IAN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
( FLORIDA, RESTRICTING THE GROSS WEIGHT
( LOAD CAPACITY OF MOTOR 'VEHICLES UPON THE
, I STREETS OF THE CITY OF ZEPHYRHILLS,
FLORIDA, TO A MAXIMUM SPECIFIED WEIGHT,
AND PROVIDING THE PENALTY FOR VIOLATION
THEREOF.
BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA.
Section 1. The gross weight imposed on the highways
or streets of the City of Zephyrhills by the wheels of any
one axle of a vehicle shall not exceed eighteen thousand pounds
(18,000#) .
Section 2. Any person 'who violates the overload
provisions of Section 1 above shall be conclusively presumed
to have damaged the streets of the City of Zephyrhills , Florida,
by reason of such overloading, which damage is hereby fined as
follows:
One cent per pound per each-pound -.in'=:excess gross
weight when the excess' exceeds one thousand pounds
(1,000#) and is two thousand pounds (2,000#) or less.
Two cents per pound per each pound of excess gross
weight when the excess exceeds two thousand pounds
(2,000#) and is three thousand pounds (3,000) or
less.
Three cents per pound per each pound of excess gross
weight when the excess - exceeds three thousand pounds
(3,000#) and is four thousand pounds (4,000#) or. less
Four cents per pound per each pound of excess gross
weight when the ' excess ' exceeds four thousand pounds
(4,000#) and is five thousand pounds (5,000#) or less
Five cents per pound per each pound of excess gross
weight when the excess exceeds five thousand pounds
( 51000#) .
Such penalties are not at any time to exceed Five
Hundred Dollars ($500.00) , or sixty (60) days in the City

Jail or both such fine and imprisonment in the discretion
of the Municipal Judge.
Section 3. All ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
Section 4. If any part of this ordinance shall, by
any Court of competent jurisdiction, be held to be unconsti®
tutional, such ruling shall not effect the validity of the
remainder of this ordinance.
Section 5. This ordinance shall become effective
in the manner as provided by the City Charter of the City of
Zephyrhills , Florida.
