereby repealed. SAVING CLAUSE: If any section, sub-section, sentence, c ause, phrase, or word of this ordinance is fox any reason held of declared to be unconstitutional, inoperative or void, such h lding or invalidity shall not affect the remaining portions of this ordinance; and it shall be construed to have been the legis- lative intent to pass this ordinance without such unconstitutional, 4roperative or invalid parts therein; and the remainder of this ordinance, after the exclusion of such part or parts, shall be d emed and held to be valid as if such excluded parts had not been included herein; or, if this ordinance or any provision thereof shall be held inapplicable to any person, groups of prson,, property, kind of property, circumstance, or act of cir- curiistances, such holding shall not affect the applicability thereof t any other person, property or circumstance.
