HomeMy WebLinkAbout210 Requirements - Subdivisions I I ORDINANCE NO. 210 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, PRESCRIBING REQUIRE- MENTS AND PROCEDURES FOR THE SUBDIVIDING OF LANDS WITHIN THE CORPORATE LIMITS OF THE CITY OF ZEPHYRHILLS, INCLUDING THE APPROVAL OF SUCH ii PLATS AND ALSO GOVERNING THE CONSTRUCTION OR IMPROVEMENTS OF BUILDINGS LOCATED IN SUCH SUB- DIVISIONS AND PROVIDING FOR THE PENALTY FOR VIOLATION THEREOF. Be It Ordained by the City Council of the City of Zephyr- hills, as follows : p C'; SECTION 1. JURISDICTION. i The regulations contained herein shall apply to all si b- divisions of lands within the corporate limits of the City of Zephyrhills and to all future additions and annexations. SECTION 2. SUBDIVISION PLATS; PROCEDURES FOR APPROVAL , REQUIRED DATA. (A. ) INITIAL DISCUSSION OF FEASIBILITY AND EXISTING CON- DITION. The subdivider, developer or agent of such subdivider or developer may discuss the proposed development and area with he City Manager or City Clerk, prior to investment in engineerin studies, lot and block layouts, surveys and tentative design. The purpose of this discussion would be to acquaint ti e subdivider, developer or agent of such subdivider or develope with existing conditions in the area of such proposed develop -. ment which might effect the area under consideration; possible problems in extending utility services, etc. ; existing or pro- posed zoning and related land uses; requirements for parks, schools, roads, etc. , indicated by any existing or future gen ral plan for the area or region; outstanding reatures such as bridges, streams; major power lines, railroads, .highways; and features of historic, scenic or environmental value. I I • I • This pre-discussion is not intended to be binding on the part of either party, nor is it intended to reduce the subdivider or developers responsibility for a full investiga- tion of all the conditions which might effect this subdivision or whereby his subdivision might effect the surrounding area. Such subdivider may also submit a simple outline sketch of one of the various layouts to be constructed in such subdivision to the City Building Inspector for consideration and comment prior to commencing work on the preliminary plat. (1. ) For subdivisions containing 20 lots or less, with r each lot fronting on an existing public street and in which no new street or major new utilities are required, the following procedure shall be followed : A sketch map shall be prepared showing the boundaries, general size and arrangement of lots, land and lot numbers, and the names of existing roads and streets. The owner shall con- fer with the City Manager or City Clerk who shall informally review the sketch plan of the proposed subdivision. Upon re— ceiving favorable consideration from the City Manager or City Clerk the owner may then proceed to prepare the final plat for submission. Favorable consideration of the sketch plan by the City Manager or City Clerk under no circumstances shall be con- strued as preliminary or tentative approval of such subdivision. (B. ) Such subdivider shall furnish the City Manager or City Clerk with three (3) black-line or blue-line copies of the preliminary plat along with the required filing fee of $25.00. The preliminary plat should be prepared by a registered civil engi- neer or registered land surveyor and..should show the following : (1. ) Title of subdivision and brief location by section, township and range. 2. (2. ) Name, address and telephone number of owner. (3. ) Name, address and telephone number of designer of plat. (4. ) Approximate North point. (5. ) Scale (100 feet to 1 inch minimum) . (6. ) Date. (7. ) Boundaries and dimensions of tract to be subdi- vided. (8. ) Topography properly contoured at an appropriate interval based on M.S.L. datum and currently valid. (9. ) Location of all existing improvements and natur 1 features of note including utilities, drainage ways, water su - faces, wooded areas, easements, roads, buildings, railruc•ds, culverts, existing and proposed property line, streets and ea e- ments, buried cables, gas, sewer and water mains on lands to e subdivided and on lands immediately adjoining for a distance f at least 150 feet. Power poles, billboards and large trees must also be shown. (10. ) Data for location sketch showing relationship f proposed site to surrounding area. (11. ) Proposed streets and lot layouts, proposed ope areas including park sites, school sites, utility sites, comm - nity or publicly owned land, easements and reserved areas and proposed thereof, etc. . (12. ) General method of providing water, sewage disposal and storm drainage for the subdivision. (13. ) Present and proposed zoning of subdivision and abutting land . (14. ) Total acreage. 