HomeMy WebLinkAbout6 SOLID WASTE COLLECTION �lZDls3 i ORDINANCE NUMBER AN ORDINANCE PROVIDING FOR THE COLLECTION OF GARBAGE AND TRASH BY THE CITY OF ZEPHYRHILLS, FLORIDA AND AUTHORIZED INDIVIDUALS AND A COLLECTION CHARGE FOR THE COLLECTION OF GARBAGE AND TRASH WITHIN THE CITY OF ZEPHYRHILLS, FLORIDA, AND PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE . BE IT ORDAINED BY THE CITY COUNCIL OF ZEPHYRHILLS, FLORIDA: SECTION 1._ The following words, terms and phrases when used in this Ordinance shall be construed to have the same meaning as hereinafter defined: (a) Garbage shall be held and construed to mea' every refuse, kitchen, shop, store or factory accumulation of animal, fruit, or vegetable matter, liquid or otherwise, that attends the preparation, use or cooking, dealing in or storage of, meats, fish, fowl, fruit or vegetables, and any bottles, cans or other containers which, due to their ability to retain water, may serve as breeding places for mosquitoes or other water breed- ing insects. (b) Trash shall , be held and construed to mean any and all paper bags, sacks, cartons, wooden or paper boxes, sweepings and all other accumulation of any nature other than garbage which are usual to housekeeping and to the operation of stores, offices and other business places. (c) Dwelling unit shall be held and construed to mean any and all places where the usual housekeeping tasks are performed. SECTION 2. (a) All residents, occupants or owners of premises in the City who have not arranged for private disposal of garbage and trash as elsewhere authorized in this Ordinance, shall be required to have accumulations of garbage and trash removed and disposed of by the City, and for such service of garbage . and trash removal shall pay to the City a monthly garbage collection charge of Fifty Cents ($.50) per family or business. I i 'SECTION 2. continued--- (b) For each multiple dwelling unit accomodating two or more families, the owner of the premises served shall be responsible to the City for a monthly garbage collection charge la s follows: Number of Units Charge Per Unit Two to Four $ .40 Five to Eight .30 Nine and above .25 - In the event any unit of a multiple dwelling unit shall not be occupied, the owner of said unit by giving written notice to the, City Clerk shallbe entitled to a- pro-rate reduction, for the unoccupied unit or units, during the period it remains vacant. (c) The monthly charge provided for in Sub-sections (a) and (b) shall be billed on the monthly statements issued by the City for water services, provided that such garbage collection charge shall be itemized separately on such statement. (d) Such garbage collection charge herein provided for shall be paid within ten (10), days after date of mailing state- ment, as stamped thereon, or such collection service shall be discontinued until all such charges shall be paid in full. SECTION 3. It shall be unlawful and a violation of this ordinance for the owner, manager or occupant of any premises to g p permit any accumulation of garbage or trash upon the premises for a period longer than four (4) days without having arranged for disposal of such accumulation by some person qualified under this Chapter tô.'_. perform such services or by the City. SECTION 4. In all cases in which garbage is removed and disposed of by persons other than the employees of the City, the owner or occupant of the premises from which such removal is made shall previously secure a written permit therefore from the City Clerk. The application for such permit shall show the name and address of the person who is to remove such garbage, the nature of the vehicle in which it is to be- transported, and the location and manner in ; which the ultimate disposition is to be made. Page ,.3. SECTION 5. No person shall remove garbage or trash from any premises in the City, or transport garbage or trash through the streets, alleys or public ways of the City, or dump, incinerate or in any other manner dispose of garbage or trash originating in the corporate limits of the city, or contract for or permit himself to be employed for engaged for any such removal, transportation or disposal without first having secured a license for such services from the City Clerk 'evidencing the payment to the City of the following sums: collectors of edible animal garbage - Twenty-Five Dollars ($25.00) per year; collectors of garbage for rendering or processing g pl only - Twenty- Five -Dollars ($25.00) per year; junk collectors - Twenty-Five Dollars ($25.00) per year; Before issuing any such license, the City Clerk shall require the execution of an application form, to be furnished by him, showing the names of persons to be licensed, or, in the case of a corporation, the names of the principal officers and the names of the persons who are to actually perform such services for the corporation, together with the business and home addresses of each of such persons; the description of the equipment to be used in such removal, transportation and disposal; the exact location of and the method of disposal, which application shall be submitted to and approved by the City Clerk as a prerequisite to the issuance of the license . SECTION 6. Any person violating or failing to comply with any of the provisions of this ordinance shall be punished by a fine not exceed- ing $50.00 or thirty (30) days forany one violation of this Ordinance. SECTION 7. This Ordinance shall not be held in any manner to repeal any other ordinance of the City of ,Zephyrhills and is expressly made cumulative therewith. SECTION 8 In the event any section, paragraph, sentence, clause or portion of this ordinance shall, for any reason, be held unconsti 1 Page 4. SECTION 8 continued -- tutional, invalid, or ineffective, the same shall not repeal, nullify, or in any wise affect any other section, paragraph, sentence, or portion of this ordinance.
