HomeMy WebLinkAbout181 Construction & Maintenance of a Sewage Treatment Plant r Q / \ ORDINANCE NO. / ` AN ORDINANCE OF THE CITY OF ZEPHYRHILLS , PASCO COUNTY, FLORIDA, AUTHORIZING THE CONSTRUCTION AND MAINTENANCE OF A SEWERAGE SYSTEM AND SEWAGE TREATMENT PLANT; THE ISSUANCE OF GENERAL OBLI- GATION BONDS OF THE CITY OF ZEPHYRHILLS COVER- ING THE COST OF SAME: AUTHORIZING THE CITY COUNCIL TO LEVY SPECIAL ASSESSMENTS ON ALL REAL PROPERTY INVOLVED, AND FURTHER DIRECTING THE PUBLICATION OF NOTICE OF A GENERAL ELECTION OF QUALIFIED FREEHOLDERS FOR THE PURPOSE OF SE- CURING APPROVAL OF THE ISSUANCE OF SAID BONDS. WHEREAS, the City Council of the City of Zephyrhills has previously hereto secured a Need and Feasibility Report of a sanitary sewerage system for the City of Zephyrhills, Pasco County, Florida , and; WHEREAS, said Report recommended the early installa- tion of an adequate Sanitary Sewerage Collection and Treat- ment System, as same was necessary to protect the health of the residents of the City of Zephyrhills and to allow for future, proper and orderly growth of said City. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida: Section 1: That the City Council of the City of Zeph r- hills, Florida, is , hereby, authorized to construct an adequ to Sewage Disposal System, including a Sewage Treatment Plant, either within or without, or partly within and partly withou , the Corporate Limits of the City of Zephyrhills , according to the plans and specifications prepared by The Michaels Engineering Company, of Orlando , Florida, same being attached hereto and made a part hereof. Section 2: To issue General Obligation Bonds of the City of Zephyrhills in the sum of One Million Three Hundred Seventy Eight Thousand Seven Hundred Nineteen and no/100 ($1,378,719.00) Dollars, to pay the cost of the construction of said Sewage Disposal System and Sewage Treatment Plant. Section 3: The Bonds herein provided for shall in no case be sold for less than 95% of their Par Value, and shall not bear a greater interest than six percentum per annum. That said bonds shall be amortized for a period " of time not in excess of twenty (20) years. Section 4: The City Council of the City of Zephyrhillls is further authorized: (a. ) To fix and collect rates, fees, and other charges for the services and facilities furnished by any such Sewage Disposal System, and to fix and collect charges for making connections with the sewer system of the. City. (b. ) To acquire , in the name of the City, either by purchase or by the exercise of the right of eminent domain, such lands and the right and interest therein, and to acquir, such personal property, as it may deem necessary in connection with the construction or operation of such Sewage Disposal System, and to hold and dispose of all real and personal property under its control. (c. ) To make and enter into all contracts and agreements necessary or incidental to the performance of its duties and the execution of its powers under this Ordinance, and to employ such consulting engineers , attorneys, accountants , construction and financial experts, superintendents, managers and other employees and agents as may in the judgment of the City Council be deemed necessary, and to fix their compensation in the construction and operation of such Sewage .Disposal System. (d. ) To exercise jurisdiction, control and supervision over the entire Sewage Disposal System, and any additions I thereto, owned, operated or maintained by the City, and to m�ke and enforce such rules and regulations for the maintenance and operation of any such Sewage Disposal System, or additions thereto ,'-as may in the judgment of the Council be necessary or desirable for the efficient operation of such System. (e. ) To receive and accept from any Federal Agency grants for, or in aid of, the planning, construction, recon- struction, or financing of such sewerage and disposal system, or sanitary sewers, and to receive and accept aid, or contri butions, from any source, of either money, property, labor or other things of value, to be held, used and applied only for the purposes for which such grants and contributions may be made. 2. (f. ) To levy Special Assessments against all real property served by such Sewerage System, whether same abuts said sewer line, or parallels same, provided, however, that such Special Assessment for the installation of the sewer line, against each property owner, shall not exceed one-third (1/3) of the cost thereof, the City to pay the remaining portion of said cost.. (g. ) To divide said City into sections , as per plans attached hereto , and to provide for the installation of such Sewage Disposal System in designated sections as will, in the judgment of the Council, be eranomically and practicably feasible. Section 5: That a Special Election shall be held on May 31, 1966, between the hours of 7 A.M. and 7 P.M. , for th purpose .of allowing the registered, qualified, freeholders of the City of Zephyrhills to either approve or disapprove the issuance of the General Obligation Bonds of the City of Zephyr- hills, mentioned in this Ordinance, said election to be con- ducted pursuant to law. Section 6: That this Ordinance shall be published in a newspaper published in Zephyrhills, Florida, for at least thirty (30) days prior to such election. - This Ordinance shall become effective upon its adoption and approval in the manner as prescribed by the City Charter of the City of Zephyrhills, Florida.
