ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA
PROHIBITING SAWDUST PILES WITHIN. THE CORPORATE
LIMITS OF SAID CITY; DECLARING SAWDUST PILES OF

OF SAID CITY TO BE .rA NTYI SANCE; PROVIDING FOR DAYS' NOTICE TO ANY PERSONS, PARTIES, FIRMS CR COR-
PORATIONS NOW OR HEREAFTER MAINTAINING SUCH SAWDUST
PILES TO REMOVE SAP,9E; PROVIDING THAT IT SHALL BE
UNLAVIFUL AFTER F: DAYS FROM'THE RECEIPT OF
SUCH NOTICE FOR ANY SUCH PERSON, PARTY, FIRM OR
CORPORATION TO ALLOW OR PERMIT SUCH SAWDUST PILE
TO REMAIN UPON PREMISES OWNED OR OCCUPIED BY THEM;
PROVIDING THAT EACH DAY TIlL T SUCH SAWDUST PILE SHALL
BE ALLOWED TO REMAIN WITH THE CORPORATE LIMITS OF
ZEP_TIYRHILLS, FLORIDA, AFTER EXPIRATION OF SUCH NOTICE,
SHALL CONSTITUTE A SEPARATE OFFENSE; PROVIDING THAT THE
CONVICTION OF VIOLATION OF THE PROVISIONS OF THIS
ORDINANCE SHALL BE CONSIDERED JUST CAUSE FOR REVOCATION '
OF OCCUPATIONAL LICENSES OR PERMITS TO DO BUSINESS ISSUED
TO SUCH PERSON, PARTY, FIRM OR CORPORATION CREATING OR j
MAINTAINING SUCH NUISANCE;. PROVIDING PUNISHMENT BY FINE
OR IMPRISONMENT OR BY BOTH SUCH FINE AND ITIIPRISONM..ENT; AND
REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CON'
FLICT •HEREWITH.
BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF
Z PHYRHILLS, FLORIDA, AS FOLLOWS:
That the term "sawdustpile" as herein used is hereby defined
to mean sawdust pile in quantity of more than �° ,z-� � •: �. %'_•

That sawdust piles as herein defined within the corporate limits
of Zephyrhills, Florida are hereby declared to constitute a nuisance and
fire hazard and a menace to the public health, safety and comfort.
- hat an parson, party, firm or corporation now or hereafter maintain-
ing such sawdust pile as herein defined withihtthe corporate limits of
ephyrhills, Florida, shall be notified by the Chief of Police in writing
o remove the same from the city limits of Zephyrhills, Florida, within
days after the receipt of such notices

r Ej `,-o`°-�' u'It shall be unlawful for any person, party, firm or corpora-
ion, after the receipt of such notice and after the expiration of the
time allowed therein for the removal of such sawdust pile as herein

d fined to allow or permit such sawdust pile as herein defined to �e-
ma-in upon premises owned or occupied by them. Each day that such
iwdust pile, as herein defined, is allowed to remain within the cor--
prate limits of Zephyrhills, Florida, after the expiration of such
notice, shall constitute a separate offense.

o' Upon conviction of the violation of the provisions of this

ordinance, the City Council may consider such conviction sufficient
c use for the revocation of any occupational licenses or permits to
do business issued to the person, party, firm or corporation creating
o maintaining such nuisance.
5 -' ' 1 f Any person, party, firm or corporation violating the terms
d conditions of this ordinance shall, upon trial and conviction ;thereof

in the municipal court of the City of Zephyrhills, Florida, be punished
b�r a fine of not more or by not more than
O days imprisonment in the city jail or by both such fine and
i prisonment at the discretion of the Municipal Judge of the City of
Z phyrhills, Florida.

/That any ordinances or parts of ordinances in conflict here-
with be and they are hereby repealed to the extent of such conflict.

Tf any part of this ordinance shall by any court of competent
j irisdiction be held to be unconstitutional, such ruling shall not af-
f ct the validity of the remainder of this ordinance.

This ordinance shall become effective after its adoption by
tie City Council and its approval by the Mayor of the City of Zephyrhills ,
F orida in the manner prescribed by the city charters of the City of
Z phyrhills, Florida.
