HomeMy WebLinkAbout1956-03-03 (42) Parking Meter Areas and Zones , II • AN ORDINANCE PROVIDING FOR PARKING METER AREAS AND ZONES TO BE DESIGNATED AND THE PERIOD REGULATIONS IN SAID ZONES TO BE IN EFFECT: PROVIDING FOR LEGAL PARKING TIME AND AREA FOR PARKING TO BE DESIGNATED: PROVIDING PARKING AREA DESIGNATED BY LINES AND PROVIDING FOR PARKING WITHOUT SAID AREA UNLAWFUL: PROVIDING FOR PARALLEL AND DIAGONAL PARKING IN SAID ZONES: PROVIDING FEES: PROVIDING EXCEPTIONS TO REGULATIONS TO PARKING METER AREAS: FIXING THE TIME LIMITS FOR PARKING IN PARKING METER SPACES: PRO- VIDING IT SHALL BE UNLAWFUL TO DEPOSIT ANY SUBSTITUTE FOR A COIN OF THE UNITED STATES IN ANY PARKING METER: PROVIDING FOR VIO- LATIONS OF THIS ORDINANCE TO BE REPORTED: PROVIDING A PENALTY FOR VIOLATION TO THIS ORDINANCE: PROVIDING FOR EVIDENCE OF ILLEGAL PARKING: PROVIDING TAMPERING WITH METERS TO BE UNLAWFUL: PROVIDING USE AND DISTRIBUTION OF FEES: PROVIDING FOR COIN COLLECTIONS FROM PARKING METERS. BE IT ORDAINED" BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA: Section ± l . DEFINITIONS. '(1 ) VEHICLE shall mean any device in, upon or by whit any person or property is or may be transported upon a highway, ex cept a device which is operated upon the rails 0r tracks . (b) STREET shall mean any public street, avenue, road, boulevard, highways or other public place located in the city, and established for the use of vehicles. (c) PERSON shall mean and include any individual , fir , co-partnership or corporation. (d) OPERATOR shall mean and include every individual, who shall operate a vehicle as the owner thereof, or as an agent, employee, or permittee of the owner. (e) A PARKING METER SPACE shall be defined, for the purpose of parallel parking, as a space approximately twenty-two feet in length along the curb, and for the purpose of diagonal par - ing , as a space approximately eleven feet along the curb, marked b appropriate lines in the street and with a parking meter set in place adjacent thereto. Section 2. ZONES DESIGNATED; PERIOD REGULATIONS IN EFFECT. The City Clerk is hereby authorized to establish immediately, zones to be known as parking meter zones, in the Loll w- ing street, avenues, and boulevards: Fifth Avenue: From the alley between Gall Boulevard and 6th Street1East to 9th Street (both sides ) Eighth Street: From 5th Avenue to 4th Avenue (on the West side only) Eighth Street: From the alley between 5th Avenue • and 6th Avenue to 5th Avenue (both . sides) Seventh Street: From the alley between 5th Avenue and 6th Avenue, South to 4th Avenue (both sides) Gall Boulevard: From 4th Avenue to 5th Avenue (the West side only) and to be in effect all week days , including Saturday, from 8 A.M. to 6 P.M. , Sundays and holidays excluded. Section 3. LEGAL PARKING TIME AND AREA AVAILABLE' FOR PARKING TO BE DESIGNATED. . Parking meters installed in the parking meter zones established, as provided in Section 2 hereof, shall be placed upon the curb immediately adjacent to the individual parking spaces: . hereinbefore- described. Each parking meter shall be placed or: set in such a manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking meter installed shall indicate by a proper legend the legal parking time established by the city, and when operated shall indic to on and by its dial and pointer, the duration of the period of 'legal parking, and on the expiration of such period, shall indicate il- legal parking. Section 4. PARKING AREA DESIGNATED BY LINES: PARKING WITHOUT AREA UNLAWFUL. The City Clerk shall have lines or markings painted or placed upon the curb and or upon the street adjacent to each park- ing meter for the purpose of designating the parking space for which the meter is to be used and each vehicle parked adjacent or next to any parking meter shall park within the lines or markings so established. , It shall be unlawful and a violation of this ordi- nance, to park any vehicle across any such line or markings so established, or to park the vehicle in such a position that the same shall not be entirely within the area so designated by such lines or markings. Section 5. PARALLEL PARKING.AND DIAGONAL PARKING. ' When a parking space in any parking meter zone is parallel with the adjacent curb or sidewalk, any vehicle parked in any such space shall be parked so that the foremost part of such vehicle shall be nearest to the parking meter; when a parking space in any parking meter zone is diagonal to the curb or sidewalk, any vehicle parked in any such space shall be parked with the foremost part of such vehicle nearest to such meter. Section 6. FEES; Exceptions . (a) When any vehicle shall be parked in any space adjacent to which a parking meter is located in accordance with the provisions of this ordinance, the operator of the vehic-le � shall upon entering the parking space, immediately deposit or cause to be deposited, a coin or coins, of the United States, in such park- ing meter, as directed in the instructions on the meter, and immed- iately put meter in operation and failure to deposit such coin or coins shall constitute a breach of this ordinance, and shall sub- ject such operator to the penalty prescribed in Section 9 thereof. Upon the deposit of such coin or coins, the parking space maybe lawfully occupied by such vehicle during the period of parking time in accordance with the time limitations as designated on the parking meter. If the vehicle