' / AN ORDINANCE PROVIDING FOR THE APPOINTMENT OF AN AIRPORT MANAGER� AND REGULATING THE USE OF ZEPHYRHILLS MUNICIPAL AIRPORT AS TO BOTH AIR AND GROUND TRAFFIC, MAINTENANCE OF=AIR- CRAFT AND PROVIDING A PENALTY FOR VIOLATION THEREOF. BE IT ENACTED AND ORDAINED BY' THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA: SECTION 1. DEFINITIONS. (1. ) Council shall mean the duly elected officials of the City of Zephyrhills . (2 . ) Airport shall mean the Zephyrhills Municipal - i Airport. (3. ) Airport Manager, shall mean the person having. immediate charge of the Airport, and acting under the direc ion of the Council. t(4. ) Aircraft shall nean any contrivance now known, or hereafter designed, invented or used for navigation or flight in the air, except a parachute or other contrivance used primarily as safety equipment. (5. ) Person shall mean any individual, partnership, firm, association or corporation. (6. ) Commercial Operation shall mean all operations of aircraft for commercial purposes and without limitation shall include the operation of non-scheduled service for transpor tation of freight, express or, passenger or charter service. (7. ) Gross weight shall mean' the maximum allowable gross landing weight of such aircraft as determined by the Federal Aviation Administration, or other governmental agency having jurisdiction. (8 . ) Private plane shall mean a plane operated by an individual owner for pleasure or for other purpose, where no direct monetary return is received from its operation. (9 . ) Itinerant pilot shall mean a pilot operating an' aircraft not based at the airport. (10. ) Landing area shall mean all aircraft operation areas including runways , taxiways, ramps and apron. (11. ) Words relating� to aeronautical practices, processes and equipment shall be construed according to the r usage in the aviation industry. SECTION 2. GENERAL PROVISIONS . 0 (1. ) All aeronautical activities at the airport an all flying of aircraft departing from or arriving at the airport shall be conducted in conformity with applicable pr - visions of the regulation of Federal Aviation Administratio , or any successor thereof. (2 . ) The aircraft owner, pilot, agent or his duly authorized representative agrees at the commencement of any aircraft operation terminating in a landing, to release or discharge the City of Zephyrhills , its officers and employe s, of and from liability for damage which may be done to or suffered by said aircraft and its equipment, except when du to the sole negligent management or operation of the airpor , and also releases and discharges the City of Zephyrhills fr m all liability for personal damages and injuries, and is res ponsible for the prompt disposal and immediate removal of wrecked aircraft and the parts thereof, to avoid all inter- ference with field operations at the airport. All itineran pilots landing and planning to remain overnight, or longer, on the airport shall contact :the Airport Manager. (3. ) All persons using any part of the airport sha 1 be held liable for any property damage caused by carelessne s I and negligence on or over the airport, and any aircraft bei g property operated so as to cause such ro ert damage be retained P Y g' may in custody by the Airport Manager and the City of Zephyrhil s may have a lien on said aircraft until all charges for dama es are paid. •Such persons agree to indemnify fully and save a d hold harmless the City of Zephyrhills and its officers and employees from claims, liabilities and causes of action of every kind and character and nature, as well as costs and fees, including attorney ' s fees connected therewith, and ex pense of the investigation thereof. 2. C' (4. ) The Airport Manager shall have the authority to suspend flying operations onto and from the airport when in his opinion, conditions might make such operations unsaf . (5. ) All aircraft operations shall be confined to hard surface runways, taxiways and aprons. (6. ) Taxi strips shall not be used for takeoffs or landings, nor shall any person block any active taxiway in such a manner as to restrict its proper usage. (7.) Any person causing damage to any property on the airport by means of contact with an aircraft, motor veh - clef building, structure or other equipment shall report i such damage to the Airport Manager immediately and shall be fully responsible for any costs required to repair and/or re- place the damaged facility. (8. ) In the event of any contingencies, not specifi- cally covered by this Ordinance, or by separate agreement with the City of Zephyrhills, the Council will be the sole arbitrator. (9. ) The Airport Manager shall at all times have authority to take such reasonable actions as may be necessary in handling the conduct and management of the public in attendance at the airport, which action shall be subject to review by City Council. SECTION 3. FIRE AND SAFETY REGULATIONS. ( l. ) All persons using, in any way, the airport or facilities of the airport shall exercise the utmost care to guard against fire and injury to persons or property. (2. ) No aircraft shall be fueled while one or, more of its engines are running. (3. ) All persons shall keep the space alloted to them policed and free from rubbish and accumulations of an material, and shall keep all floors clean and free from fuel . and oil. The use of volatile' and/or flammable solvents for cleaning floor is prohibited. No baxes, crates, paint or varnish cans, bottles or containers shall be stored in or about any hangar. 