I i a ORDINANCE NO, 191 AN ORDINANCE - OF THE CITY OF ZEPHYRHILLS, FLORIDA, A MUNICIPAL CORPORATION, CREATING ABOARD OF EXAMINERS OF BUILDING CONTRACTORS FOR THE CITY OF ZEPHYRHILLS, PRESCRIBING THE DUTIES OF SAID BOARD OF EXAMINERS, COMPENSATION OF SAID BOARD AND FEES TO BE CHARGED BY SAME IN CONDUCTING EXAMINATION. PROVIDING FOR THE ISSUANCE OF REGISTRATION NUMBERS TO THOSE PASSING EXAMINATION BY SAID BOARD, PROVIDING THE MEANS OF REVOCATION OF SUCH REGISTRATION, AND PROVIDING PENALTY FOR VIOLATION OF SAID ORDINANCE. Be It Enacted by the City Council of the City of Zephyrhills, as follows: SECTION 1. A Boards of Examiners of building.-con— i tractors is, hereby, created and shall hereinafter be known as The Board.. SECTION 2. This Board shall consist of three mew bers, all of whom shall have been residents of the City of Zep yr— hills for at least two years.. Two members of the Board shall have as the major portion of their business the construction of buildings and shall be actively engaged in such work at the time of their appointment. One member of the Board shall be the Building Inspector of the City of Zephyrhills. The Mayor shall appoint, with approval of the City Council, the two buil — ing contractor members of said Board, one to serve for a perio hreeof /4 years., the other to serve for a period of years;. Any member of the Board may be removed from office by the City .Council,, in the same manner as is provided for removal of de- partment heads of the City.. SECTION 3. Each member of the Board., upon appoin — ment shall, before entering upon the discharge of his duties o office, prepare and file with the City Clerk of the City of Zephyrhills, an oath in writing to perform properly the duties of his office as a member of such Board, and to uphold the laws of the City, Constitution, and laws of the State and of the United States. SECTION 4. ELECTION OF OFFICERS; ADOPTION OF BY- LAWS AND RULES. The Board shall elect from its membership a Chairman and Vice Chairman, whose terms of office shall be for one year. The Building Inspector of the City shall serve as Secretary—Treasurer of the Board,.. The Board shall make all By—Laws and Rules not inconsistent with the law, that may be needed in performing its duties, which shall be approved by th City Council. SECTION 5. MEETINGIS; COMPENSATION. The Board sh 11 meet at such times as shall be necessary, but no less than on quarterly basis, to hold examinations for applicants under the terms of this Ordinance, act upon appeals under Section 12 of this Ordinance, and to pass upon renewal of certificates, appli- cations for licenses having been received and transacting such other business as may come before the Board, Special Meetings of the Board may be called by the Chairman or the Building In— spector at any time for the purpose of considering or acting upon any violation of this Ordinance or for any other purpose within the purview of this Ordinance. Members of the Board, except the Building Inspect r � I of the City, s all each be paid from the treasury of the City the sum of $/o. oo per meeting attended.. They shall not be paid for more than four meetings per year. 2' I I SECTION 6. RECORDS TO BE KEPT; COLLECTIONS OF i MONIES; ROSTER OF LICENSED CONTRACTORS; NOTIFICATION OF REVO- CATION OR REISSUANCE OF REGISTRATION. The Building Inspector shall keep a record of all the meetings and proceedings of the Board, together with the necessary register showing all applic — Lions for examinations and registration, such register to show the names of each applicant, the date of application, qualificatioi ., place of business, and place of residence, the result of any examination given and if registration is granted, a record of such registration, including th' registration number. He shal receive all monies derived from the operation of this Ordinance and he shall deposit all monies received with the Treasurer of the City. The books and register of this Board shall be prima facie evidence of all matters recorded therein.. It shall be the duty of the Building Inspector to promptly notify the City Clerk' s Office in the event of revoca tion or the reissuance of any registration. SECTION 7. EXAMINATION FOR REGISTRATION. No application for registration shall be granted or otherwise approved by the Board:, until the Board has satisfied itself, upon evide .ce presented and recorded,, as to the integrity of the applicant, and that such applicant is capable of handling in a proper man er so as to safeguard the life andproperty of the general public within the classification for which registration is sought. The applicant's qualification shall be determined by a written examination which shall be given by and under the direct super i— i sion of the Board, which examination shall be given for the pu — pose of determining the applicant' s ability to read plans and interpret specifications and that the applicant has general 3. J 1 knowledge of the proper use of the various building materials and the ability to estimate correctly the proper quantity of materials required for any construction project and general familiarity with the nationally accepted standards of good con- struction work and knowledge of .the requirements of the Building Code of the City of Zephyrhills, as applicable to the class of contractor for which the registration is sought.. SECTION 