AN ORDINANCE TO AMEND ORDINANCE No. 104
WHICH SAID ORDINANCE CREATED THE OFFICE OF
CITY MANAGER OF THE CITY OF ZEPHYRHILLS,
FLORIDA, AND WHICH PROVIDED FOR THE APPOINTMENT
OF SUCH CITY MANAGER AND PRESCRIBED HIS DUTIES
TERM OF EMPLOYMENT COMPENSATION AND SO FORTH
AND AMENDING SAID ORDINANCE IN RSPECT TO THE
DUTIES OF THE SAID CITY MANAGER AND HIS TERM
OF OFFICE AND HIS COMPENSATION- BE IT ORDAINED
AND ENACTED BY THE CITY COUNCIL OF THE CITY
OF ZEPHYRHILLS AS FOLLOWS:
Section 1. That Sub®section (b) of Section 2
f Ordinance 104 be and the same is hereby amended so that when
mended the same shall read as follows:
"That the City Manager shall have no responsibility
as to the enforcement of the laws and Ordinances
of the City of Zephyrhills , except that when in
the performance of his duties , it might come to
his attention that some of the Ordinances of the
city are being violated, that he shall call the
same to the attention of the proper law enforcement
officers of the city."
Section 2. That Section 3 of Ordinance 104 be and
the same is- hereby now amended so that when amended it shall
ead as follows:
"Sectio3That the compensation :of the., City
Manager as the city council-may- from time
to time determine and shall be payable Ujfl regu-
lar monthly ±ntallments , provided, Uhqwever,
that the Gity Council- may notreduce the amount
of such compensation during the term of employment
as is provided for by the succeeding section."
Section .3.".. That Section 4 of Ordinance be and the
ame is herebyamended,.so that when so amended, the said section
hall read -as follows:
"Section 4. - That the City Manager shall be
appointed by the City Council upon the majority
vote ,of. the City 'Council and that when once having
(been appointed the City Manager, shall remain in
office until through and .including the 31st day
of the succeeding.. July and he shall be deemed to
be automatically re.-.app.oint'ed from year to year
' U U without, further action by the City. Council unless
the City Council -hall at or. before its first
regular meeting in July of any, year by. vote of
the council by majority vote determine that the
services of the then City Manager shall be
dispensed with as. of the.. end of July of'i that year
provided, however,that the said :City .Council shall -
have the right to remove the: said City Manager at
any time upon establishing that he has been guilty
of misfeasance or nonfeasance of his
'duties and that he has willfully neglected
the duties assigned to him and that in the
event that any charges of such malfeasance
or misfeasance in office shall be directed
against the said City Manager that they will
be filed with the City Council in writing by
any Councilman or citizen of the City of
Zephyrhills and that if the City Council deem
that the same be worthy of investigation or
action, that a copy thereof shall be promptly
furnished to the C .t3T Manager and a date set
for a hearing thereon not less than five days
from the date of the serving of a copy of such
charges upon such City Manager and that at the
date so set that the City Council shall hear
evidence pertaining to such charges both for
and against the said City Manager and shall
thereupon determine whether or not the said
charges have been substantiated and proven
and if by majority vote of the City Councilmen
it shall be determined that such charges set
/4-the acts of misfeasance and nonfeasance
which would justify the removal of the said
City Manager, and that such charges have been
substantiated by the evidence adduced before
the City Council, then the City Manager may
Thereupon be removed by the majority vote of
said City Councilmen.
REPEALING CLAUSE: That all Ordinances or parts of
Ordinances in conflict herewith be and the same are hereby now
repealed.
SAVING CLAUSE: If any section, sub-section, sentence,
paragraph or provision of this Ordinance shall for any reason
be held invalid or of no effect, that it shall not affect the
remaining portions of this Ordinance; and it shall be construed
so as to have been the legislative intent to pass this Ordinance
without such unconstitutional, inoperative or invalid portions
thereof.
