FLORIDA, AMENDING ORDINANCE NO. 7S,ENTITLED:
"AN ORDINANCE OF TIIR CITY OF ZEPHYRHILLS, _
FLORIDA, RESTRICTING THE LOCATION 'WHEREIN
PLACES OF BUSINESS FOR THE SALE. OF ALCOHOLIC
BEVERAGES CONTAINING MORE THAN .FOUR .PER CENT
� OF ALCOHOL BY VOLUME MAY BE LOCATED; PROHIBITING
THE. CONDUCT OF SUCH BUSINESS, FOR THE SALE' OF
SUCH BEVERAGES. WITHIN A ZONE LOCATED WITHIN
THE CORPORATE LIMITS OF THE' CITY OF ZEPHYRHILLS,

LICENSE SHALL BE GRANTED FOR THE CONDUCTING OF
ANY 'SUCH BUSINESS. WITHIN THE. ZONE HEREIN DEFINED:"
WHEREAS, the City Council o-f 'the City of .Zephyrhills,
F orida, deems the restriction, as imposed by OrdinanceNo. 78
as heretofore passed, to be unreasonable and
WHEREAS, the City Council deems it to the best interest
o all thoseparties concerned,
NOW THEREFORE BE IT :ORDAINED BY' THE CITY COUNCIL OF THE
C TY .OF ZEPHYRHILLS., FLORIDA, AS. FOLLOWS.:
Section 1. That paragraph one of Ordinance No, 78,
-e titled 'as follows:
AN ORDINANCE OF- THE CITY OF ZEPHYRHILLS, FLORIDA,
RESTRICTING, THE. LOCATION WHEREIN PLACES OF BUSINESS
FOR THE SALE. )F ALCOHOLIC BEVERAGES CONTAINING MORE
THAN :FOUR PER 'CENT -OF ALCOHOL BY VOLUME."MAY 'BE'
LOCATED; PROHIBITING- THE CONDUCT OF SUCH 'BUSINESS
{ FOR THE. SALE OF 'SUCH BEVERAGES, WITHIN A ZONE LOCATED
WITHIN THE CORPORATE. LIMITS. OF THE CITY LIMITS OF
THE -CITY OF ZEPHYRHILLS., FLORIDA., HEREIN DESCRIBED;
AND PROVIDING THAT NO LICENSE SHALL BE GRANTED FOR
THE CONDUCTING OF ANY SUCH .BUSINESS. WITHIN THE ZONE.
HEREIN DEFINED:
b and the same is hereby amended to read as follows:
That it shall b.e unlawful for any person-, party, firm
o corporation, to establish, conduct, manage, or 'carry on the
business of selling, vending., or dispensing alcoholic beverages of
m re than four per cent (4%) of alcohol by 'volume, within the
b undaries of the following -described zone, to-wit:
Within 200 feet of the Center line' .of Fifth Av-enue;
Within 100 feet of. the Center line of Walter Gall
Boulevard, Between South. Avenue and. Twelfth Avenue;

Within. 100 feet of the Center line of 'South Avenue;
s id streets and territory herein defined lying and being within
t1e corporate limits of the City of Zephyrhills, Florida.
Section 2. That paragraph. two of said Ordinance No., . 78
be, and the same is hereby, amended to read 'as follows:
That the location of such -businesses for the sale of
such alcoholic beverages shall be restricted to that part of the
City of Zephyrhills, Florida, not ' embraced within, the limits of
zone described inthe amendment to Ordinance No. 73, said amendment
being -Ordinance No. ; and no license shall be granted or
issued to conduct a place of 'business- for the sale of such alcoholic
b verages within the said zone described in the amendment to'
O dinance No. 78.
Section 3-. All other provisions of said Ordinance
78., not in ,conflict herewith., r-emain the same.
Section 4. All ordinance or partsof ordinances in
conflict herewith are hereby repealed to the extent of such conflict.
Section '5. If any part of this ordinance- shall, by
a ,y Court of 'competent jurisdiction, b.e held to- be unconstitution 1,
such ruling shall not -affect the validity of the remainder of this
O' dinance.
Section 6. This ordinance shall become effective in
t e manner as provided by' 'the City Charter of the City of Zephyr-
hills, Florida.