3 i � i I (I+. ) Approved metal receptacles with self-closing covers shall be used for the storage of oily, waste, rags and other materials . The contents of these receptacles sha 1 be removed daily; drip pans shall be• placed under engines a d kept clean at all times and clothes lockers shall be constr c- ted of metal or fire resistent materials. (5. ) Gasoline, kerosene, ethel, jet fuel, ether or other flammable gasses or liquids, including those used in connection with the process of "doping" shall not be stored in any hangar at the airport. Storage of all such liquids shall be in compliance with the regulations of the National Board of Fire Underwriters. Buildings shall be provided with suitable first aid fire appliances and first aid equip went and all heating equipment and fuel burning appliances shall be as approved and required by the said National Boar of Fire Underwriters. (6. ) Aircraft reservoirs, including fuel tanks, sh 11 not be drained or filled while aircraft are within any build- ing or structure . (7. ) Fuel trucks, whether loaded or empty, will ne er enter hangars, nor will they be parked unattended within a distance of 100 feet of hangars, paint and "dope" shops, f el storage systems or other critical installations. (8. ) Cleaning of aircraft parts and other equipme t shall preferably be done with non-flammable cleaning agent or solvents . In cases where the use of flammable solvents cannot be avoided, only liquids having flash points in exc ss of 100 degrees fahrenheit shall be used and special precau tions shall be taken to eliminate ignition sources in com- pliance with the practices recommended by the National Fir Protection Association. (9 . ) The use of any equipment employing open flaw s or sparks within any hangar is prohibited. (10. ) No portable lamp assembly shall be used in ny maintenance shelter without a proper guard or wire shield over such lamp assembly to prevent leakage. (11. ) All power operated equipment or electrical devises will be shut off whenlnot in actual use. Radio transmittors and other similar equipment installed in air- craft will not be tested or operated with dynamotors runnin , unless all parts of the antenna system are at least one foo removed from any other object: (12. ) The aircraft electrical system will be de- energized upon any aircraft upon which work is being done i any hangar or structure. (13 . ) Smoking or striking matches or other lightin devices will not be permitted' within fifty feet of parked aircraft or during fueling, or during the loading or unload ing of tank trucks or in hangars, shops or other building in which flammable materials are stored or used, except in cases where specifically approved smoking rooms have been constructed for that purpose. (14. ) Lighting in hangars is restricted to electri city. (15 . ) Heating in any hangar shall only be by appro ed systems or devices as listed by the Underwriters Laboratori s, Inc. , as suitable for use in aircraft hangars and shall be installed in the manner prescribed by the Underwriters Labo - atones, Inc. . (16. ) The starting or operating of aircraft engine inside any hangar is prohibited. This shall not be constru d as prohibiting the use of tractors employed in moving plane within any hangars . (17. ) Taxiing aircraft in or out of any hangar is prohibited. (18. ) The process of; "doping" will be carried on a set forth in the standards of1the National Board of Under- writers , Section 16, of Phamphlet No. 85, "Standards of the National Board of Fire Underwriters for Construction and Pr - tection of Airplane Hangars" .j 5 . (19. ) No fuel, grease, oil or flammable liquids of any kind will be allowed to flow into or be placed in any sewer system. (2-O. ) --- All aircraft, aircraft fueling trucks and other fueling devices shall be positively grounded to an approved grounding source during fueling or defueling opera- tions. No aircraft shall be fueled or defueled while passe - gers are on board, unless a passenger boarding ramp is in p ace at the cabin door of the aircraft and a cabin attendant is present at the cabin door. Only authorized persons in pur- suit of official duties shall be permitted in the immediate vicinity