TAXICABS AND REGULATING THE OPERATION OF TAXICABS WITHIN THE CORPORATE LIMITS OF ZEPHYRHILLS, FLORIDA; LIMITING THE HUMBER OF TAXICABS TO BE LICENSED TO ONE' CAB FOR EVERY FIVE HUNDRED POPULATION OF SAID CITY OR MAJOR FRACTION THEREOF; DEFINING THE TERM TAXICAB AS HEREIN USED;. PRESCRIBING THE QUALIFICATIONS OF TAXICAB DRIVERS; PRESCRIBING THE TYPE OF EQUIPMENT TO BE USED BY TAXICABS; PERMITTING PARKING OF TAXICABS IN CERTAIN DESIGNATED AREAS ON THE PUBLIC STREETS OF 23HE CITY OF ZEPHYRHILLS, FLORIDA, AND PROHIBITING THE PARK- ING OF TAXICABS ON PORTIONS OF THE PUBLIC STREETS OF THE CITY OF ZEPHYRHILLS, FLORIDA, NOT SO DESIGNATED AS TAXICAB ' PARKING ZONES; FIXING RATES AS 'TO THE AMOUNT TO BE CHARGED BY TAXICABS; REQUIRING LIABILITi' AND PROPERTY DAMAGE INSURANCE FOR THE OPERATION OF TAXICABS; FIXING THE AMOUNT OF LICENSE TAX FOR THE OPERATION. OF TAXICABS, AND OTHERWISE REGULATING THE OPERATION OF TAXICABS WITHIN THE CORPORATE LIMITS OF THE CITY OF ZEPHYRHILLS, FLORIDA; PROVIDING A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS 'ORDINANCE; REPEAL- ING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLIC HEREWITH; AND PROVIDING THAT THIS ORDINANCE SHALL'BE- COME EFFECTIVE IN THE MANNER AS PRESCRIBED IN THE CITY CHARTER OF . THE CITY OF ZEPHYRHILLS, FLORIDA. BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL, OF THE CITY OF Z PHYRHILLS, FLORIDA AS FOLLOWS: Section 1. The term taxicab as used herein shall be conl trued t include every motor vehicle of seven (7) passenger capacity or (less, e gaged in. the general transportation of persons for hire, not on regu- 1 r schedule or between fixed termini or over regular routes, but 'Iver t e streets generally of the said City of Zephyrhills, Florida, with o casional trips beyond the boundary of the said City. Section 2. It shall be ,unlawful for any party,, firm or Ipor- p ration to operate any taxicabs herein -defined, within the corporate 1 mits of the City of Zephyrhills, Florida, without having first pro- c red a license therefor, and paying the annual license tax of "10:00, ' w ich said license or permit shall be issued by the Clerk of the City of Z phyrhills, Florida upon payment of the aforesaid fee or.'license tax a d upon the compliance with the other conditions herein made . prer;equi-' s to to issuance of such license. Such license shall be for a period o from the it' day of -h(-)1 p' , to the an y; 'day of S , m1- r • of each year or for any part or fraction thereof, and such license. s 11 be subject to revocation by resolution of the City Council of t e City of Zephyrhills, Florida, upon affirmative proof of the vio- 1 tion of any provision of this ordinance by such taxicab operator. (a) It shall be unlawful to drive or operate any taxicab within the limits of the City of Zephyrhills, Florida, unless the d iver ' s qualifications as a taxicab driver have been approved by the C ty Council of the City of Zephyrhills, Florida, which qualifications • s all be deemed to include the skill and ability of the driver to dive said taxicab in a safe and careful manner. (b`). As to the moral character of such drivers : No license shall be issued to any driver who indulges in the excessive use of in- t xicating liquors, spirits or beverages, or who is a drug addict,'1nor t any persons found guilty by any courts of any crime or misdemeanor i volving drunkenness, intoxicating liquors or moral turpitude. Section 3. . That the number of taxicab licenses shall be' limited to one taxicab to every five hundred or major fraction of five hundred of the population of Zephyrhills, Florida. That the cab stand parking f, ` p aces herein provided for shall also be limited to one cab stand for e ch authorized taxicab. Only one cab stand for each cab shall be al- 1 wed within the corporate limits of the, said city. Section 4. The City Council shall have the right to refuse t approve the qualifications of any applicant for taxicab permit or 1 cense for any reason which in the opinion of the City Council woIuld r nder such driver an unfit or improper person to safely drive and Ali operate such taxicabs within the corporate limits of the City of 0ep hyrhills, Florida. No permit for the operation of any taxicab shall be issued to a y firm, party or corporation unless and until the applicant therefor has obtained a policy of insurance from an insurance company duly, 2 , • ' • a thorized to do business under the laws of the State of Florida, n- s ring the operation of such taxicabs for public liability and property d mage in the amount of not less than ' , which said po icy o policies must remain in force during the entire time that such taxi- i c bs shall operate, and shall be approved by the City Council befo'e ay issuance of any license, for operation of such taxicabs . The r vocation, lapse or suspension of such insurance policy shall be --� g ounds for the revocation of such license or permit . (a) It shall be unlawful to operate any taxicab within the c rporate limits of the City of Zephyrhills, Florida, unless or until s oh taxicab is equipped with brakes sufficient to bring the said t xicab to' a total stop within a space of t?