OASI--5 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, RELATING TO FEDERAL OLD AGE AND SURVIVORS INSURANCE, ORDINANCE NO. �. An ordinance declaring the policy and purpose. of the City of Zephyrhills, Florida, to extend to the employees and officials of said City of Zephyrhills, Florida, not excluded by law, the benefits of the system of Federal Old Age and Survivor' s Insurance, as authorized by the Federal Social Security Act, and amendments they to, upon the basis of applicable State and Federal Laws or -regulations; authorizing, and directing the Mayor, or. other chief exec tive officer, to execute agreements and amendments thereto with the State Agency authorized to enter into such agreements, for coverage of said employees and officials; providing for with- holdings from salaries and wages of employees and officials of said City so covered, to be made and paid over as provided--by appli- cable State of Federal laws or regulations; providing that said Cit , shall appropriate and pay over employer' s contributions as proivded by applicable State or Federal laws or regulations; providing that said City shall keep records and make reports as required by applicable State or Federal laws or regulations; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, AS FOLLOWS: Section 1. - It is hereby declared to be the policy and purpose o the City of Ze hyrhills, _Fl/orida, to extend, effective as of � � /1 to ' the employees and officials , .. l� � t e f,, not excluded by law, and whether employed in connection it a governmental or proprietary function, the benefits of the system of Old Age and Survivor' s Insurance as authorized by the Federal Social Security Act and amendments thereto ,. including Pub is Law 734 of 81st Congress, and by Chapter 26841, Laws of Flo ida, 1951; and to cover by such plan all- services which constitute employment as defined in Section 2 of said Chapter 26841, Laws of Florida,. 1951, performed in the employ of said Cit by employees thereof. In pursuance of said policy, and for ha purpose, the City shall take such action as may be required t p P ' Y by pp licable State or Federal laws or regulations. Section 2. The Mayor, or other chief executive officer of the City of Zephyrhills, Florida, is hereby authorized and directed to execute all necessary agreements and amendments thereto with the Chairman of the Florida Industrial Commission as the State Agency for the State of Florida, or his authorized repree sentative, for the purpose of extending the benefits provided by said system of Old Age and Survivors Insurance to the employees and officials of this City as provided in Section 1 hereof, which agreement shall provide for such methods of adminH listration of the plan by said City as are found by the State Agency to be necessary for the proper and efficient administra® tion thereof, and shall be effective with respect to services ini r employ t covered by such agreement performed after the 1 4� day o£ S ction 3. W'th oldings from salaries., wages, or other compensation of emp oyess and officials for the purpose provided in Section 1 hereof are hereby authorized to be made, and shall Ibe made, in amounts and at such times as may be required by i applicable State or Federal laws or regulations, and shall be ,paid over to the State Agency designated by said laws or regulations i to receive such amounts. Section 4. There shall be appro irated from available funds, ;derived from such amounts at su h times, s may be required to pay promptly the contribution required o the ,City as employer by applicable (State or Federal laws or regulations, which shall be paid over to the lawfully designated State Agency at the times and in the manner I provided by law and regulation. Section 5. The City shall keep such records and make such reports as may be required by applicable State or Federal laws or regulations, and shall adhere to the rules and regulations f the State Agency for the enforcement of said laws and regulations. Section 6. There is hereby excluded from this ordinance any authority to make any agreement with respect to any position or 4ny employee or official now covered, or authorized to be covered, by any other ordinance or law creating any retirement system for an}� employee or official of the said City. 2. - � I Section 7. The City of Zephyrhills., Florida, does hereby adopt the terms conditions, requirements, reservations, benefits, I privileges, and other conditions thereunto 'appertaining, of Title II of the Social Security Act as amended by Public Law, No. 734, 81st Congress, for and on behalf of all the ;'officers and employees thereof and of its departments and agencies, save and except any of such officers and employees now covered, orauthorized to be covered by any retirement system provided by law, and. further excepting any official or employee who occupies any position, office, or employment not .authorized to be covered by applicable State or Federal laws or regu- lations. Section 8. John Phillips, Jr. , of the City of Zephyrhills is he�eby designated the custodian of all sums withheld from the compensation of officers and employees and of the appropriated funds for t e contrubution of the City, and John Phillips, Jr. , City Clerk i Hof said City is hereby made the withholding and reporting agent and ;charged with the duty of maintaining personnel records for the purposes of this ordinance. Section 9. This ordinance shall take effect upon its approval and publication as required bylaw. Passed and approved this day of 19 . . I 'on its first reading.
