THE WATER MAINS AND PIPES; AND PROVIDING FOR THE ENFORCEMENT AND COLLECTION OF WATER RENTS.; FORBIDDING CERTAIN ACTS CON- CERNING SAID WATER WORKS EQUIPMENT AND PROVIDING A PENALTY THEREFOR. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYR ' HIL S, FLORIDA: SECTION 1. That water rents shall be payable quarterly in dvance, and that the quarterly rate to be charged customers for the use of water taken from the mains and pipes of the City Water Wor s shall. be as follows: For the fir-st 12,000. gallons, $3.50 For all excess over 12,000, per 1,000 gallons Pro ided that the minimum charge of $3.50 shall be collected whether Ai9 the customer uses '12,000 gallons or less than that amount . Provided, or buildings fur her that where two or more houses,�take water through one meter the rate to be charged shall be the minimum of $3.50 per quarter for or building eac houseAso served by such meter, that is to say that each and every or e 1 served with water through the mains or pipes of the City Water Wor s shall be charged the minimum of $3.50 per quarter. SECTION 2. A service charge of $15.50 shall be paid beflore the installation of meter service or connection with the water mains orpipes of the City Water Works. Said amount shall be deposited with \ h the City Clerk before commencement of the work of installing the meter or aking connection with the water mains or pipes. SECTION -3•. That there be created in the City of Zephyr- Public Welfare Board hills a WtxWrkgx to consist of three (3) persons who sh 11 be residents of the City of Zephyrhills, and shall be freeholders Board ov r the age of 21 years. Which said shall ; be appointed by the Mayor of the City of Zephyrhills and their appoint- me t shall be confirmed by the City. Council. That upon their appointment Board until the end of the r sent Fiscal an confirmation, said ~ shall serve,1for a term of two Year, andI ye rs s from the date of such appointment1shall receive no then compensation for their services. It shall be the Welfare Board duty of ,the x •to investigate each case of de- linquency and non-payment of water rent by any person and if no emergency, as hereinafter defined; is found to exist, the Board shall forthwith direct the City.Marshall of the City of Zephyrhills to cut off the water of such person in arrears of water rent in the manner as hereinafter provided. SECTION 6 . It shall bed unlawful for any person to tap or make any. connection with the 'ity water- mains or pipes w thout first procuring therefor a written permit from the proper city authorities . No person except a City official -or an employee o the water department of the City shall open or examine any mete or meter box, or open any valve, or turn the water on or- off. It shall be unlawful - fOr any person to do anything abusive or SECTION 6; Addition. Provided; Nothing in this section shall apply to repairs, changes, or alterations, or us`e of pipes or water, by the owner of property within or on his property. ----------------- vti..-,-•- i-:. -......•_,.. __ -...-. -.,...-.....,. _,,,.,,,.. sentence, clause, phrase or word -of this Ordinance, is for any reason held or declared to be unconstitutional, inoperative or void; such holding or invalidity 'shall not affect the remaining portions of this - Ordinance ; and it shall be construed to have been the legislative intent to pass this, Ordinance without such •i, 'e .• I • unconstitutional, inoperative or invalid. part , therein; and the remainder of this Ordinance, after the exclusion of , such • part or parts shall be de-erred and held to be valid a's if such excludea tarts' had not been included herein; or if this Ordinance, or any provision thereof, shall be held inappli- cable to any 'person, groupsof persons, property, kind of property, circumstances or set of circumstances, such holding shall not affect the applicability .thereof- to any other person, property or circumstance . SECTION S. That all Ordinances and -parts of Ordinan es in conflict with the provisions 'hereof be, and . the same are, hereby repealed, and that Ordinance No. 47, the same being an Ordinance regulating the Water Works system of Zephyrhills, Florida, and the' use thereof; fixing the rates to, be charged, for water and for making connections with the .water mains and pipes ; and forbidding certain acts in connection therewith, be, and the same is hereby repealed.