of any aircraft which is being fueled or defueled. No truck shall be backed within 20 feet of an aircraft, un- less a guide man is posted to assist . The driver shall respond to an order from one such guide only. (21. ) All regulations and recommendations of the Zephyrhills Fire Department shall be adhered to with regard to fueling, storage and handling of all inflammables. SECTION 4. AIR TRAFFIC RULES. (1. ) All aircraft operations to, on or from the a r- port shall be conducted in conformity with the chart provi sions of the Federal Aviation Regulations and/or Civil Aeronau- tics Board Rules and Regulations , or any successor thereof. (2. ) No motorless aircraft may land or take off f om the airport. (3. ) No aircraft engines shall be started or run at the airport, unless a pilot certificated to operate that particular type of aircraft or a certificated A and P mech nic, qualified to start and run engines of that particular airc aft, shall be attending controls. ; (4. ) The Council shall have the right to deny the use of the airport to any aircraft violating any provision of his Ordinance or Federal Regulation, whether at the airport or elsewhere. 6 ' (5. ) Operation of aircraft on or at the airport in a careless or negligent manner is prohibited. (6. ) Experimental flight, demonstrations, acrobati s, parachute jumping, stunt-flying and air shows at the airport are prohibited, except by prior written approval of Council. SECTION 5. AIRCRAFT GROUND OPERATIONS AND RELATED ACTIVITIES. (l. )- No person shall: taxi an aircraft to or from any hangar area, or to or from any approved parking space, until he has ascertained that there will be no danger of co li- sion with any person or objects in the immediate area. (2 . ) All aircraft shall be taxied at a safe and re - sonable speed and no aircraft' shall be taxied into or out o any hangar under its own power. (3. ) All aircraft being taxied, towed, or otherwise being moved at the airport shall proceed with navigation I lights on during the hours between sunset and sunrise. (4. ) All aircraft operating at the airport shall be equipped with wheel brakes in proper working order. (5 . ) Aircraft engines shall be started and/or operated only in the places designated for such purposes by the Airport Manager. (6. ) At no times shall engines be run up when han ars, shops or other buildings or persons are in the path of pro peller or jet wash. Aircraft shall not beparked except in areas (7• ) P and in the manner designated by the Airport Manager. (8. ) All un-hangared aircraft shall be parked at the airport in spaces designated for this purpose and shal be adequately secured. Owners of such aircraft shall be held responsible for any damage resulting from failure to properly comply with this provision. (9. ) The City of Zephyrhills assumes no responsib - lity for overnight aircraft parking on the airport. 7. (10. ) No person or persons (except airmen, duly authorized personnel, passengers going to and from aircraft, or persons being personally conducted by airport attendants shall be permitted to enter the landing area. This does no give any person or persons soiexcepted, the privilege of unrestricted use of the space of a landing area. These pri vileges are confined to the necessary use of this space in connection with flight inspection or routine refuels. (11. ) The operator of any aircraft involves} in an accident on the airport, causing property damage or personal injury, shall immediately report such accident to the Airpo t Manager, or to his representative. (12. ) Subject to compliance with appropriate Fede al Regulations, the aircraft owner and/or the operator thereo shall be responsible for the prompt disposal of aircraft disabled at the airport and parts of such aircraft as dire ted by the Airport Manager. In the event of his failure or re usal to comply with such directions, such disabled aircraft and parts may be removed by the Airport Manager at the owner ' s and/or at the operator' s expense, and without liability fo damage which may be incurred as the result of such removal. SECTION 6. CHARGES. (1. ) Occupancy and rental of all space for the ca ry- ing on of any business, commercial enterprise or other for of revenue producing activity on the airport will be by writt n agreement with the Council. !All charges and fees for sere ce performed to or for itinerant aircraft or aircraft stored n a daily basis shall be paid before the aircraft will be cl ar- i ed from the airport, unless prior satisfactory credit arra ge- ments have been made. (2. ) Aircraft landing weights are certificated maxi- mum landing weights as determined by the Federal Aviation Administration or other governmental agency having jurisdi tion. 8: { I SECTION 7. PENALTIES. (1. ) Any person violating the terms of this Ordi- nance, upon conviction thereof in the Municipal