AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA, AMENDING SECTIONS 8 AND 9 OF
ORDINANCE NO. 1O6, READ AND PASSED ON
FEBRUARY 18, 1952, GRANTING TO ZEPHYRHILLS
TELEPHONE COMPANY,; INC. , A CORPORATION
OF THE STATE OF FLORIDA, CERTAIN RIGHTS,
PRIVILEGES AND FRANCHISES FOR THE OPERATION
AND FURNISHING OF TELEPHONE SERVICES IN THE
CITY OF ZEPHYRHILLS , FLORIDA, AND PROVIDING
FOR THE TERMS AND CONDITIONS UNDER WHICH
THIS FRANCHISE IS GRANTED.
WHEREAS, the City of Zephyrhills, Florida, granted to
Zephyrhills Telephone Company,, Inc. , the right, privilege and
franchise to construct, own, maintain and operate a general
telephone business within the City of Zephyrhills, Florida, on
February 18, 1952, by adopting Ordinance No. 1O6, and
WHEREAS, the City Council deems it advisable to am4nd
Sections 8 and 9 of said Ordinance.
NOW THEREFORE BE IT ORDAINED by the City Council of
Zephyrhills, Florida, that Section 8 of Ordinance 1O6 be amended
to read as follows:
Section 8. That said telephone company does hereby
covenant andagree that it will proceed with all reasonable speed
to install a dial telephone system within the City of Zephyrhills,
and will secure the equipment and install the same with all reason
able speed, and shall have the same installed on or before Decembe
31, 1953, unless prevented by Acts of God or Government regulation ,
which would prohibit or restrict the furnishing of materials neces
sary for such change, or other causes beyond its control, and in
the event that the same is not installed as required by this
section then this Ordinance shall be null and void and of no ef-
fect, unless further extensions thereof be granted by the Ci y
Council of the City of Zephyrhills, and such extensions shal not
be unreasonably withheld.
BE IT FURTHER ORDAINED by the City Council of Zephyrhills,
Florida, that Section 9 of Ordinance 1O6 be amended to read 's

follows:
Section 9. The City of Zephyrhills shall not be liable
to the said telephone company for damage or injury done to any
of its equipment in the carrying on and the conducting of the
affairs of the City by the grading, improvement or alteration of
any streets, alleys, or thoroughfares or in any manner whatsoever,
providing, however, that the City shall at all times use ally,
reasonable care and caution to avoid any damage or injury to any
of the equipment of the said telephone company.
This Ordinance shall become effective upon its adoption
and approval, in the manner prescribed by the City Charter of the
City of Zephyrhills, Florida.
