AN OR))INANCE REGULATING THE KEEPING AND (Y 7N ING
OF DOGS ; REQUIREMENT FOR DOG LICENSE, PRESCRIBING
OF FORM OF LICENSE, COST OF LICENSE, AND REQUIRE-
MENT THAT DOGS BE INOCULATED AGAINST RABIES AS A
PREREQUISITE TO THE ISSUANCE OF A DOG LICENSE;
PROVIDING FOR THE IMPOUNDMENT OF UNLICENSED DOGS;
DOGS RUNNING AT LARGE; PENALTY; PROVIDING THAT
BITCHES BE KEPT IN SUBSTANTIAL ENCLOSURES WHILE IN
•HEAT AND PENALTY FOR OWNER OR KEEPER FAILING TO DO
SO; AND PROVIDING THAT THE OWNER OR KEEPER OF
THREE OR MORE ADULT DOGS OBTAIN A DOG KENNEL LICENSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYR-
HILLS, FLORIDA, as follows:
Section 1. Unlawful to Own, Maintain or Keep Unlicensed
Dogs : It shall be unlawful for any person, party, firm or cor-
poration to keep, own or maintain, within the city limits of
Zephyrhills, Florida, any dog' without having first procured a
license from the City Clerk of the City of Zephyrhills, Florida,
1n the manner and form hereinafter prescribed. Any person, fir4,
:party or corporation owning or maintaining a dog within the City.
of Zephyrhills., without first obtaining a license, shall upon I
conviction,Ibe fined THIRTY-FIVE ($35.00) DOLLARS, or imprison-
ment in the city jail for TEN (10) days, or both.
Section 2. Dog License: The City Clerk of the City of
Zephyrhills, Florida, is hereby authorized and directed to issue
a license to the owner or keeper of any dog withirr- the City of
Zephyrhills, Florida., which said license shall be in substantially
the following form:

providing, however, that as a prerequisite to the issuance of a
license, the owner shall first submit evidence that the said
dog has been inoculated against rabies within the year next,
preceding, by any person licensed', to practice veterinary medi-
cine,, or any person authorized by the City Council of the City
of Zephyrhills} Florida. to administer anti-rabies inoculation.
All licenses issued by the City Clerk of the City of Zephyrhill ,
Florida, shall expire one year after the date of issuance.
The license charge shall be. $1.50 per . year for each male dog.,
or female dog that has been spayed; and $2.00 per year for each
female dog, that has not been spayed,
Section 3. Dog Tag Required: The City Clerk shall also
give the licensee an appropriate dog tag to be attached to the
collar of said animal, to show that said dog has been inoculated
and licensed within the City.
Section 4. Impoundment of Unlicensed Dogs; and Dogs Running
at Large: Any dog found running at large in the City of Zephyr-
hills,.. Florida, shall be impounded by police officers of -the City..
or any other person designated to impound animals, within the

ity Pound; the owner of such animal may obtain the release of
the animal from the dog pound by procuring a license for said
animal and paying an additional penalty of $2.50; if the owner
of such animal shall not obtain the release of the animal as
herein prescribed within three (3) days after the impounding , of
the animal, the animal shall be killed by the appropriate desig-
nated "city Official,, and thecarcass of such animal shall be
buried by said officer, who shall receive a fee of $1.00 for
each animal so killed and buried, out of the general funds of
the City. of Zephyrhills, Florida.,,
Section 5. A. Second Impoundment of Dogs: if any dog or'
bitch is impounded by the impounding officer the second time,
he charge to the owner of such animal for its release shall,
in addition to procuring a license for such animal, be FIVE
.($5.00) DOLLARS.
B. Third and S tUsequent Impoundment of Dogs : If any dog
or bitch is impounded by the impounding officer three or more
times., the charge to the owner of such animal for its release
shall, in addition to procuring a license f:ar::.such animal, be
TEN ($10.00) DOLLARS.
Section 6. Unlawful for Owners or Keepers of Dogs- to
permit same to be a nuisance within the City;(Penalty/ The
roaming of dogs at large within the City, and the barking of
dogs within. the City, is hereby deemed to be a nuisance for the
reason that it::-adversely affects the health,, the peace and
tranquillity, and the wellbeing of the citizens of the City of
Zephyrhills, and other acts or habits of dogs that affects the
health, the peace and tranquillity,, and the wellbeing of the
City of Zephyrhills, is also deemed to be a nuisance. It shall ,
be unlawful for the owners or keepers of dogs to permit same ..,.", ;

to be a nuisance within the meaning of nuisance hereinabove
defined, within the City of Zephyrhills.- When three or more
separate neighboring property owners., or residents, of the City
of Zephyrhills, shall sign a petition complaining to the City
certain specified dogs being a nuisance within the City. including,
but not limited to, the roaming at large of dogs and the barking
of dogs.. which said petition shall also specify the owners or
keepers -of -the dogs, and his or her address, and shall fully'
describe the dog, and other information, to show that the dog is
a nuisances he .City Clerk shall. hotify the Owner or keeper of
'f s ch dog by Regular United States, Mail, to abate the nuisance.

If the owner or keeper of the dog shall fail or refuse to abate
the nuisance within 3 days from the date the Clerk sends the
notice to the owner or keeper of such dog, the owner or keeper
} of such dog shall, upon conviction, be deemed guilty of a misde.

any police officer, or any -other officer duly authorized by
the City., shall . immedi.ately impound the dog so specified and
described and place it in the City Pound,, whereupon the owner
or keeper of such dog may obtain the release in the same manner
as set forth in Sections 4 and 5 ;above, and if the release of

such dog is not obtained by the owner or keeper within three (3)
days from the date of its impoundment, it shall be disposed of
as set forth in Section 4 above.
Section 7. Requirement that Bitches in heat be Maintained
in a Substantial Enclosure; Penalty; It shall be unlawful for

any owner of a bitch, or .anyone maintaining or keeping a bitch,
not to keep such animal while it is in heat, in a substantial
enclosure, sufficient to the extent that the bitch .will .not be
visible to male dogs$ during the said animal 's period of heat,
and any owner or keeper of such animal, failing to keep such
bitch within a substantial enclosure during the bitch's period
of heat, shall, upon conviction$ be fined by a fine not
exceeding THIRTY-FIVE ($35.00) DOLLARS,. or imprisonment in the
City Jail for a period of time not to exceed TEN (10) days,
or both.
Section 8. Dog. Kennel License Required; Penalty for Failure
to obtain License: Any person., party, firm, or corporation,
owning or maintaining three or more adult dogs within the City
of Zephyrhills, Florida, shall first obtain .a dog kennel license
from the City Clerk of the City of .Zephyrhills., Florida; the
duration of each dog kennel license shall be from October 1., to
and including September 30, of the year next succeeding, and
the cost thereof shall be $10.00 per_ year. Any person., party,
firm or corporation,. upon conviction, of failing to comply with
this Section of this Ordinance, shall be fined by a fine not
exceeding THIRTY-FIVE ($35.00) DOLLARS, or TEN (10) days in
jail, or both.
Section 9. Repealing Clause: Ordinances No. 70 and 130,-
according to the numbering scheme; of the City Clerk of the City
of Zephyrhills,: Florida, be, and the same are hereby repealed.
Section 10. Saving Clause:1 If any section, part or. por-
tion of this Ordinance shall be held unconstitutional by' any
court of competent jurisdiction,-.such ruling shall not affect
the remaining portions of this Ordinance.
