AN ORDINANCE ADOPTING THE POWERS GRANTED TO INCORPORATED
MUNICIPALITIES BY. CHAPTER 69-139 OF THE LAWS OF FLORIDA
TO PLAN FOR FUTURE DEVELOPMENT AND TO PREPARE, ADOPT
AND AMEND COMPREHENSIVE PLANS TO GUIDE FUTURE DEVELOPMENT;
TO IMPLEMENT THE COMPREHENSIVE PLANS BY AUTHORIZING ZONING
(PROTECTIVE DEVELOPMENT) REGULATIONS; AUTHORIZING THE
ADOPTION, AMENDMENT AND ENFORCEMENT OF SUBDIVISION
REGULATIONS AND THE ADOPTION, AMENDMENT AND ENFORCEMENT
OF BUILDING, PLUMBING, ELECTRICAL, GAS, FIRE, SAFETY AND
SANITARY CODES; PERMITTING THE ESTABLISHMENT AND
MAINTENANCE OF BOARDS AND COMMISSIONS FOR CARRYING OUT
THE PROVISIONS AND PURPOSES OF THIS ORDINANCE; PERMITTING
THE EMPLOYMENT OF PROFESSIONAL AND CLERICAL STAFF SUPPORT
FOR CARRYING OUT THE PROVISIONS AND PURPOSES OF THIS
ORDINANCE; AND EMPOWERING THE CITY COUNCIL OF THE CITY
OF ZEPHYRHILLS, FLORIDA, INDIVIDUALLY OR JOINTLY WITH THE
BOARD OF COUNTY COMMISSIONERS OF PASCO COUNTY, FLORIDA, BY
MUTUAL AGREEMENT TO EMPLEMENT THE PROVISIONS OF THE SAID
CHAPTER 69-139 IN SUCH COMBINATIONS AS ITS INTERESTS MAY
DICTATE WITHIN A LEGALLY DEFINED URBAN PLANNING AREA.
WHEREAS, the Legislature of the State of Florida has adopted
Chapter 69-139 of the Laws of Florida and has provided that any incorporated
municipality may exercise the powers granted under the provisions of said
Chapter upon the passage of an appropriate ordinance to that effect by the
governing body; and
WHEREAS, Chapter 69-139 of the Laws of Florida also provides that
unincorporated areas adjacent to incorporated municipalities may be included
in the areas under municipal jurisdiction when the governing bodies of the
municipalities and the county in which the areas are located shall agree as
to the boundaries of such additional areas, procedures for joint action,
procedures for administration of ordinances and regulations applying to the
areas, and the manner of obtaining equitable representation on the established
commissions and boards, provided that the agreements shall be formally stated
in appropriate official action by the governing bodies involved; and
WHEREAS, the City Council of the City of Zephyrhills, Florida,
after a public hearing with due public notice, has determined that the public
health, safety, comfort, good order, appearance, convenience, morals, and
general welfare would best be served by the exercise of the powers granted o
counties and municipalities by said Chapter 69-139, and that the same would
tend to conserve the value of land, buildings, and resources, protect the
character and maintain the stability of residential , agricultural , business
and industrial areas and promote the orderly development of such areas;
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF

ZEPHYRHILLS, FLORIDA, AS FOLLOWS:
1. That all of the powers granted to incorporated municipalities
nder the provisions of Chapter 69-139, Laws of Florida (Florida Statutes 163.160
hrough 163.315, inclusive) be, and the same are hereby, adopted by the City
Council of -the City of Zephyrhills, Florida, and said powers hereafter shall
e exercised in the areas and in the manner provided herein.
2. That a Planning Commission to be known henceforth as "The
• Southeast Pasco Urban Planning Commission" is hereby established in cooperaton
and jointly with the Board of County Commissioners of Pasco County, Florida,
Said Planning Commission shall be comprised of five (5) regular members and
three (3) alternate members. The board of County Commissioners of Pasco County.,
Florida, shall appoint three (3) regular members and one (1 ) alternate membe ,
the City Council of the City of Zephyrhills shall appoint two (2) regular
members and two (2) alternate members. Each of said members shall serve
from the first Monday in September, 1972. In order that terms of said
• members shall be staggered so that three (3) regular members and two (2)
alternate members are appointed during even numbered years and two (2)
regular members and one (1) alternate member is appointed during odd numbered
years, the two (2) regular members from the City of Zephyrhilis and the
one (1) alternate member from Pasco County shall serve until the first
Monday in January, 1973, at which time their terms will expire, and the .
terms of the remaining regular and alternate members will expire on the firs
Monday in January, 1974. Beginning in 1973, all newly appointed members
shall be appointed for terms of two years '. duration. The removal from office,
filling of vacancies, officers, rules of procedure, employees and salaries,
appropriations, fees and other income, functions, powers and duties of the
Southeast Pasco Urban Planning Commission shall be as set forth in the
said Chapter 69-139.
3. That the Southeast Pasco Urban Planning Commission shall operate
within an urban planning area lying and being situate within Pasco County,
Florida,. and being legally described as follows:
The South 1/2 of Township 25 South, Range 20 East, Range
21 East and Range 22 East; All of Township 26 South, •
Range 20 East and Range 21 East; and• the West 1/2 of.
• Township 26 South, Range 22 East.
4. That any ordinances or resolutions or portions thereof, previously
enacted or resolved by the City Council of the City of Zephyrhills, Florida,
that conflict with the purpose and intent of this ordinance are
hereby repealed in whole or in part as necessary for the effective
application of this ordinance, provided that previous ordinances
and resolutions and portions thereof not in conflict with this
ordinance shall remain in full force and effect.
5. That nothing in this ordinance shall be construed to
mean that the City Council of the City of Zephyrhills, Florida,
hereby relinquishes any legislative authority over the incorpor—
ated areas of the City of Zephyrhills, Florida.
6. That the effective date of this ordinance shall be
the first Monday in September, 1972.
