AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA, MAKING IT UNLAWFUL FOR ANY t\
PERSON TO EXPOSE OR EXHIBIT HIS SEXUAL -y r
ORGANS IN ANY PUBLIC PLACE OR ON THE
PRIVATE PREMISES OF ANOTHER OR SO NEAR
THERETO AS TO BE SEEN FROM SUCH PRIVATE
PREMISES, OR TO GO OR TO BE NAKED IN
SUCH PLACE, AND ALSO MAKING IT UNLAWFUL
FOR ANY PERSON TO HANDLE, FONDLE, OR
MAKE AN ASSAULT UPON ANY MALE OR FEMALE
CHILD UNDER THE AGE OF FOURTEEN (14)
YEARS IN A LEWD, LASCIVIOUS, OR INDECENT
MANNER, OR WHO SHALL KNOWINGLY COMMIT
ANY LEWD OR LASCIVIOUS ACT IN THE
PRESENCE OF SUCH CHILD WITHOUT INTENT
TO COMMIT RAPE WHERE SUCH CHILD IS A
FEMALE, AND FURTHER MAKING IT UNLAWFUL
FOR ANY PERSON OR PERSONS TO COMMIT OR
ENGAGE IN ANY LEWD, LASCIVIOUS, OR
INDECENT ACT IN ANY PUBLIC PLACE OR ON
THE PRIVATE PREMISES OF ANOTHER, OR IN
ANY PARKED AUTOMOBILE, AND FIXING THE
PENALTY THEREFOR.
BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ZEPHYRHILLS, FLORIDA,,, AS FOLLOWS:
Section 1. It shall be unlawful for any .person to
expose or exhibit his sexual organs in any public place or
on the private premises of another or so near thereto as to
be seen from such private premises in an indecent and vulgar
manner, or so to expose or exhibit his person in such place
or to go or to be naked in such place. Provided, however,
this section shall not be construed, to prohibit the exposure
of such organs or the person in any place provided or set apart
for that purpose.
Section 2. It shall be unlawful for any person to
handle, fondle, or make an assault upon any male or female
child under the age of fourteen ('14) years in a lewd, lasciviou ,
or -indecent manner, or who shall knowingly commit any lewd
or lascivious act in the presence of such child, without in-
tent to commit rape where such child is a female.
Section 3. It shall be unlawful for any person or
persons to commit or engage in any lewd•, lascivious or inde-.
' cent act in any public place,upon the private premises of
another or in any parked automobile.
Section 4. Any person violating the provisions of
Section 1, Section 2, or Section 3 of this ordinance shall,
upon conviction thereof, be punished by a fine of not more
than Five Hundred and no/100, Dollars ($500.00) or by imprison-
ment in the City Jail for a period not exceeding sixty (60)
days, or both such fine and imprisonment in the discretion
of the Municipal Judge.
Section 5. All ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of
such conflict.
Section 6. If any part of this ordinance shall be
by any Court of competent jurisdiction, held to be unconsti-
tutional, such ruling shall not effect the validity of the
remainder of this ordinance.
Section 7. This ordinance shall become effective
in the manner as provided by the City Charter of the City of
Zephyrhills, Florida.