�-t.i rtv ,�) feet, running • a the speed of twen T miles per hour. (b) It shall be equipped with lights which are now or maybe h reafter .prescribed by the laws of' the State of Florida . ( c) It shall be equipped with a horn in working conditilon and • i s ali also be equipped with a windshield wiper in working condition. (d) It shall be equipped with clean upholstery and interior 'f• rnishings, and the said upholstery and interior of the said taxicab Ls' all at all times be kept clean and sanitary. No license shall be issued for the operation of any taxicab u less satisfactory proof is presented to the City Council of the City o Ze'phyrhills,' Florida, that the requirements for equipment, herewith "a' 'd above contained, have been and will be complied with. The failure have or maintain the equipment as herein and above set forth by any t xicab shall be sufficient grounds for revocation of the license i 1 lid i sued to the driver thereof. Section 5. Before any license or permit is issued, the lappli- cant should submit his written application to the City Council, width - a plication should state among other things (1) name; (2) age; (3) race ( ). color (5) address containing place of residence of applicant ( ) applicant ' s driver 's license containing type, date of issuance and /P ' H p ace of issuance and number thereof, the license number,Jthe date, t e serial number, the engine number and the name of the owner of t e motor vehicle to be used as a taxicab (7) and a statement as to w ether or not the applicant is addicted to drugs or does indulge in tie use of intoxicating liquors to excess ,(8) also a statement as to w ether or not the applicant has been convicted of any crime or d meanor relating to drunkenness and use of intoxicating liquors, or. i volving moral turpitude, and such other statements as the City Couneil- m y determine from time to time, touching upon the applicant ' s moral fitness or qualifications of a taxicab driver. No taxicab shall be permitted to park on an por- t on of the public streets of the City of Zephyrhills, Florida, to s licit passengers except at the following designated, areas, which said a eas are hereby designated solely and exclusively as taxicab loading 1 9 z nes: • On Fifth Avenue at the west side of alley east of Seventh Street. and at east of alley west of Eighth Street, both sides of street. • - I January 19, 1948 The first two parking spaces on Fifth Ave. at 7th St. west; • Willie ' s Taxi on the Southeast Corner and Zephyr, .' Cab on the Northwest corner ' I I e 4 T Section 7. It shall be unlawful for any taxicab operating within the city limits of the City of Zephyrhills, 'lorida to carry more than F• re 5 passengers any , carry passen- gers � ) at one time or to gars on the running boards, fenders, or any exterior portion of the said taxicab. No driver or operator of any taxicab within the corporate limits of the City of Zephyrhills, Florida, shall drive a taxicab at a speed in excess of T'" f ive miles per hour, or drive or operate said taxicab in such a manner as to be negligent or careless . Section 8. It shall be unlawful for any taxicab driver Within (1.) t e corporate limits of the City of Zephyrhills, Florida, to charge • Se A rates in excess of the following: >' cents"for the first__- mile-s; and cents for each�addi.tional _.miles, or rates in excess of those now or hereafter prescribed by the Railroad Co _fission of the State of Florida or by the laws or statutes of the St to of Florida. Section 9 . It shall be unlawful for any taxicab to +operate within the city limits of the City of Zephyrhills, rlorida, unless the wo d 'taxi ' is displayed by sign, or by painting of the body of the vehicle at the following ;points or places.. Sec. 8. Twenty-five cents for a continuous trip within tt e limits of the City of Zephyrhills, with an additional ten cent's f r each special stop made for the convenience of the passenger. Section 10. All taxicab drivers or operators are hereby ' re- qu'red to report any accident, collision or upset involving the opera- •tin of such taxicab, and causing damage to the persons or property of anr other person, firm, or corporation, within 24 _hours after th happening of such accident, to the Chief of Police of the City of Ze hyrhills, Florida, which said report shall be written and shall con- talLn, accurate description of the time, place and manner in which the said 5 ;v- li a cident occurred, along with a full and complete account of all the d mage. and injury resulting therefrom, and the name of the witnesses t ereto. Section 11. All persons, parties, firms and corporations e gaging in operation of taxicabs, herein defined, within the cor 'orate 1 mits of the City of Zephyrhills, Florida, shall be notified in writing b the Clerk of the City of Zephyrhills, Florida of the passage of this o dinance and shall be given days from the date of passage h reof,' to comply with all and singular the provisions hereof The amount of . license tax for the privilege of operatin a t xicab in the city heretofore paid by such persons, shall be credited a ainst the license fee hereby required, and in the event such persons a e unable to comply with the requirements hereof, the unearned part o the license fee heretofore paid shall be refunded. Section 12. Any person . party, firm or corporation, upon c nviction of violation of any term of this ordinance shall be punished b a fine of not less than 25®00 rand not more than 2000-0 , o be confined in the City Jail of the City of Zephyrhills, Florida f r not less than -eX, days, and not more than ninety days or b both such fine and imprisonment at the discretion of the Judge Jof t e Municipal Court of the City of Zephyrhills, Florida. Upon such conviction, the City Council shall revoke theC 1 cense or permit issued to such persons, parties, firms or corporations t us convicted, and no other permit or license shall be issued to � such violators. Section 13. All ordinances or parts of ordinances in con- f ict herewith are hereby repealed to the extent of such conflict) Section 14. If any part of this ordinance shall by anyicourt o competent jurisdiction be held to be unconstitutional, such ruling s all not affect the validity of the remainder of this ordinance. 6 This ordinance shall become effective from the time of its a option by the City Council, and its approval by the Mayor of the C ty of Zephyrhills, Florida .
