AN ORDINANCE REQUIRING GARBAGE AND TRASH PICK-UP BY THE CITY OF ZEPHYRHILLS , ES- TABLISHING THE RATES FOR SUCH GARBAGE AND TRASH REMOVAL AND PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS , FLORIDA, as follows: Section 1. The following terms and phrases , when ised in this Ordinance shall be construed to havethe same meaning as hereinafter defined: a . Garbage shall beheld and construed to mean ev ry refuse , kitchen, shop, storeior factory accumulation of an�mal, fruit, or vegetable matter, liquid or otherwise , that atteijids the preparation, use ox± cooking, dealing in or storage of meats , fish, fowl, fruit or vegetables , and any bottles , c ns or other containers which, due to their ability to retain water, may serve as breeding places for mosquitoes or othe water breeding insects. b. Trash shall be held and construed to mean any and all wooden or paper boxes , leaves , shrubbery trimmings tree trimmings , tree limbs , sweepings and all other accumu a- tion of any nature other than garbage which are usual to -house-- keeping and to the operation of stores , offices , and other places of business. That tree limbs referred to above sha 1 not exceed six (6) feet in length except that any said tre limbs having a diameter of one (1) foot or more shall be c t in lengths not exceeding three (3) feet. c. Dwelling unit shall be held and construed to mean any and all places where persons live and reside and where the usual housekeeping tasks are performed. d. Business shall be held and construed to mean a commercial or industrial establishment or enterprise. • Section 2. All residents , occupants or owners of premises in the City shall be required to have accumulation of garbage and trash removed by the City, and for such ser'v1ices of garbage and trash removal shall pay to the City a month y collection charge, as per the following schedule: a . GARBAGE REMOVAL 1. DWELLINGS: SINGLE FAMILY DWELLINGS $2.00 per month MULTIPLE FAMILY DWELLINGS (To include apartments , duplexes and the like , pro- viding Booking facilities) First family apart- anent ;or unit $2.00 per month Each additional apart- ment ,or unit $ .50 per month 2. ROOMING AND BOARDING HOUSES , HOTELS , MOTELS AND THE LIKE: First ten rooms , per room $ .40 per month All over ten rooms , per room $ .30 per month 3. COMMERCIAL AND INDUSTRIAL: BUSINESS ESTABLISHMENTS , regardless of nature , not hereinabove provided for: Minimum: Daily pickup , except Saturday and Sunday, removal of 24 20-gal- lon cans or containers or garbage. Trash cans to have lids and full bo.ttoms. $4.00 per month Two pickups per week, removal of. 12 30-gallon cans or containers of garbage. $2.00 per month The removal of garbage in excess of the amount pro- vided for in the minimum above , shall be at the rate of $1.00 per month for each 12 30-gallon cans or containers , or any part thereof: II b. TRASH REMOVAL 1. SINGLE FAMILY DWELLINGS $1.00 per month Each additional unit or apartment $ .25 per month 2. ROOMING AND BOARDING HOUSES , HOTELS , MOTELS AND THE LIKE: $2.00 per month 3. COMMERCIAL AND INDUSTRIAL: BUSINESS ESTABLISHMENTS , regardless of nature, not hereinabove provided for: Minimums $1.00 per month Each additional occupant in common building $ .25 per month 4. That should trash removal from any of the aforementioned three locations exceed one truck load 12 foot by 8 foot truck bed in: any two week period of time then an additional charge of $5.00 will be made for any such additional: load or portionithereof. c. In the event that more than one business establish- ment is contained in a common building, the owner of the b ilding, at his option, may provide for single place of deposit for the garbage of all such occupants' of that building, and be billed for garbage collections by paying one minimum charge of $4.00 per month, and whatever additional charge as provided for above, this charge to be in lieu of the minimum charge being paid by each such occupant of such common building, plus any overt arge as is provided -for above. d. The monthly charge provided for in sub-section a and b above shall be billed on quarterly statements, issue by the City, for water services , provided that such garbage a d trash collection shall be itemized separately on such stat ment. e. Such garbage and trash collection charge herei provided for shall be paid within ten days after date of mailing statement , as stamped thereon, or such collection service shall be discontinued until all of such charges shall be p id in full. • - 3 - t . 1 I f. That the City Clerk shall refer all delinquent accounts for garbage and trash collection to the Welfare Board , as the same has been appointed by the City Council , and that if said Welfare Board should find that the user of such ga age and trash - collection service is indigent and is unable to pay for such services, that the services will not be discontini ed. Otherwise, it will be discontinued , as provided for in sub section 3. Section 3. Any per.sn convicted of violation of a y provision of this Ordinance shall pay a fine of not more t an { $500.00, or shall be sentenced to serve not over 90 days ii. the Municipal Jail, or both fine and sentence , in the discietion of the Municipal Judge. Section 4. All Ordinances in conflict with the to ms and conditions of this Ordinance be and the same are, hereby, repealed. Section 5. In the event any section, paragraph, sentence, clause or portion of this Ordinance shall, for any reason, be held unconstitutional, invalid, or ineffective, the same shall not repeal , nullify, or in anywise affect any other section, paragraph, sentence , or portion of this Ordinance.
