I AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA, PROVIDING THAT ALL PERSONS OR
BUSINESS ORGANIZATIONS ENGAGED IN THE
BUSINESS OF SELLING ALCOHOLIC BEVERAGES
AS SET FORTH IN CHAPTER" 561, FLORIDA
STATUTES, 1953 , APPLICABLE TO COUNTIES
HAVING A POPULATION OF OVER 10,000 AND
NOT OVER 40,000 SHALL PAY A LICENSE TAX,
AND PROVIDING THE AMOUNT OF SAID LICENSE
TAX, AND THE TERM OF SAID LICENSE, AND
PROVIDING FURTHER THE PENALTY FOR VIOLA-
TION THEREOF.
BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA.
Section 1. That a license tax shall be paid by
and collected from every person, ,firm, association, or cor-
poration carryingr engaging in ,any of the businesses or
occupations set forth, mentioned; or enumerated in Chapter
561 of the said Beverage Law applicable to counties having
a population of over 10,000 and not over 40,000 according
•to the latest State or. Federal census , the amount of the
said license so collected and paid to be fifty per cent
(50%) of the amount fixed and prescribed by the. said Beverage
Law for a State and County license to carry on or engage in
any of the said businesses or occupations outside of the
incorporate cities and towns , as set forth in the schedule
contained in Chapter 561 of said Beverage Law, each of said
amounts , unless otherwise specifically stated, to be the
amount payable as a license tax for darrying on or engaging
in such businesses or occupations for one year, said amount
to be payable at the same time and in the same manner as pro-
Ivided by prior ordinances for other businesses and occupational
licenses.
Section 2.. Any person, on conviction of violation
of any of the provisions of Section l: above, shall be punished
by a fine of not more than Five Hundred Dollars- ($500.00) , or
by imprisonment in the City Jail for not more than sixty (60)
days, or both such fine and imprisonment at the discretion
of the Municipal Judge of the City of Zephyrhills, Florida.
Section 3. All ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
Section 4. If any part of this ordinance shall, by
any Court of competent jurisdiction,, be held to be unconsti-
tutional, such ruling shall not effect the validity of the.
remainder of this ordinance.
Section 5. This ordinance shall become effective
in the manner as provided by the ; City Charter of the City of
Zephyrhills, Florida.