shall remain parked in any such parking space beyond the parking time limits fixed for such parking space, the parking meter shall indicate by its dial and pointer, such illegal parking, and in that event, such vehicle shall be considered as parked overtime and beyond the period of legal park- ing time and the parking of a vehicle overtime or beyond the period of legal parking time in any such part of a street or avenue where such meter is located, shall be a violation of this ordinance and punished as hereafter set forth. (b) Nothing in this ordinance is to be construed as prohibiting the city from providing space for the parking of taxi- cabs or buses in parking meter zones without parking meters. Section 7. OVERTIME PARKING. (a ) It shall be unlawful and a violation of the pro- visions of this ordinance for any person to cause, allow, permit or suffer any vehicle registered in the name of, or operated by such person to be parked overtime or beyond the period of legal parking time established by any parking meter zone as herein de- scribed. Provided, however, that every hour of over time parking is a separate and distinct offense and shall be considered a continuing offense. (b) It shall be unlawful and a violation of the pro- visions of this ordinance for any person to permit a vehicle to remain or be placed in any parking space adjacent to any parking meter while the meter is displaying a signal indicating that the vehicle occupying such parking space has already parked beyond the period of time prescribed for such parking space on the park- ing meter adjacent to such space. Section 8. FAILURE TO DEPOSIT FEE. It shall be unlawful and a violation of the provisions of this ordinance to deposit or cause to be deposited in any park- ing meter, any slug, device or metallic substance, or any other substitute for a coin of the United States. Section 9. ' VIOLATIONS TO BE REPORTED: PENALTY FOR VIOLATION. It shall be the duty of the police officers of the city to report: (a) The number of each parking meter which indicated the vehicle occupying the parking space adjacent to such parking meter is, or has been, parking in violation of any of the provision of this ordinance. (b) The state license on such vehicle. (c) The time of day or night the officer detected such violation to the provisions of this article. (d) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. (e) Each officer shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has- been parked in violation of a provision of this ordinance and summoning such owner or operator to appear before the Municipal Judge in regards to such violation. That any violator of the provisions of this ordinance, upon receiving a summons issued by the city police, may discharge such summons by paying $.25 penalty to the City of Zephyrhills within 72 hours from the date of the issuance of such summons or if such violator shall not pay $.25 as provided above within 72 hours, such violator may discharge the summons is- sued by paying the City of Zephyrhills $1 .00 provided however. such payment be made within five days from the issuance date of any such summons and provided further that in lieu thereof , any alleged violator of these provisions must appear before the Municipal Judge in answer to any such summons being issued. Section 10. LICENSE TAG NUMBER PRIMA FACIE EVIDENCE OF ILLEGAL PARKING. In any hearing of the municipal court on a charge of illegally parking a motor vehicle, testimony that a vehicle bear- ing a certain license plate was found unlawfully parked as pro- hibited by the provisions of this ordinance or testimony that the records of the registrar of motor vehicles show that the license plates were issued to the defendant, shall be prima facie evidence that the vehicle was unlawfully parked, was so parked, permitted or supposed to be parked by the defendant. A certified copy showing such fact from the registrar or deputy registrar shall be proof of ownership. Section 11 . TAMPERING WITH METERS. It shall be unlawful for any person to deface, injure, tamper with, open or wilfully break, destroy or impair the useful- ness of any parking meter installed under the provisions of this ordinance. Section .12.x. USE AND DISTRIBUTION OF FEES. The coins required to be deposited in parking meters, as provided herein, are levied and assessed as fees to provide for the proper regulation and control of traffic upon the public street and avenues, and also the cost of supervision and regulating the parking of vehicles in the parking meter zones created hereby, and to cover the cost of the rental, purchase, supervision, protection, inspection, installation, operation, maintenance, control and use of the parking meters described herein. Section 13. COIN COLLECTIONS FROM PARKING METERS. The coins required to be deposited in the parking meters are to be collected by some person named by the City Clerk, such collector to be bonded in the amount of $1,000.00. . i Section . All ordinance or parts of ordinances in conflict herewith are hereby repealed to the extent of such con- f i.ct. Section . If any part of this ordinance shall , by any Court of competent jurisdiction, be held to be unconstitution al , such ruling shall not affect the validity of the remainder o this Ordinance. Section . This ordinance shall become effective in t e manner as provided by the City Charter of the City of Zephry hills, Florida.
