OF BUSINESS OF ANY';KIND OR NATURE WHATSOEVER, WHICH IN THE SAME BUSINESS, ESTABLISHMENT OR PLACE OF BUSINESS, SELL, OFFER FOR SALE, OR DISPENSE, OR HAVE A LICENSE FOR TEE SALE AND DISPENSING OF- ALCOHOLIC BEVERAGES CON- TAINING MORE THAN ONE PER CENT OF ALCOHOL BY WEIGHT, TO CLOSE AND REMAIN CLOSED BETWEEN THE HOURS OF 3 6 0' CLOCK Pl. , and' Da O' CLOCK - • M. , DAY,, AND MAKING IT UNLAWFUL FOR NY S - CH PLACE 1 OF BUSINESS OR ESTABLISHMENT TO TRANSACT ANY BUSINESS OF ANY KIND OR NATURE WHATSOEVER BE-. TTNEEN SAID HOURS; PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE: AND REPEALING':;ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT. WHEREAS, the City Council of the City of Zephyrhills,; Florida, has heretofore passed Ordinance No: , which prohibited, among other things, the sale of beverages con- taining more than one per cent (:1%o) of alcohol by weight , by any place of business licensed to sell such beverages between the hours, of 1 bb o' clock : V_; M. , and 7' C o' clock, n r M, of j , 4e , . / . day; and L WHEREAS, said Ordinance No. has failed to stop the sale of such beverages between said hours because of the difficulty incident to enforcing it occasioned by the fact that said places of business have other articles such as food and groceries and other merchandise which they can legally sell at all hours ; and WHEREAS, the allowance of such places of business to conduct other busines's . has-,-.been used by said businesses as a means of defeating the provisions of Ordinance No. aforesaid, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, as follows: Section 1./ Definitions: Business , as herein defined, shall mean all types of business carried on or transacted in or by any business establishment or place of business wherein -1- ,F beverages containing more than one per cent (1%) of alcohol by weight are sold, dispensed, or offered for sale, or where the sale of such beverages has been licensed by the City of I Zephyrhills, Florida. Section 2. That it shall be unlawful for any person, party, firm or corporation to carry on or transact any business in or around any establishment or place of business where beverages containing more than one per cent (1%) of alcohol by weight are sold, dispensed, or offered for sale ; or where \�U the sale or dispensing of such beverages is. licensed by the City of Zephyrhills, Florida, between the hours of U'.. Any party, person, firm or corporation vio- lating any of the Provisions of this Ordinance, shall, upon con- viction, be punishedby a fine of not more than C. � GreUC� DOLLARS, or by imprisonment in the City Jail fora �-- ��-- days, or by ! term o not more than � Y : both such fine and imprisonment , at the discretion of the Municipal Judge of the said City of Zephyrhills, Florida. REPEALING CLAUSE: All Ordinances or parts of Ordinances of the City of Zephyrhills, Florida, in conflict herewith be, and the same are hereby repealed. - SAVING CLAUSE: If any section, sub-section, sentence, clause, phrase, or word of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such -2- 1i holding or invalidity shall not affect the remaining portions of this Ordinance; and it shall be construed to have been the ' legislative intent to pass this Ordinance without such uncon- stit utional, inoperative, or invalid parts therein; and the remainder of this Ordinance, after the exclusion of such part ! or parts, shall be deemed and held to be valid as if such ex- cluded parts had not been included herein; or, if this Ordinance or an . provision thereof shall be held inapplicable to any person, y groups of persons , property, kind of property, circumstance, or act of circumstance, such holding shall not affect the applicability thereof to any other person, property or circumstance.