3. • $ •• . ,. S (15. ) Number of homesites, subject to regulations con- tained in appropriate zoning. and density ordinances of the City of Zephyrhills. (16. ) Gross residential acreage (include lots, streets, parks, lakes, canals, etc. ) . (17. ) Location of all structures on said lands to be subdivided and within 10 feet thereof. (18. ) Exact location of intersection of all adjacent streets with boundaries of proposed plat. (19. ) Proposed lot lines, lot and block numbers and approximate dimensions. (20. ) If acreage, tied to nearest known point. (21. ) Existing and proposed parks, school sites and other public open spaces, both on the proposed subdivision and within 150 feet thereof. (22..) It is required that such plans for preliminary subdivision plats will show all of the ownership within 150 feet on each side of the proposed development. If, in specia cases, a preliminary plat is not required, the final plat mus indicate ownership within 150 feet. Unusable strips of land will not be permitted. (23. ) Legal description and general terms. (24. ) All proposed vacation of existing easements or right-of-ways. (25. ) Estimate of total cost for development of the site. (a. ) Within 30 days after the meeting at which the preliminary plat is reviewed by the City Council of the City f Zephyrhills, the City shall notify the subdivider or develope 4. of the changes and modifications, if any, which must be incor- porated in the final plat before it shall be approved. (C. ) After receiving approval of preliminary plat such subdivider shall furnish three (3) copies of construction plans for all required improvements to the City of Zephyrhills, said plans to be prepared by a resitered engineer, and to include the following.: . (1. ) Street and lot layouts, together with street pr - i files and cross-sections, and details meeting all minimum sta - dards of these regulations and such other regulations as may e applicable. (2. ) Drainage plans, profiles, cross-sections and de ails, including under-drains where needed, meeting all minimum stan dards of these regulations and such other regulations. A mas er lot grading plan shall be included. Drainage calculations wi 1 be furnished on request. (3..) Water supplies and sewage disposal plans approv d by the County Health Department, or evidence that such plans ave been submitted to the State Board of Health. (4.•) Specification meeting all minimum standards of he City of Zephyrhills and such other standards as may be' applic ble. (5. ) Estimate by consulting engineer of cost of impr ve- ments, or bids by two licensed contractors for completion of 11 improvements. (D. ) The subdivider shall submit to the City of Zephyr- hills a final record plat, prepared by a registered land sur- veyor, made on a linen tracing or equal in India Ink and a cl th print of an overall size by 21" x 25", three (3) inch border n left, one (1) inch border on remaining sides, and minimum sca e of drawing of one (1) inch equals 100 feet (1" = 100' ) . 5. (1. ) The following information shall appear on the final record plat : (a. ) Name of subdivision. (b. ) Location by section, township and range. (c. ) Scale, North arrow and date. (d. ) The government corner, forty (40) acre corner or other recorded permanent reference monument, or description and tied to such control point to which all dimensions, angles, bearings and similar data on the plat shall be referred. (e. ) Tract boundary lines, right-of-way lines of streets, easements and other right-of-way lines and property lines of residential lots and other sites with accurate dimensions bear- ing or deflection angles, radii, arcs, chords and central angles of all curves. (f. ) Name and right-of-way widths of each street or other right-of-way. (g. ) Location, dimensions and purpose of any easement. (h. ) Lots shall be numbered progressively, or if in blocks, progressively numbered in each block and the blocks p o- gressively lettered. (i. ) Location and description of permanent reference monuments (P.R.M. ) . ( j . ) Where adjoining land is unplatted it will be so stated. It will be required that the plans for preliminary s b- division plats or final plats, if no preliminary was submitted, will show all of the ownership within 150 feet on each side of the proposed development. Unusable strips will not be permit ed. All abutting property ownership lines to be shown by dashed o dotted lines. 