ORDINANCE NO. /8
AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA, RESTRICTING THE LOCATION WHEREIN
PLACES OF 'BUSINESS FOR THE SALE OF ALCOHOLIC
BEVERAGES CONTAINING' MORE THAN FOUR PER CENT
OF ALCOHOL BY VOLUME MAY BE LOCATED; PROHIBIT-
ING THE CONDUCT OF SUCH BUSINESS FOR THE SALE
OF SUCH BEVERAGES WITHIN A ZONE. LOCATED WITHIN..
THE CORPORATE LIMITS OF THE CITY OF ZEPHYRHILLS,
FLORIDA, HEREIN DESCRIBED; AND PROVIDING THAT
NO LICENSE SHALL BE GRANTED FOR THE CONDUCTING
OF ANY SUCH BUSINESS WITHIN THE ZONE HEREIN
DEFINED:
WHEREAS, Fifth Avenue, Walter Gall Boulevard,` and
South,.Street .are the principal business thoroughfares in the- 1
CITY OF ZEPHYRHILLS,. FLORIDA; and
WHEREAS, a liquor store located on these streets
would: ',attract motorists to drink intoxicating whiskey, and
encourage violation of the ordinance of .the CITY OF ZEPHYRHILLS',
FLORIDA, . prohibiting drunken driving; and
WHEREAS, the location of said liquor; stores upon said
would constitute an. attractive nuisance to the youth o

fr wom n ad: children who shop and frequent said streets; and
WHEREAS, the location of liquor stores or saloons on
(. ,: sstreets would constitute a menace to the public safety,
welfare, health, and comfort of the citizens who res de in said
zone, and to all of the citizens of Zephyrhills , Florida,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL 0
THE CITY OF ZEPHYRHILLS, FLORIDA, as follows:
1.
Tha/it shall be unlawful for any person, party, firm

or corporation, to establish, conduct , manage, or carry on the
business of selling, vending, or dispensing alcoholic beverages \

of more than four (4) per cent of alcohol by volume, within the
boundaries of 'the following described zone , to-wit :
Within 100 feet of the Center Line of Fifth Avenue ;
•Within 100 feet of the Center Line of }Walter Gall Blvd;
Within 100 feet of the Center Line of South Street ;
said streets and territory herein defined lying and being within

the corporate limits of the CITY OF ZEPHYRHILLS, FLORIDA.
2.
That the location of such businesses for the sale of
such alcoholic beverages shall be restricted to that part of the
CITY OF ZEPHYRHILLS, FLORIDA, not embraced within the limits of
he above described zone; jand no license shall be granted or
issued to conduct a place of business for the sale of such
alcoholic beverages within the zone herein described in para-
graph one hereof.
3.
That this ordinance shall take effect immediately upon
its passage

REPEALII\TG CLAUSE: All ordinances or parts of ordinances
�� of -the• ,CITY OF ZEPHYRHILLS, FLORIDA, in conflict herewith be, and
4tW,"s6i4e are hereby repealed.
SAVING CLAUSE: If any section, sub-section, sentence,
clause, phrase, or word of this ordinance is for any reason held
or declared to be unconstitutional, inoperative or void, such
holding or invalidity shall not affect the remaining portions of
this ordinance ; and it shall be construed to have been the legis-
lative intent to pass this ordinance without such unconstitution-
al, inoperative or invalid parts therein; and the remainder of
this ordinance, after the exclusion of such part or parts, shall
be deemed and held to be valid as if such excluded parts had not

been included herein; or, if this ordinance or any provision thereof
shall be held inapplicable to any y person, group of persons , property,
kind of property, circumstances, or act of circumstances, such
holding shall not affect the applicability thereof to any other
person, property or circumstance.
The foregoing Ordinance No. 7S was read and passed
on. its first reading by the City Council of Zephyrhills , Florida,
on the ,2 day of A. D. 1942.
