ANEN1 'IENT TO ORDINANCE NO. 88-=-AN ORDINANCE REGULATING
AND RESTRICTING THE HEIGHT, NUMBER OF STORIES, AND SIZE
OF BUILDINGS AND OTHER STRUCTURES, THE PERCENTAGE OF LOT
THAT MAY BE OCCUPIED, THE. SIZE I OF YARDS, COURTS AND OTHER
OPEN SPACES, THE DENSITY OF POPULATION, AND THE LOCATION
AND USE OF BUILDINGS, STRUCTURES, AND LAND AND WATER FOR
TRADE, INDUSTRY, RESIDENCE AND OTHER PURPOSES WITIIIN THE
CITY OF ZEPHYRI-IILLS, FLORIDA--';PROVIDING FOR THE SUB-
STITUTING OF TIIE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS
TO ACT IN THE STEAD OF THE BOARD OF ADJUSTMENT PROVIDED
FOR IN SAID ORDINANCE NO. 88 WHENEVER THE SAID BOARD OF
ADJUSTMENT IS NOT FUNCTIONING . ,
WHEREAS, the City Council of the City of Zephyrhills has
h�(retofore passed a Zoning Ordinance, above referred to, wherein
s id ordinance provided for the establishment of a Board of
A justment, which said Board of Adjustment provided for -five
m tubers, - and their duties were .to .hear and make special exceptions
t the terms of said zoning ordinance in harmony with its general
p rpose and intent and in accordance with general or specified
r les therein contained, and to hear appeals by any person
aggrieved or by any officer or bureau affected by any decision
of the building inspector, and
WI-IEREAS, heretofore it has been difficult to obtain the services
.of persons to act as members of said Board of Adjustment, and that
no the said Board of Adjustment is 1not functioning, by reason of
inability to obtain the services of ;ones to serve as members theref,
and .
WHEREAS, it is imperative that ithere be some lawful designate
body upon whom responsibility can rest .as regards making specific.
ex ept ions to the terms of said zoning ordinance in harmony with
it general purpose and intent and in accordance with general or
sp cified rules therein contained,, and, to hear appeals. by any
pe son aggrieved or by any officer or bureau affected by any
de ision of the building inspector,
NOW, THEREFORE, BE IT ORDAINED ;BY TILE CITY COUNCIL OF THE
CI Y OF ZEPHYRHILLS, FLORIDA, AS FOLLOWS:
TI-IAT Section 9, entitled "Board of Adjustment," of the fore-
going Ordinance No. 88, above referred to, be amended to the effec
that the City Council of the City of. Zephyrhills shall and do

h reby have concurrent jurisdiction to do all things that the
B6ard of Adjustment has heretofore been authorized to do in Section
• t 7 I.
9 of said Ordinance No . 88, and any other things necessary in
order to carry out the terms of said ordinance in harmony with
its, general purpose and intent and in accordance with general or
si ecified rules therein contained.,
All other parts of Ordinance No. 88, hereinabove referred to,
are hereby reiterated and are to remain in full force and effect .
The foregoing Amendment to Ordinance No. 88 was read and
passed on its first reading by the City Council of the City of