6. (k. ) Reference to recorded subdivision plats or ad- joining platted lands by record, name, plat book and page num- ber. (1. ) All lands within the boundaries of the plat must be accounted for by either blocks, lots, parks, streets, etc. , or accepted parcel. - (m. ) Certificates required on recorded plats; (1. ) A certificate of ownership and dedication. (2. ) Surveyors certificate. (3. ) Certificate of approval of City Council. (4. ) Certificate of approval of County Commission an County Engineer. (5. ) Certificate of approval of Clerk of the Circuit Court of Pasco County, Florida. (2. ) Following approval of preliminary plans the City of Zephyrhills shall prepare an estimate of costs for the balance of improvements necessary to complete the subdivision in accord- ance with approved plans and specifications. (3. ) Subdivider shall furnish security acceptable to I ' the City Council covering one hundred ten percent (110%) of t e City' s estimate of costs for the balance of such improvements (4. ) Following City Council ' s approval of such plans the City Manager or the City Clerk shall present the official subdivision plat, complete with all necessary signatures and certification to the subdivider with instructions to have sal plat recorded with the Clerk of the Circuit Court of Pasco County within sixty (60) days of - the date of such approval. 7. SECTION 3. SUBDIVISION PERFORMANCE STANDARDS. (A. ) STREETS. (1. ) Any proposed subdivision street system shall re- cognize and extend the plan and profile of presently existing streets and shall make possible the future extension of streets into adjacent, undeveloped land, where feasible. (2. ) Block lengths in such subdivision shall not exceed 1, 500 feet. Lots in such subdivisions shall have a minimum size of 60 feet in width, 100 feet in length, a minimum area of 6,000 square feet and a minimum front yard set-back of 25 feet. (3. ) Sidewalks shall be required on all arterial collec- tors, commercial and residential streets. This will apply on both sides of the street if the street lies wholly within the boundaries of such subdivision. (4. ) Right of ways : (a. ) Arterial streets shall have a minimum of 100 feet right of way. (b. ) Collector and commercial streets shall have a mini- mum of 80 feet of right of way. (c. ) Residential streets shall have a minimum of 60 feet of right of way. (d. ) Cul-de-sacs shall have 50 foot right of ways to a 90 foot diameter right of way circle. (e. ) Where development occurs prior to the normal gro th pattern of the City, resulting in the dedication of only one-half of the necessary right of way on peripheral streets, no street improvements shall begin until the complete right of way is ob- tained. No building permits shall be issued for lots fronting on such half-streets. If, at the expiration of six months follow- ing the City Council ' s approval of such plat, the subdivider 8. I : , has been unable to acquire sufficient right of way for the full street, the City shall enter into condemnation proceedings to acquire this right of way with the subdivider bearing all costs sustained by such condemnation. (5. ) Design standards : (a. ) Pavement width (including width of curb or valley curb) ; (1. ) Arterial streets - 48 feet. (2. ) Collector or commercial streets - 28 feet. (3. ) Residential streets - 24 feet. (B. ) Basis for all streets shall be six (6) inches of primed compacted lime rock or shell and shall be in accordance with Section 130, 200 and 250 of the Florida Department of Trans- portations Standrds, Specifications, for road and brodge con- struction, and compacted to a minimum of ninety six per cent (96%) modified proctor maximum density. Test results to be fur- nished to the City by developer. (C. ) Surfaces for arterial streets shall be 1z inche asphaltic concrete. All other surfaces shall be one (1) inch asphaltic concrete. (D. ) Pavement crown shall be 1/4 inch per foot or greater, with no inverted crowns permitted. Finished pavement shall be from 1/4 inch to 1/2 .inch higher than the lip of any concrete gutter. (E. ) Sidewalks shall be four (4) feet wide and four (4) inches thick except at driveways. Driveway sidewalks sha 1 be six (6) inches thick with six (6) inch by six (6) inch, number ten (10) wire mesh reinforcing. (F.) Sub-bases for street shall be good, clean, acce t- able material, nin (9) inches compacted thickness, the material 9. to have sixty (60) pound per square inch Florida bearing value. G . Sub-bases for sidewalks shall be of( ) good, clean acceptable material, compacted to 0.96 degrees of maximum density. (H. ) Arterial streets shall be designed to meet Pasco County requirements. (I . ) Street names shall be approved by the City prior to final plat approval. (J. ) Street signs shall be placed at each intersection, such signs shall conform to City of Zephyrhills standards . . (K. ) Valley curbs shall be