HomeMy WebLinkAbout309 Utility Fund Water Rates ORDINANCE NO. 309 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS AMEND- i• (�, ING ORDINANCE #274; CHANGING THE NAME "SANITARY SEWERAGE FUND" to "UTILITY FUND" ; CHANGING CHARGE FOR WATER SERVICE TURN-ON AND TURN-OFF: AMENDING SECTION 27 (a) PERTAINING TO DISCONTINUING SERVICE FOR NON-PAYMENT: AMENDING SECTION 29 CHANGING FEE FOR RE-READING OF METERS: AMENDING SECTION 35 CHANGING WATER AND SEWER RATES; DEFINING PENALTY THEREFOR. WHEREFORE, the City has heretofore enacted Ordinance 274 pertaining to water and sewer within the City and whereas it is in the best interest of the City that certain amendments be made, Ordinance #274 is hereinafter amended as follows : 1. Paragraph 2 of Section 2 is hereby deleted in its entirety and shall be amended to read as follows : "That any owner, tenant or occupant of any such lot either failing or refusing to connect with the sewerage system within 120 day period of time upon receiving notice by the appropriate city official to connect said sewerage system shall be guilty of a misdemeanor by the second degree and punished as provided for according to applicable State law. 2. Paragraph (a) of Section 27 , shall be deleted in its entirety and shall be amended to read as follows : "In the event it becomes necessary to discontinue supplying water to any consumer or failure of said consumer to pay the charges and subsequently said consumer shall pay said delinquent charges then he shall be entitled to have said water service restored upon payment to the City Manager of the fee of $10 as a charge for restoring service in addition to a $10 cut-off fee" . 3 . Paragraph (b) of Section 26, shall be deleted in its entirety and amended to read as follows: Charge for turning water on or off; when it shall become necessary for a user to have his water turned on or off the normal charge for such service shall be $10 or such other charge as the City Council may from time to time set provided, however, that service can be effected during the normal working hours of the City employees; if a user shall request that the water be turned on or off at any yii o3 pp rree -gyp 4 3 1 / U aJ time other than the normal working hours of City employees the charge shall be $20 for turning the water on or off or such other charge as the City Council may from time to time establish. " 4 . Section 28 , shall be deleted and amended to read as follows: "'It shall be unlawful for any person to tap or make any connection with the City water or sewer mains or pipes other than owners of property within or on their own property without first procuring therefor a written permit from the City; any person violating the provisions of this section shall be guilty of a misdemeanor of the second degree as defined and as punishable by the Florida Statutes. 5. Section 29 , shall be deleted in its entirety and amended to read as follows: "Re-reading water meters. If requested, water meter readings will be re-checked, however, if meter is not malfunctioning and there is not a leak in the lines, then there shall be an additional charge of $10 to the person requesting re-reading of meter. 6 . Section 35, shall be deleted in its entirety and . - amended to read as follows : "Rates. The rates for water and sewer service shall be as follows : Water Inside City: Ninety cents ($ . 90) per 1,000 gallons metered water. Water Outside City: One and 35/100 dollars ($1,35) per 1, 000 gallons metered water. Sewer Inside City: Ninety cents ($ . 90) per 1 ,000 gallons as determined by computa- tions based-on 9.0,- of -the metered water for that unit. Sewer Outside City: One and 35/100 dollars ($1. 35) per 1,000 gallons as determined by computing 90% of the metered water for that unit.. Service Fee: There shall be a service fee per user of water or sewer or both per lot per month in the amount of $1 if such lot is inside the City and $1. 50 if such lot is outside the City during the period service is active. (lot shall also include each individual .lot. in. nfobile.home parks, each O.R. 11®3 PG 1944 individual unit of a motel , hotel or apartment. " 7 . Section 8 shall be deleted in its entirety and shall be amended to read as follows : "The funds received from the collection of the charges or rentals authorized by this Ordinance shall be deposited daily with the City treasury, and shall be accounted for and be known as the Utility Fund and when appropriated by the City Council , shall be available for the purpose of payment of the costs and expenses of the management , maintenance and repair of the City' s sanitary sewerage system, and the sewage pumping treatment and disposal works , and any surplus in such funds shall be used for the payment of the interest on the certificates . issued and outstanding, or which may be issued, to provide funds with which to pay the City' s portion of the cost of constructing such sanitary sewerage system, or part thereof, and such sewerage pumping -treatment -and -disposal works and to retire such 'certificates when they mature , and/or for the enlargement or replacement of said sanitary sewerage system, pumping, treatment and disposal works . 8 . Paragraph (b) , Section 22 shall be deleted in its entirety and shall be amended to read as follows : It shall be a requirement that each single family residential unit and duplex shall have a separate water meter. The City of Zephyrhills may require that each unit in a multiple unit area be metered individually, which requirement may be enacted either in the initial stage of the multiple residential unit development or at any subsequent date that the City deems - - advisable and an early non-requirement by the city shall -not be a.' waiver of that requirement. Multiple unit area shall mean an area utilized for a high density of residential living, for example an apartment complex, mobile home park and travel park. Multiple being three or more residential units . In the event multi- units are on a master meter, such account shall be the respons-ib l'&ty -. of and in the name of the real property owner. Section 43 shall be deleted in its entirety and shall be amended to read as follows : Any residential use of either water or sewer facilities who does not have a water meter installed shall pay a flat fee of $10 per month for each service (water and/or sewer) received from the City prior to meter installation, aril'.provided, further, that nothing in this section shall ,exempt any user from the requirement to connect. ` :.. as hereinbefore referenced. Any commercial user of either water or sewer facilities who. :, does not have a water meter installed shall continue to pay the rates in -:existence immediately prior to the enactment of Ordlinance,- 294 for each such service received from the City prior to meter installation and further, provided, that nothing in this section shall exempt any user from the requirement to connect as herein- before referenced and further provided there shall be a minimum charge of $20 per month. 10 . . Effective date . This Ordinance shall become effective when- s-igned by the mayor after publication and notice as required by law.
