Home My WebLink About1961-07-03 (147) Adoption of Model Traffic Ordinance GRD INANCE NO.�J____ AN ORDINANCE ADOPTING MODEL TRAFFIC ORDINANCE FOR MUNICIPALITIES, WITH CERTAIN EXCEPTIONS AND MODIFICATIONS AS SET FORTH IN CHAPTER 186$ FLORIDA STATUTES; PROVIDING PENALITIES FOR THE VIOLATION OF TRAFFIC REGULATIONS; AND PROVIDING FOR CREATION OF TRAFFIC COMMITTEE. _ WHEREAS, Section 186.02,. Florida. Statutes, 1959, provides that any incorporated r city or town may adopt Model Traffic Ordinance fox Municipalities as set forth in Chapter 186, Florida. Statutes, 1959, as to any part or all without setting forth the provisions in full; , and i • WHEREAS, the City of Zephyrhills does, by this Ordinance, elect to avail itself of said Model Traffic Ordinance for Municipalities wi h certain exceptions and modifications of said ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT OF ZEPHYRHILLS, FLORIDA., a.s follows : SECTION I. That Chapter 186$ Florida Statutes , 1959, entitled Model Traffic Ordinance for Municipalities be$ and the same is hereby adopted by reference, excepting the following sections and portions of said Chapter 186: Section 186.10 through Section 186.41, both inclusive; Section 186.49 Section 186.73(2) Section 186.0104(f) Section 186.0177 Section 186.0194 SECTION II: (1) Section 186,10 through Section 186.41, both inclusive, Florida Statutes, 1959, entitled Model Traffic Ordinance for Municipalities be, and the same is hereby adopted by reference with the exception that where the words "traffic engineer's are shown that the same, for all -1- intents and purposes of this Ordinance, shall mean and include. "traffic committee"9 (2) The "traffic committee", a.s is set forth in the preceeding stub-paragraph, shall include the Chief of Police of the City of Ze; hyr-- hills , the Mayor of the City of Zephyrhills, and a. Councilman for the City of Zephyrhills to be named and designated by the President of the City Council of the City of Zephyrhills. SECTION III: Penalities for violation: Any person or persons who violate the provisions of this Ordinance, with the exception of the provision and penalities set forth in Section IV below, shall, upon conviction hereof, be :.punished by a fine of not more than $100..00; or by imprisonment in the City Jail for not more than sixty (60) days, or both. SECTION IV: Driving while under the influence of liquor or drugs : (1) It is a violation of this, Ordinance for any person, while nder the influence of intoxicating liquor or narcotic drugs, or my other drugs, wh en hen effected to the extent that his or her normal faculties a e impaired, or who is a. habitual user of narcotic drugs or othe .;dru:g� , to drive any vehicle upon any street within this municipality. (2) Every person who is found guilty of a. violation of this Section shall, upon conviction thereof, be punished by a fine of not less than $50.00 or not more than $500.00, or by imprisonment in the City J. .il for not more than sixty (60) days, or both. (3) Every finding of guilty under this Section shall be rep rted to the Department of Public Safety of Florida, .or such other a.gen y as may by statute be designated for the purpose of supervising the licensing of drivers and chauffeurs. SECTION V: Section 186.0104(f) be, and the same is hereby adopted by reference a.� a part of said Chapter 186, with the exception that the said sub- -2- i V - paragraph (f) shall read "within 10 feet of a. crosswalk at an inter- section", SECTION VI: Schedules of designated one-way street; through streets and parking of vehicles: SCHEDULE II (1) ONE-WAY STREETS : In accordance with Section 186.96., Flo ida. Statutes$ 1959, entitled Model Traffic Ordinance for Municipalities, when properly signposted, traffic shall move only in the direction i dica.ted upon the following streets : Name of Street Direction of Traffic Movement Eighth Street from Ninth Avenue to South Avenue Southerly direction ire ta.on Ninth Street from South Avenue to Ninth Avenue Northerly direction SCHEDULE III (1) THROUGH STREETS : In accordance with Section 186.12, Flo ida Statutes, 1959, :entitled Model Traffic Ordinance for Municipalities and when. signs are erected giving notice thereof, drivers of vehicles Beall stop a.t every intersection before entering any of the following streets or parts of streets : Name of Street Portions Effected Fourth Avenue ; All portions, except that all traffic moving on Fourth Avenue shall stop and yield the right-of- way at the. intersection of Ud S. Highway 301 and said Fourth Avenue. Sixth Avenue I All portions, except that, all traffic moving on said Sixth Avenue shall stop and yield the right-of- wa.y at the intersection of Highway 301 and said Sixth Avenue, and at the intersection of Twelfth Street and said Sixth Avenue, South Avenue All portions, except that al traffic moving on South Aveni.e shall stop and yield the right-of- way at the intersection of U. S. Highway 301 and said South ,A enue, or conform to traffic light located at said intersection, -3- Ninth Avenue All portions, except that all traffic moving on Ninth Avenue shall stop and yield the righ -of- way at the intersection of U. S. Highway 301 and said Ninth AveInue, and at the intersection of Twelfth Street and said Ninth Avenue. Tenth. Avenue All portions lying West of U. S. Highway 301, except that all raffic moving East on Tenth Avenue s all stop and yield the right--of-w1ay a.t the intersection of U. S. Highway 301 and said Tenth Avenue.. Twelfth Avenue All portions, except that all traffic moving on Twelfth Avenue shall stop_ and yield the right-of-way at. the intersection of U. S. Highway 301 and .s.a.id Twelfth Avenue, and at the intersection of Twelfth Street and said Twelfth Avenue. Fifth Avenue All portions, except that all traffic moving on said Fifth Avenue s all stop and yield the right--of-way at the intersection of U. S. Highway 301 and said Fifth Avenue, or conform to traffic light located a.t said inter- section; and it is further authorized that stop signs be erected a.t the intersections of Seventh, Eighth and Ninth Streets and said Fifth (Avenue, indicating that traffic moving on said Seventh, Eighth and Nint Streets shall stop at said Fifth Aven e; and that Yield Right-of-Way signs be erected at intersections of all other streets intersecting said Fifth Avenue indicating that all traffic moving on said streets shall yield righ -of-way at said Fifth Avenue. SECTION VII: If any provisions of this Ordinance shall be declared unconst ' - t tional or invalid, it shall not effect any part of the other provisions of this Ordinance, and same shall remain valid and enforceable. SECTION VIII: If any Ordinance or portion oflOrdinance enacted prior, to thi Ordinance shall be in conflict herewith, this Ordinance shall super sede any inconsistent Ordinance or portion of Ordinance insofar as any inconsistency might appear. -4- I . r The foregoing.