twenty four (24) inches wi e, with a minimum thickness of six (6) inches at the center with a three (3) inch - rise to the bank of the curb and a one (1) inch rise to the payment edge, three. thousand (3, 000) p. s. i . concrete used throughout. Design to be submitted to the City Council for approval. (L. ) Curbs shall be. twelve (12) inches deep, five (5) inches top width, with a six (6) inch deep, one (1) inch wide reveal on the face. Gutters shall ' be six (6) inches deep, , eighteen (18) inches wide, with a slope of of one (1) inchf:to one (1) foot, three thousand (3,000) p. s. i. concrete used through ut. Design to be submitted to the City for approval. (M. ) Vertical curbs without gutters shall be six (6). inches wide, eighteen (18) inches deep, with a six (6) inch curb above pavement, three thousand (3, 000) p. s. i. concrete u ed throughout. Design to be submitted to City for approval. (N. ) Alley right of ways shall be twenty (20) feet. SECTION 4. UTILITY REQUIREMENTS. (A. ) DRAINAGE REQUIREMENTS . .(1. ) SCOPE: 10. Complete drainage system shall be provided. All areas within the subdivision, including lots, streets, alleys and other areas, must be suitably drained. In addition, where drainage runoff from outside the subdivision passes over or through areas of the subdivision, such runoff shall be included in the drainage system design. Such system should be designed for long life and shall be suitable for low cost maintenance by normal maintenance methods. (2. ) HYDRAULIC DESIGN CRITERIA: (a. ) Rainfall and Runoff .Criteria : Such system shall be designed for "design floods" re- suiting from rain storms of the following expected frequencie or greater. (1. ) Twenty five (25) year rainfall interval for ma j r drainage ways (over one (1) square mile drainage area) . (2. ) Five (5) year rainfall interval for underground drainage through storm sewers. (3. ) Ten (10) year rainfall interval for all others. Rainfall intensity factors shall come from accepted meterological and rainfall sources as applicable to Pasco Cou ty. Ultimate land usage shall be assumed for selection of proper runoff coefficients within the basins involved, whether withi the subdivision or not. Weighted runoff coefficients shall b applied where different coefficients apply within the areas c m- prising the basin. The rational formula or other methods acc pt- able to the City shall be employed. (3'. ) HYDRAULICS. OF CURB AND GUTTER- CONSTRUCTLONs The minimum grade for curb and gutter construction sh 11 be 0.3 percent. 11. (4. ) HYDRAULICS OF UNDERGROUND DRAINAGE : Underground drainage through storm sewers, where em- ployed shall conform to good accepted engineering practice. Coefficients of friction suitable for the type of pipe or structure shall be applied. Minimum pipe diameters shall be fifteen (15) inches for side drains and eighteen (18) inches for cross drains, for swale drainage. Twelve (12) inch minimu pipe diameter for closed hydraulic design. Inverted siphons shall not be accepted. (5. ) HYDRAULICS OF DRAINAGE STRUCTURE : Drainage structures such as bridges, box culverts, head- walls, dams, weirs, spillways, ',bulkheads and other structures shall be designed hydraulically and structurally in accordance with good accepted engineering practice. The effects on adjacent channels and structures shall be considered. Foundations or other supports or anchoring methods shall be adequate. (6. ) DRAINAGE OUTFALLS: Studies may be required showing that existing outfalls are both positive and adequate. Drainage wells, seepage basins or underdrains shall not be accpted as positive outfalls. (7. ) HYDRAULICS OF MINOR STREAMS, CANALS, DITCHES AND SWALES : Open channels other than major waterways may be defined as minor streams, canals, ditches and 'swales. Such open channels shall be designed in accordance with good accepted engineering practice adapted to local conditions. The design shall provide that the channels will not overflow their banks at design flood conditions. Cross-sectional areas and hydraulic gradients shall 12. it • �� 1 . .