AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA, MAKING IT UNLAWFUL FOR ANY
PERSON, IN AN INTOXICATED CONDITION
OR IN A RECKLESS MANNER, TO OPERATE
ANY MOTOR VEHICLE UPON THE STREETS OF
THE CITY OF ZEPHYRHILLS, FLORIDA, AND
PROVIDING THE PENALTY FOR VIOLATIONS
THEREOF.
BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA.
Section 1. It shall be unlawful for any person while
under the influence of intoxicating liquors , or while in an
intoxicated condition, to drive or operate any automobile or
other motor vehicle over or upon the streets of the City of
Zephyrhills.
Section 2. It shall be unlawful for any person to
drive or operate within the limits of the City of Zephyrhills,
Florida, any motor vehicle in a manner that will endanger
life ' limb, or property, regardless of speed.
Section 3. Any person violating the provisions of
Section 1 or Section 2 above, upon conviction thereof, shall
be punished by a fine of not less than:
(1) Twenty-five Dollars ($25.00) , or by imprison-
ment for a period; of not more than ten (10)
days for the first offense.
(2) One Hundred Dollars ($100.00) , or by imprison-
ment for a period, of not more than thirty (30)
days for the second offense.
(3) Two Hundred and Fifty Dollars ($250.00) , or by
imprisonment for a period of not more than
• sixty (60) days for the third offense.
(4) Five Hundred Dollars ($500.00) , or by imprison- 3/
ment for a period of not more than sixty (60)
days for the fourth..offense.
Or, for each offense, both such- fine and imprisorn-
ment as is provided for, in the discretion of the
Municipal Judge.
Section 4. All ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
Section 5. If any part of this ordinance shall, by
any Court of competent jurisdiction, be held to be unconsti-
tutional, such ruling shall not effect the validity of the
remainder of this ordinance.
Section 6. This ordinance shall become effective
in the manner as provided by the City Charter of the City of
Zephyrhills, Florida.