8. APPLICATIONS. All applications for registration from the Board must be made in writing on such printed forms as the Board shall prescribe and prepare. Such forms shall be obtained from the office of the Building In- spector. Applications shall include a complete statement and description of the applicant's contracting business or the con tracting business for which the registrationis desired, if the applicant is an individual, his name and address, and if a partnership or co—partnership, the names and addresses of all the partners; and if a corporation, association, or agency, or other organization of any kind, the names and addresses of the president, vice president, secretary and chief construction f i manager, together with any other information which may be required by the Board1 and shall designate the individual who will be 7- quired to take the written examination, and such individual must be an active member or legally authorized agent of such firm, partnership, co—partnership, corporation, association or any o her organization desiring to secure registration. Registration issued as a result of such examination shall be effective only during the time that such individual i connected or associated with the contractor in the same capaci y that he occupied at the time of registration. Any individual who has taken an examination upon which registration has been. 4. approved may not qualify to take an examination or be register d . in a different name, while any registration secured by former registration remains uncancelled; provided, however, that if the individual passing the examination severs his connection with he contractor to whom such registration was issued on his examina ions i it shall be the duty of both the individual and the contractor to give written notice of such termination immediately to the Board, at which time th.e registration shall be cancelled.. The contractor to whom the registration was issued may, at the time of cancellation, delegate some other qualified individual to take an examination, without the payment of any other additional examination fee or occupational license for the remainder of t e license year.,. SECTION 9. REGISTRATION NUMBER,, It shall be the duty of the Building Inspector to assign to each general con- tractor and sub-contractor approved by the Board, a registrati n number, which registration number shall be filed in the City records, shall appear on the Occupational License of said general contractor or- sub-contractor, and will also appear on all Bull ing Permits secured from the Building Inspector of the City of Zep yr- hills.. SECTION 10,. DISPLAY ON VEHICLE. It shall be un- lawful for any person, firm, partnership, corporation, associa tion or other organization engaging in the business oft or acting in the capacity of, a contractor or sub-contractor, to use any vehicle for the purpose of conveying or transporting tools, equipment,, machinery, . materialslor workmen in connection with any construction work unless there shall be first placed upon ach side of said vehicle, in a prominent place visible from a bear ng of 10 degrees. from directly ahead or behind such vehicle, the registration number of said contractor or sub-contractor, in b id I � 5. letters, in a color sharply contrasting with the background I thereof, which registration number shall be in letters of no less than 3 inches in height. SECTION 11. REVOCATION OF REGISTRATION. For goo cause shown, the Board may revoke the registration. of any con— tractor or general contractor which revocation shall not be— come final until approved by the City Council of the City of Zephyrhills,.. SECTION 12. REVIEW AND APPEAL. Any applicant shall have the right to request the City Council to review the action of the board in the granting or revocation of any regis tration. Request for such review shall be made in writing to the City Council clearly specifying applicant' s complaint agai st Board actions and must be filed with the City Council within fifteen days from the date of the alleged incorrect action of' the Board occurred,. That upon receipt of said written request- s for review, the City Council shall grant a public hearing., within thirty days from the date same is received, at which time the aggrieved applicant and, one member of the Board shall be grant d reasonable time to present their position on said matter to th Council. Finding of the City Council, upon such hearing-, sha, be binding upon both applicant and the Board. SECTION 13... FEES. i The Board is authorized to charge each applicant for examination, an application fee, the amount of said application .fee to be approved by the City Counc That all monies so collected inform of application fees by th Board shall be immediately deposited in the General Fund of the City of Zephyrhills. 6. SECTION 14, PENALTY. Any person, firm, partner— ship,, co—partnership, corporation, association,, 'or agency en— gaging in the contracting business, covered by this Ordinance, without complying with the terms, and conditions of same, upon. conviction thereof in the Municipal Court, shall pay a fine no exceeding $500.00, or be sentenced to the City Jail for a term not to exceed 90 days, or both such fine and imprisonment, in the dis— cretion of the municipal judge, { SECTION 15.« In the event any action, paragraph, sentence, clause or portion of this .