• � . , . . _ . . . be such that design velocities shall not result in solid scouring for the soil and/or turf conditions reasonably anticipated. Mean velocities greater than three (3) ft./sec. shall be con- sidered excessible unless permanent channel lining or other suit- able protection is employed. (8. ) . MAJOR • WATERWAYS : Improvement or establishment of major canals is of suc significance to the City and County that the design of each such improvement or establishment proposed shall be developed s a separate hydraulic problem. Engineering data, criteria and suitable calculation shall be submitted to the City prior to approval of construction plans. Design to comply with Standar s adopted by the City. (9. ) DRAINAGE CONNECTION AND INTERSECTIONS : Drainage connections to drainage ways, and intersectin and. conveying drainage ways shall be suitably designed and aligned to provide effective erosion and silting control, subj ct to the approval of the City. (10. ) LAKES :' Where lakes are included as a part of the drainage system, detention time in these lakes may be considered in com ut ing discharge by presentation of hydrographs based on accepted engineering• practice approved by the City. (11. ) CULVERT PIPE : Culvert pipe shall be reinforced concrete pipe, asphal coated corrugated metal pipe or aluminum pipe. Culvert pipe n t subjected to wheel traffic loads may be of non-reinforced con- I I crete, asphalt coated corrugated metal pipe or aluminum pipe ` 7 conforming to specifications of AASHO. Corrugated metal pipe may be used if proof that soil conditions will not be harmful is submitted. 13. Proposed designs shall be submitted for approval of the City. (15. ) VALLEY CROSSINGS IN STREETS : Design of valley crossings in streets shall be submitted for approval by the City. (16. ) UNDERDRAINS : (a. ) Underdrains for curb and gutter construction : Where road construction incorporates curbs and gutters, underdrains shall be installed, where necessary, as determined by the subdivider' s Engineer. The underdrains shall be eight en (18) inches outside of the curb and a minimum of eighteen (18) inches below the bottom of the curb and with a slope to a pos ' - tive outfall. Where test reports justify the omission of under- drains, such reports must be submitted with plans. (17. ) CANALS, LAKES, MAJOR WATERWAYS : Lakes shall have a maximum side slope of 4:1 to a nor al depth of water of six (6) feet. Proposed designs shall be sub- mitted for approval of the City. (18. ) FLOOD PLANES : Where lands are or have been subject to periodic f1oocling and minimum building elevations have not been established by he County or the U.S. Corps of Engineers, the subdivider ' s engineer shall establish flood planes at design flood condition. (19. ) DRAINAGE EASEMENTS AND RIGHTS-OF-WAY : (a. ) Structures : All structures shall be within a de- dicated easement large enough to permit access, maintenance, and protection. A minimum easement of ten (10) feet width shall be provided over all culvert pipe that is not placed within street rights-of-way. A minimum easement of ten (10) feet width shall be provided for access to structures not placed within street 15. 1: • rights-of-way, said easement shall be along the nearest lot lines from the structure to the street rights-of-way. Where an easement is to be used for two or more uses such as storm sewer and power lines, the minimum width shall be fifteen (15) feet. (b. ) Canals and major waterways : All easements for canals and major waterways shall include sufficient width for the ultimate design canal top of bank width plus a minimum fifteen (15) foot berm on one side of the proposed canal for top of b nk dimensions under forty (40) feet, and a minimum fifteen (15) foot berm on both sides of the proposed canal for top of bank dimensions of forty (40) feet and over. (c. ) Lakes : When a lake is incorporated within a su - division and is abutting by lots, such abutting lot lines sha 1• be extended into the lake proportionately encompassing all of the lake area, and where such lakes exist and are bounded in whole, or in part, by streets, a strip of land not less than twenty (20) feet wide abutting such street right-of-way shall border the lake. Such border shall be proportionately divide into sub-lots or satellite lots, whose lot lines shall be ex- tended into the lake proportionately, encompassing all of the lake area. Such satellite lots shall become apportioned to, nd as a part of, these lots on the opposite side of the street. In such cases, satellite lot, except that additional) they shall carry the lettered Suffix A. Plats submitted as above shall note a restriction tha satellite lots can neither be, purchased nor sold separately f om their parent lot, and that for tax purposes, the two lots sha 1 be assessed as one lot. 16. It should be noted that any areas involved in satel lite lots or the extension of any lot lines into lakes can not be applied to lot areas for the purposes of meeting minimum lot area requirements. Where such lakes are included as a part of the drainage system of the subdivision, an easement shall be dedicated acr ss the lake with sufficient width to enable suitable construction to permit continued use of this drainage way, if the lake is filled by the private owners. (B. ) SANITARY SEWER SYSTEM : (1. ) Design