HomeMy WebLinkAboutA-3/90 WATER METER AND CONNECTION FEES 3 ::9 ' ORDINANCE NO. 3 AN ORDINANCE PROVIDING FOR A METER FEE AND A TAPPING OR CONNECTION FEE TO THE CITY WATER SYSTEM; ESTAB- LISHING CHARGES FOR THE USE OF WATER SUPPLIED BY THE CITY WATER SYSTEM; PROVIDING FOR A DEPOSIT THEREFORE; PROVIDING FOR A FORFEITURE OF SUCH DEPOSIT; PROVIDING ! ' FOR A REFUND OF SUCH DEPOSIT; PRESCRIBING THE PERIOD / FOR WHICH METER READINGS SHOULD COVER AND THE BASIS ,a"'e FOR COMPUTING WATER BILLS; PROVIDING A MEANS FOR DETERMINING AN AVERAGE CONSUMPTION IN THE EVENT THERE IS A MALFUNCTION OF THE WATER METER OR WHEN A CORRECT READING CANNOT BE MADE FOR OTHER CAUSES; PROVIDING N WHEN WATER BILLS ARE PAYABLE; PROVIDING FOR RESTOR- ATION OF SERVICE FEES; PROVIDING THAT IT SHALL BE NECESSARY FOR A CONSUMER TO NOTIFY THE CLERK THAT HE DOES NOT HAVE A METER AND THAT THE CLERK PROVIDE FOR INSTALLATION THEREOF, AND THAT IF CONSUMER FAILS TO PROVIDE FOR INSTALLATION OF A METER WATER SERVICE SHALL BE DISCONTINUED;; AND TO REPEAL ALL ORDINANCES AND RESOLUTIONS OR PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDINANCE WILL TAKE EFFECT UPON ITS BECOMING A LAW ASPROVIDED BY THE CHARTER. BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ZEPHYRHILLS, FLORIDA, AS FOLLOWS: Section 1. That before any building or property shall hereafter be connected to the water system of the City of Zephyx- hills there shall be paid to the City Clerk of said city the various sums of money hereinafter set forth for said connections in accordance with the following schedule:. 3/4 meter . . . . . $35.00 1" " 9. . . . . $)+5.00 ' let 14 n • • • $60.00 • 12" " . . . $70.00 2" " $85.00 plus any additional cost to compensate the City of Zephyrhills for an increase in the purchase price of such meter from the factory or manufacturer PLUS • a $5.00 connection fee. Further, that the said sums shall become the property' of the City of Zephyrhills absolutely in payment for said connections and services. Section 2. - That effective the 1st day of January, 1954, charges for water supplied by the water system of the - i City of Zephyrhills shall be according to the following rates: a. For consumers. within .the City of Zephyrhills, for the first 4,000. gallons used in any one month or fractional . part thereof: $2.00., said amount to be a minimum chargefor' any one month. • I I B. For consumers located outside the city limits of the City of Zephyrhills , for the first 13-,000 gallons used in any one month or fractional part thereof: $3.00, said amount to be a minimum charge for any one month. c. For any next quantity--bet,deen ,4. ,000 and 10,000• _: gallons used in any one month: $ .40 per 1,000 gallons. d. For any next quantity between 10 000 and 15,000 gallons used in any one month: .35 per 1,000 gallons. fie. For any quantity in excess of 15,000 gallons used in any one month:, $ .30 per 1,000 gallons. ` Section 3. That before water is turned on for use only any premises there shall be $5.00 deposited with the City Clerk of the City of Zephyrhills. Section 4 a. That at any time upon failure to pay any of the amounts due for water used within 15 days from the time the same shall become due and payable, the said City Clerk be and he is hereby authorized to apply said deposit upon any delinquent bill due from the premises for which said deposit i was made and all or any part of said deposit so applied shall be deemed forfeited by the depositor. b. In the event that water service should 11be discontinued by any user and all accrued charges for water used shall have been paid by him to the City of Zephyrhills, then he shall be entitled to a refund of any such deposit made by him. Section 5. All water meters connected to the City lof Zephyrhills water system shall be read quarterly so as to reflect water consuption and use for the periods as follows : June 1 to August 31 September-i to November 30 December 1 to last day of February March 1 to May 31. Water bills shall be computed by dividing the amount of water consumed in any one quarterly period as shown above by three (3) , thus establishing an average monthly consumption or use. 4,000, ( gallons will then be subtracted from such average amount computed -2 to have been used in one month, for which a $2.00 minimum charge , will be made. Any overage in excess of the 4,000 gallons, the above minimum, for each month shall be charged as per the schedule provided above for such excessive consumption or use. Section 6. That in the event the water consumption of any user or consumer cannot be determined by the reading of his meter by reason of malfunction of such meter or for other ause, the City Clerk may and he is hereby empowered to compute he consumption for such period f r the last reading of the meter by computing the average for the previous year 's consumption or such period as is available for determining an average con- sumption and billing said consumer or user for such period on the basis of such average. Section 7 a. That the payment for water used in ac- cordance herewith shall be made monthly, payable on the first Iday of each and every month and not later than the 10th day of I !any such month, and any amount due after the 10th day of such 'month shall be in default, and the City Clerk be and he is hereby directed and instructed that upon the failure of any user to pay for the consumption of such water in accordance with the rates prescribed herein and the default shall continue in such pay- ment later than the 15th day of the month next succeeding the date upon which the amount due for the use of such water has become due and payable, the City Clerk shall forthwith discon- tinue supplying such water to such consumer. b. That in the event it becomes necessary � to discontinue supplying water to any consumer for failure of said consumer to pay the charges , and subsequently said consumer: shall pay said delinquent charges, then he shall be entitled to have said water service restored upon payment to the City Clerk the fee of $1.00 as a charge for restoring service. i I Section 8 a. That it shall be necessary for any user of such water furnished by the City of Zephyrhills and who, upon this ordinance becoming effective, does not have a meter installed on his or its premises g to so notify the City Clerk of the City of Zephyrhills and said City Clerk shall provide for the installation of a meter in accordance with the connec- tion fees as shown in Section 1 above. b. . That in the event any user shall refuse or fail to comply with this section, then the City Clerk shall notify such user that unless he shall comply with this section within 30 days after notice that water service will be discon- tinued at the expiration of such 30- day period, and the City Clerk shall at the expiration of said 30-day period, discontinue water service to such consumer. Section 9. If any section, clause or provision of this ordinance shall for any cause be held void and of no effect, that it shall not effect the validity of the remainder of this ordinance. Section 10. This ordinance shall take effect immediately upon its becoming a law as provided by the Chart of the City of Zephyrhills, Florida.
