NO. _________ AN ORDINANCE REGULATING AND AUTHORIZING THE CITY OF ZEPHYRHILLS, A MUNICIPAL CORPORATION OF FLORIDA, TO PERMIT AND AUTHORIZE THE. BUILDING. OF CITY STREETS BY PRIVATE INDIVIDUALS AND PRESCRIBING THE. STANDARDS. AND METHODS THEREFOR. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, AS. FOLLOWS : Section 1. Private individuals establishing subdivisions and requiring paving of certain streets, which streets are already dedicated as public streets within the city limits of the city of Zephyrhills, may by this Ordinance make application to the City Council for permission to construct such streets at their own expense, and the City Council may by this Ordinance allow per— mission to construct such streets so long as the streets are so constructed according to plans and specifications as hereinafter stated. Section 2. Be it further ordained that any person requesting the opening of any street, which has been dedicated as a public street , must make such application to the City Council d the City of Zephyrhills. Section 3. Be it further ordained that any applicant making application for th:e establishment of any new streets shall first ascertain and certify to th,e City that the street has been previously dedicated by act of the City Council, or if the street is to be dedicated, thr right—of—way for said street shall be not less than sixty feet in width. All .streets to be paved or con— structed shall be so pared or constructed according to the rules and specifications as hereinafter set out : All streets in a Subdivision Plat or in City right-of-'way or persons to be paved by any..persoi submitted for approval by th-e City Council , . r 1 must be paved for a minimum width of 20 feet and a minimum depth of inches compacted, with a prime coat, and double surface treatment x / meeting city of Zephyrhills paving specifications. - 2 -- GRADING: The su.bgrade shall be of a non-plastic soil constructed to line and grade, subgrad-e to be thoroughly compacted prior to placing base course. PAVING: The base course shall be- 6 inches compacted clay, lime— rock, or shell . The loose material to be placed on prepare.d sub— grade thoroughly compacted, an-d shaped to line and grade. In the construction of sand—clay base, natural sand—clay shall be a natural m aterial cons'isting largely of a mixture of sand and clay in proper proportions, artificial sand-clay shall consist of an artificial mixture composed largely of sand and clay and made by mixing together on the road such quantities of two or more naturally occurring materials as will produce the proper proportions in the combination after mixing. The sand-clay shall have a plastic. mix of not more than 12, and a li-quid limit of riot more than 30. PRIME. COAT : T'he prime coat shall be RC-1S cut-back asphalt, applied oi! the completed base at th,e rate of 0. 15 gallons per square yard. SE.RFACE TREATMENT: Bituminous wearing sur:fact shall consist of construction of a two (2) course surface treatment of slag and emulsified asph It as specified below. The first course of' surface treatment shall consist of an application of emulsified asphalt Grade RS-2 at the rate of approxi- mately 0. 36 gallons per square yard, then covered with approximately 0L40 cubic foot per square yard of slag Grade No. 12-C, after proper rolling and brooming ; a second application of emulsified asphalt Grade RS.-2, shall be applied at the rate of approximately 0. 20 gallons per squaare yard, the preceding course to be choked with an application of approximately 0. 20 cubic foot per square yard of Grade . No. 18:.S•l ag. 1 � • 1 — 3 — Any person making application fort he approval of -streets- to be paved or established shall furnish the City with a plat and plan profile, which profile s-hall show the lines and grades of the streets to be paved or established. Such plat and plan profile shall first be approved by the City . 1 Section 4. Be it further ordained that the City Council of the City of Zephyrhills shall approve or reject all paying and/ or establishment of streets upon the recommendation of the City Engineer-, or such other competent and qualified engineer as the r City may employ. Section S. Upon the applicant having been granted per— mission to construct a street , and the street having met all specifications required by the City, the City shall inspect the said streets during the time of construction, as well as upon completion, dete.rminiing if all requirements have been met, and the City at its -discretion may require the applicant to do such additional repairs as in its discretion it feels should be made, and upon the complete satisfaction of the City Council, it shall accept the street and it shall he treated as any other street for the purpose of further repair and maintenance. REPEALING CLAUSE: All ordinances or parts of ordinances of the City of Zephyrhills, Florida, in conflict herewith be, and the same are hereby repealed. SAVING CLAUSE : If any section, sub—section, sentence, clause, phrase, or word of this ordinance is, for any reason, held or declared to be unconstitutional , inoperative or void, such holding or invalidity shall not affect the remaining portions of this Ordinance; and it shall be construed to have been the legis- lative intent to pass this Ordinance without such constitutional , ilnoperative or invalid parts therein; and the remainder of this Ordinance, after the exclusion of such part or parts, shall be 4 - deemed a-nd held to be valid as if such excluded parts had not been included herein; or, if this ordinance or any provision thereof shall be held inapplicable to any person, groups- or persons`, pro- pe{rty, kind of property, circumstance, or act of circumstance, such holding shall not affect the applicability thereof to any other person, property or circumstance.