criteria, materials and construction of 11 facilities for the collection and transportation of sanitary sewage located within the development and serving individual residences within the development shall be in accordance with Section 170 C-6 of the Florida State Sanitary Code. Such fac ii- ties shall include gravity sewer collecting piping, sewer service laterals, sewage pumping facilities, force main piping, and all C ' other appurtenances necessary to complete the system. (2. ) Connections between dwellings and the sewerage facilities described in "No. 1" above shall be in accordance ith the City. (C. ) WATER SYSTEMS : (1. ) The purpose of this section is to set forth cri e±ia, procedure, and minimum standards for the design of all water supply systems to be connected to the City of Zephyrhills. (2. ) There shall be no physical connection between a safe water supply and a questionable supply or a sanitary or torm sewerage system which would allow unsafe water to enter the s Fe water system by direct pressure, vacuum, gravity, or other means. 17. rn Water mains will not be installed in the same trench with sewer lines. Water mains will not be located closer horizontally than ten (10) feet from a sewer. Where water lin s cross over gravity sewer lines closer than eighteen (18) inche , the sewer pipe for a distance of ten (10) feet each side of th crossing, will be made of pressure pipe with no joint located within five (5) feet, horizontally, of the crossing or encased with six (6) inch concrete all around for ten (10) feet. Wate lines will be at least two (2) feet above the sewer pipes. Dead ends in� mains will not be approved except where unavoidable, such as at the ends of cul-de-sacs, in which case permanent blow offs or hydrants will be provided for blowing off the line. (3. ) Sizes of mains will depend upon fire demand, and the peak domestic demand. Every distribution system will be designed to deliver required flows under both of the following conditions : Peak domestic flow of 22 times the average daily requ ' re- ments at a minimum residual pressure of thirty (30) psi in th main. Necessary fire flow requirements plus fifty per cent ( 0%) of the average domestic requirements. The residual pressure during fire demand may be drawn down to twenty (20) psi in th main in areas where only hose streams are required. (4. ) Water mains shall be installed in public rights of-way (not easements) five (5) to seven (7) feet behind the curb. (5. ) Valves will be installed at intervals of not mo e than 1,300 feet in main distribution loops or feeders and on 11 primary branches connected to .these lines, lengths should not exceed two blocks or eight hundred (800) feet. Except in cas "s 1 . . F of long blocks where additional valves will be required, valves will be installed at street intersections. (6. ) Fire Hydrants will be required in all water distri- bution systems and extensions thereof, and shall be spaced so that no dwelling is more than 500 feet hose distance from a fi e hydrant. Each hydrant shall be capable of delivering not less than 500 GPM with a residual pressure of not less than 20 psi. In no case shall mains feeding fire hydrants and fire hydrant branches be less than six (6) inches in diameter. Each branch will be individually gate valved. Fire lines shall also be valved at the right-of-way line. Hydrants will be located within one (1) foot of the; pro- perty line, on lot lines and the pumper discharge will face t e nearest roadway with discharge twenty (.20) inches above grade level. Fire hydrants shall be of the compression type, confo m- ing to AWWA C502-54, with a six (6) inch inlet connection, a valve opening at least four .(4) inches in diameter. Each hydrant shall be fitted with one 4z inch pumper connection and two 2'-z inch hose connections, all having American National StandardShose threads. Each hydrant shall have a barrell of sufficient lengt to bring the bottom of the six (6) inch connection three (3) feet below the surface of the finished ground . Hydrants shall be painted by the developer in accordance with City regulations. (7. ) Pipe and fittings over four (4) inches will be cast iron, A.S.A. A21.6 or A21.8 in standard lengths. Cement 19. I, lining in accordance with A.S.A. A21. 4 except it shall be half thickness, "Enameline" or equal, with seal coat. Standard bituminous enamel coating outside. Class 150, iron 18,000 psi tensile strength, 40,000 psi modulus of rupture. Joints shall be "Fastite", "Belltite" or "Tyton" . Mechanical joint pipe may be used with written approval or any pipe approved by the Florida State Board of Health and/or any other regula- tory agency. Pipe and fittings four (4) inches and under will be same as above or may be PVC Type II, conforming to ASTM-D 178 -65T specification. 