ORDINANCE NO.
AN ORDINANCE TO PROVIDE FOR DEFINITIONS
TO BE USED IN THE ADMINISTRATION OF LICENSE F ,
TAX REGULATIONS FOR BUSINESSES AND OCCUPA-
TIONS; TO PROVIDE FOR PENALTIES FOR DOING
BUSINESS WITHOUT PAYING THE PRESCRIBED
LICENSE FEE; TO SET OUT CERTAIN EXEMPT-
TIONS FROM THE NECESSITY OF OBTAINING
THE LICENSE AS PROVIDED FOR THEREIN;.
TO ESTABLISH WHEN VARIOUS LICENSE TAXES
FOR BUSINESSES AND OCCUPATIONS ARE DUE
AND PAYABLE; TO PROVIDE, IN CERTAIN IN-
STANCES, FOR THE SEMI-ANNUAL PRORATING.
OF SUCH LICENSE TAXES; TO ESTABLISH THAT
SUCH LICENSE. TAXES ARE PAYABLE TO THE
CITY CLERK; TO SET OUT THE FORM AND CON-
TENTS OF EACH SUCH LICENSE ISSUED; TO
PROVIDE THAT EVERY LICENSEE SHALL CONSPI-
CUOUSLY DISPLAY SUCH LICENSE AS IS ISSUED
HIM; TO PROVIDE THAT MONEYS COLLECTED
BY THIS LICENSE TAX REGULATION SHOULD BE
PAYABLE TO THE GENERAL FUND;; TO PROVIDE
WHEN SUCH LICENSES WILL EXPIRE; TO PRO-
VIDE THAT AN AFFIDAVIT OF INVENTORY BE
EXECUTED BY A PERSON OR ENTITY TAXED ON
INVENTORY BASIS; AND TO PROVIDE A. SCHE-
DULE OF THE VARIOUS LICENSE FEES; AND
TO REPEAL ANY OF THE ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH, AND
TO PROVIDE FOR ITS EFFECTIVE DATE.
Be It Enacted and Ordained by the City Council of the City of
Zephyrhills, Florida:
Section 1. That the words , "Who pay no other license
tax" as herein used shall be defined and construed to mean

those who pay no other license tax to the City of Zephyrhills

provided for in this Ordinance.
Section 2. That it shall be unlawful for any person,)
firm, or corporation to engage in or manage within the 'said
City of Zephyrhills, any business , profession or occupation
mentioned in this Ordinance without having first obtained a.
license to do so from the City of Zephyrhills, Florida, in the
manner as hereinafter set forth, and without paying the license
tax as hereinafter set forth opposite the name of such business ,
profession, or occupation.

Section 3. That all confirmed cripples or invalids ,
physically incapable of manual labor, who have been resident

of the City of Zephyrhills , Florida, for at least one (1) year,
or all Confederate Veterans of the Civil War, or veterans of
World War I, or World War II or the Spanish American War, fal-
ling within any exemption otherwise provided by law, and widows
who are dependent upon their own exertions, shall be allowed to
peddle without paying a license, using their own capital only;
provided such exemptions shall be allowed upon the certificate
of the county physician or other reputable physician of the
disability herein named, provided this exemption shall not apply
to the sale of sprituous , vinous, or malt liquors, lightening
rods and cigarettes, "operators and location operators of coin
operated devices".
Section +. That all licenses shall be payable on or
before the 1st day of October of each year.
Section 5. That no license shall be issued for any
fractional portion of a year, except as otherwise provided in
this ordinance, and except that any license not otherwise spe-
cified herein may be issued after the 1st day of April to ex-
pire September 30th, upon payment of one-half (Z) the amount
fixed as a price for such license for one (1) year.
Section 6. That all license taxes shall be paid to
the City Clerk of the City of Zephyrhills , Florida, and the
said City Clerk is hereby authorized and directed to collect
said license tax.
Section 7. That upon 'the payment of the license
tax in the amount and in the manner as herein provided, the
City Clerk of the said City of Zephyrhills shall issue a li-
tense to the person, firm, or corporation paying the required
license tax, and said license shall be in the form adopted
; and approved by the City Council of the said City of Zephyrhills,
, and shall state the name of the City of Zephyrhills, the name of
the person or firm or corporation! to whom the license is issued,
the nature of the business, profession or occupation to be engaged
in or managed, the amount of the license tax paid, the date of
issuance and the date of expiration.
Section 8. Every licensee shall keep conspicuously posted
and displayed in the place of business at all times the license
which shall have been issued to him under this Ordinance.
Section 9. That all license taxes collected by the City
Clerk of the City of Zephyrhills, under the provisions of this
Ordinance shall be promptly paid into the general fund of the
said City of Zephyrhills .
Section 10. That all licenses under the provisions of this
Ordinance shall expire on the 30th day of September of each calendar
year.
Section 11 . That any person, party, firm, or business, who
or which intends to make application for a license to carry on an
occupation or business in the City of Zephyhills, the license fee
for which is to be established upon the inventory of such applicant
or his or its business, as hereinafter provided for, shall, not
later than the 1st day of September next preceding the October 1st
of the year for which such license is to be obtained, furnish to
the City Clerk of the said City . f Zephyrhills a sworn affidavit
�r gas to. the__inventory of such applicant or his or its business as
of the 1st day of the next preceding January or the next preceding
1st day of thle fiscal year under which said applicant is operatr
ing his or its business., for which the application for license is
made . Provided, however, that in the event of an amergency, the
City Clerk may waive the said September 1st time limit for the
presenting of such affidavit, provided, however, that it shall be
furnished before October 1st of the year for which issued, and that
in no instance shall such business, the license tax for which is

based on its inventory, be issued a license until the City
Clerk has received an affidavit as hereinabove provided for.
Section 12. Following is' a table or schedule of the
different businesses, professions and occupations for the
engagement in which city licenses shall be required as herein-
above provided, and the amounts to be paid for such licenses
shall be as follows :

.Section 13. That any person, firm or corporation,
violating : a provision of this Ordinance' upon conviction
thereof, shall be punished by a fine of not less than Five
Dollars ($5.00) , nor more than One Hundred Dollars ($100.00) ,
or by imprisonment in the City Jail for a period of not more
than thirty (30) days , or by both such fine and imprisonment
at the discretion of the Municipal Judge of the said City of
Zephyrhills , Florida.
Section 14. If any section, clause or provision
of this ordinance shall for any cause be held void and of no
effect, that it shall not affect the validity of the remainder
of this ordinance. •
