Home My WebLink About207 Florida Retirement System ORDINANCE NO. 27D AN ORDINANCE DECLARING THE POLICY AND PURPOSE OF THE CITY OF ZEPHYRHILLS, FLORIDA, TO EXTEND TO THE EMPLOYEES AND OFFICIALS OF SAID CITY OF ZEPHYRHILLS, FLORIDA, NOT EXCLUDED BY LAW OR HEREINAFTER EXCEPTED, THE BENEFITS OF THE FLORIDA RETIREMENT SYSTEM, AND AMENDMENTS THERETO, ON THE BASIS OF APPLICABLE STATE LAWS AND REGULATIONS; AUTHORIZING AND DIRECTING THE PRESI- DENT OF THE CITY COUNCIL TO EXECUTE AGREEMENTS AND AMENDMENTS THERETO WITH THE DEPARTMENT OF ADMINISTRATION, FOR COVERAGE OF SAID EMPLOYEES AND OFFICIALS; PROVIDING FOR WITHHOLDING FROM SALARIES AND WAGES OF EMPLOYEES AND OFFICIALS OF SAID CITY SO COVERED TO BE MADE AND PAID OVER AS PROVIDED BY APPLICABLE STATE LAWS OR REGULATIONS; PROVIDING THAT SAID CITY SHALL APPROPRIATE AND PAY OVER EMPLOYERS' CONTRI- BUTIONS AND ASSESSMENTS AS PROVIDED BY APPLI- CABLE STATE LAWS OR REGULATIONS; PROVIDING THAT SAID CITY SHALL KEEP RECORDS AND MAKE REPORTS AS REQUIRED BY APPLICABLE STATE LAWS OR REGU- LATIONS. Be It Ordained by the City Council of the City of Zephyrhills, Florida, as follows : Section 1. It is hereby declared to be the policy an purpose of the City of Zephyrhills, Florida, to extend, effec tive January 1, 1973, to the employees and officials thereof, not excluded by law or exempted herein, the benefits of the Florida Retirement System as authorized by Chapter 121, Flori a Statutes, and amendments thereto, to cover by such plan all services which constitute employment as defined in Chapter 12 , Florida Statutes, performed in the employ of said City by emp oyees and officials thereof. Section 2. There is hereby excluded from this ordina ce any authority to include in any agreement entered into under Section 3 hereof any service, position, employee, or official now covered by or eligible to be covered by an existing retir - merit system sponsored by the City except social security only after holding a referendum, in which all employees and offi- cials in the affected units have the right to participate. Only those employees and officials electing coverage under the Florida Retirement System by affirmative vote in said referendum shall be eligible for coverage, and those not par- ticipating or electing not to be covered by the Florida Re- tirement System shall remain in their present system and shall not be eligible for coverage. After said referendum is held, ) all future employees shall be compulsory members of the Florida Retirement System. Section 3. The President of the City Council is, here- by, authorized and directed to execute all necessary agreements and amendments thereto with the Department of Administration for the purpose of extending the benefits provided by the Florida Retirement System to the employees and officials of this City as provided in Section 1 and 2 hereof, which agreement shall provide for such methods of administration of the plan by said City as are found by the Administrator of the Florida Re- tirement System to be necessary and proper, and shall be effec- tive with respect to services in employment covered by such agree— ment and performed on and after the 1st day of January, 1973. Section 4. Withholding from salaries, wages, or other compensation of employees and officials for the purpose provided in Section 1 hereof are hereby authorized to be made, and shall be made, in the amounts and at such times as may be required by applicable State laws or regulations, and shall be paid over to the Administrator designated by said laws or regulations to receive such amounts. 2. Section 5. There shall be appropriated from available yn funds, derived from. the General Fund of said City such amount and. at such times as may be required to pay promptly the con- tributions and assessments required of the City of Zephyrhill , Florida, as employer, by applicable State laws or regulations, which shall be paid over to the lawfully designated Adminis- trator of the Florida Retirement System at the times and in t e manner provided by law and regulation. Section 6. The City of Zephyrhills, Florida, shall keep such records and make such reports as may be required by appli- cable State laws or regulations, and shall adhere to all laws and regulations relating to the Florida Retirement System. Section 7. The City of Zephyrhills, Florida, does, hereby, adopt the terms, conditions, requirements, reservatio s, benefits, privileges, and other conditions thereunto appertai — ing, of the Florida Retirement System, for and on behalf of a 1 officers and employees of its departments and agencies to be covered under the agreement. Section 8. The City Clerk of the City of Zephyrhills Florida, is hereby designated the custodian of, all sums withheld from the compensation of officers and employees as authorized herein and of the appropriated funds for the employer.' s contri— butions as provided in Section 5 hereof. Also, the City Clerk is hereby made the withholding and reporting agent and charge with the duty of maintaining records for the purposes of this Ordinance. Section 9. This Ordinance shall take effect upon its approval and publication as required by law. 3.