'PVC pipe and fitting will be not less than schedule 40 for cemented joints and not less than schedule 80 for threaded joints, and shall, be free- from odor and taste an shall meet the specifications for potable water pipe as publi hed by the National Sanitation Foundation Testing Laboratories, I c'. . (8. ) Before any section of the system is placed in service, it shall be disinfected and shown by test to be free from potential sources of bacterial pollution. The procedure for disinfection shall conform to the State of Florida Stands d Procedures. The City shall also require a hydrostatic test a 150 P.S.I . in accordance with A.W.W.A. Standards. (9. ) Metered and unmetered taps will be made by the City at the standard fees and application for such taps' requi es plan approval of the proposed distribution system. (D. ) FIRE PROTECTION: (1. ) Fire hydrants shall be positioned throughout th development so that no structures shall be more than five hun red (500) feet distant from a hydrant, and shall be supplied with water from not less than six (6) inch diameter' mains. 20. (2. ) All recreation halls, laundry rooms and other out buildings used by the residents shall have approved fire extinguishers properly positioned, and shall have exit lights over all exterior doors. (3. ) Parking - No parking shall be allowed within twenty (20) feet of any corner. (4. ) All overhead wires shall be a minimum of fifteen (15) feet above the street surface. (5. ) Where possible, more than one entrance-exit fro the development shall be provided. SECTION 5. UTILITIES --GENERAL: All gas, water, sewer, electrical, telephone and cable television utilities shall be placed underground. For the purpose of this paragraph surface mounted tra s- formers, pedestal mounted terminal boxes and meter cabinets, street lighting or signal control cabinets, and other associ- ated equipment in an underground system may be placed above ground. Plans for building sites for such associated equipme t ii shall be submitted for approval to the Director of Public Wor s. Structures over three (3) feet in height shall be totally screened by a continuous permanent evergreen planting. Struc- tures over three (3) feet high shall have a minimum of forty per cent (40%) of the height of the exposed wall surface screened by a continuous permanent evergreen planting (or equivalent) . The owner or developer is responsible for complying with thes requirements and shall make all the necessary arrangements as required by the serving utilities for the installation of such facilities. 21. :: 1 Conflicts between this regulation and applications on State or County rights-of-way or easements shall be resolved by the utility owner with the Director of Public Works. SECTION 6. AUTHORITY OF CITY INSPECTORS. A City of Zephyrhill ' s Inspector may inspect all con- struction, all materials and may inspect preparation, fabrica- tion or manufacture of supplies. The City Inspector is not authorized to revoke, alter or waive any requirements of the specifications, but he is authorized to call to the attention of the subdivider any ; failure of work or materials to conform to the plans or specifications. The City Inspector shall have t e authority to reject materials or suspend the work until any questions of issue can be referred to and decided by the City. The City Inspector shall in no case act as foreman or perform other duties for the subdivider, nor interfere with the management of the work, and any advice which the City Ins ec- tor ,may give to the subdivider, shall in no way be construed a binding, to the City or releasing the subdivider from carrying out the intent of the plans and specifications. When the City Inspector causes the operation to cease, he will present to the subdivider or his agent a written orde signed by the City Manager r or City Clerk. SECTION 7. VARIANCES. If these standards create any undue hardship on the developer, a variance may be granted by the City Council. SECTION 8. PENALTIES. Any subdivider, developer or agent of such subdivider or developer violating any mandatory provision of the foregoing ordinance shall, upon conviction thereof, pay a fine not ex- 22. ceeding Five Hundred and no/100 ($500.00) Dollars, or a jail sentence not exceeding ninety (90) days, or both, in the discretion of the Municipal Judge. SECTION 9. SAVINGS CLAUSE. Should any section, or part of any section, of this ordinance, for any reason be found to be invalid or void, by a court having jurisdiction of same, such ruling shall have no effect upon the remaining provisions of such ordinance.