Court, shat be sentenced to pay a fine of not more than —, or to spend days in the Municipal Jail, or both such fine and sentence, in the discretion of the Municipal Judge. (2 . ) That the aforementioned penalty shall be in addition to any penalty levied by Federal Law or Federal Administration Regulations. SECTION 8 . MOTOR VEHICLES. (1. ) Movement of all vehicular traffic within the confines of the airport shall be subjected, at all times, to regulations promulgated by the Council. (2 . ) No motor vehicles shall be parked on airport property except in areas designated for that purpose by the Airport Manager. (3. ) No motor vehicle may park on any portion of the aircraft landing area, with the exception of those true s and other vehicles necessary to the servicing of such air- craft and the maintenance of .the airport. (4. ) No motor vehicle ( including aircraft) shall be parked in a manner so as to block the gates or emergency en trance to the landing areas or entrance to any hangar, shops or buildings on the airport.. (5. ) The Airport Manager shall have the authority o tow or otherwise move motor vehicles which are parked on the airport in violation of the regulations of the airport. (6. ) The Airport Manager shall have the authority o make a reasonable charge against the owner or operator of such vehicle for such towing or moving service and the moto vehicle so towed or moved shall be subject to lien for such charge. (7. ) Moving aircraft are those having engines in operation and have the •right of way over motor vehicles ope - ating on any aircraft ramp and in no instance shall any motor vehicle enter the path of such aircraft or otherwise place the aircraft or vehicle in jeopardy. 9. (8 . ) No person shall' operate a motor vehicle on th airport while his vision is hampered in any way. (9. ) Unauthorized persons shall not walk or operate a motor vehicle on any portion of the aircraft ramps, taxi- way or landing areas . (10. ) All persons involved in any accident on the airport resulting in personal injury or major damage to vehicles or aircraft shall immediately report such action to the Airport Manager, or his representative. (ii. ) All vehicles operated on the airport shall be maintained in safe operating condition, especially with re- spect to brakes, steering gear and electrical systems . (12 . ) Parking or standing of vehicles in walkways, i on ramps or in areas designated for pedestrians or vehicula traffic is prohibited, when such vehicles are not in use. (13. ) Vehicles parked on the aircraft parking ramp will be placed so as to minimize the possibility of their being over-turned or blown out of position by the back-blas of taxiing aircraft. ( 14. ) The speed limit of which motor vehicles can be driven on the streets and other vehicular traffic areas of the airport shall be at miles per hour, unless otherwise posted. (15. ) The intent andl effect of the above mentioned actions is extended to apply ;to all of the areas presently within the present or future boundaries of the airport. SECTION 9. HELICOPTER OPERATIONS. (1. ) Helicopter aircraft will avoid fixed wing traffic patterns and altitudes to the maximum extent possible. (2. ) Helicopters sha11 not be taxied., towed or other— wise moved with rotars turning, unless there is a clear area of at least 50 feet in all directions from the outer tips of the rotars . (3. ) Helicopter aircraft shall not be operated wit in 200 feet of any areas on the airport, where unsecured light 10. aircraft are parked. Light aircraft being all types with -- a maximum gross weight of 12,500 lbs. or less. (4. ) Helicopter aircraft during landings and take- offs shall not pass over any airport building structure or auto parking areas . SECTION 10. MISCELLANEOUS. (l. ) No person shall travel on any portion of the airport except upon roads, walks, or places provided for the particular class of traffic, nor occupy the wads or walks in such a manner as to hinder or obstruct their proper use. (2 . ) All-';tenants shall maintain their leased pro- perty as to repair, cleanliness and general maintenance, i a manner agreeable to the Council, or in accordance with their individual lease agreement. (3. ) Except as otherwise may be provided in a sep r- ate agreement with the Council, any personal property that is left on the leased premises at the airport by any former tenant or occupant of such leased premises, and which personal property remains on the leased premises after the tenant o occupant has surrendered possession of same to the Council, shall become the absolute property of the City of Zephyrhi ls, and may be disposed of in an manner that may be deemed nec- essary or proper by the Council, and the tenant or occupan of such leased premises shall have no interest whatsoever in any proceeds that may be realized from the disposition of such personal property.
