AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA
AMENDING THE MASTER PLAN FOR SILVER OAKS PLANNED UNIT
DEVELOPMENT ("PUD"); IN ACCORDANCE WITH THE PROVISIONS
OF SECTION 166.041, FLORIDA STATUTES; PROVIDING FOR
CODIFICATION, CONFLICT SEVERABILITY, AND AN EFFECTIVE
DATE. (SILVER OAKS).
WHEREAS, on December 10th, 2001, the City Council of the City of Zephyrhills,
Florida (hereinafter the "City Council") adopted Ordinance 784-01, which approved a
modification to the Silver Oaks PUD Master Plan; and
WHEREAS, The City received a request on behalf of CBD Real Estate Investment, LLC
for approval of an additional amendment permitting modifications to the Silver Oaks 'PUD
Master Plan; and
WHEREAS, Planning and Zoning have reviewed the application and have approved the
proposed amendments and modifications with certain conditions; and
WHEREAS, the City Council, as the governing body of the City of Zephyrhills, Florida,
pursuant to the authority in Chapter 163 and Chapter 166, Florida Statutes, and the City's Land
Development Regulations, is authorized and empowered to consider petitions related to zoning
and land development orders; and
WHEREAS,,the City Council has considered the evidence and testimony presented by
the Applicant and other interested parties and the recommendations of the various City of
Zephyrhills review agencies and staff; and
WHEREAS, the City Council deems approval of this Ordinance to be in the best interest
of the health, safety, and welfare of the residents and citizens of the City of Zephyrhills, and the

NOW THEREFORE BE IT ENACTED AND ORDAINED BY THE CITY
COUNCIL OF ZEPHYRHILLS,FLORIDA AS FOLLOWS:
Section 1: The above Whereas clauses are hereby adopted and incorporated herein.
Section 2: The City Council for the City of Zephyrhills has determined/that the amending
and modifying_{of the Silver Oaks PUD Master Plan would promote the general welfare and
,encourage`proper,development within the City, and that the following described lands, lying and
•being situated in Pasco County,to wit:

REFERENCE.AS EXHIBIT "A".
SILVER OAKS MASTER PLAN MODIFICATION SKETCH IS ATTACHED yHER C.
AND INCORPORATED BY REFERENCE AS EXHIBIT "B".
Section 3: The Silver Oaks PUD Master Plan is hereby amended as to area"G-as fo"ilovs: '
1. The use for area" is changed from duplexes--to single family residential.
2. The side yard setback is reduced from 7.5 feet to 5 feet.
3. The amendments in this section have the following conditions:
a. Area "G" is authorized only as a 55 and older community pursuant to
Florida Law. Any change in use shall require review and approval from
the City.
b. i Home elevations shall be limited to one story and no more .than two
consecutive lots with the same elevation.

c. Area "G" shall include a perimeter screening/buffer along Simons Road
with details provided on the future Construction Plans.
d. The minimum landscape package, including a tree in the front and rear
yard, shall be required on each lot and be 'provided ' in the HOA
documents.
e. The Builder shall provide a varying front and rear yard setback of a
maximum of two feet on each adjoining lot.
f. No air conditioning compressor units or other above ground structures,
other than fences that comply with paragraph g below, shall be allowed in
the side yard setback.
g. Future side yard fences shall be subject to City permitting requirements
and shall be raised 4 inches in the side yard to ensure proper drainage.
h. The entryway / gateway treatments shall be constructed and shown and
approved on the future construction plans.
i. The Builder shall provide to the City Planning Department (at the time
each building permit is submitted) an as-built survey documenting that the
side yard drainage has been constructed pursuant to the approved
construction plans.
j. Consecutive lots shall not be.allowed the same exterior paint color.
k. The future Simon's' Road construction plans shall need to address the
intersection improvement at the Northwest corner of Area"G".
Section 5: This Ordinance shall supersede all ordinances or parts of Ordinances in conflict
herewith. All provisions of the Silver Oaks PUD Master Plan unaffected by this Ordinance shall
remain in full force in effect.
Section 6: That if any section, sentence, clause or phrase of this Ordinance is held to be
invalid of unconstitutional by a court of competent jurisdiction, then said holding shall in no way
affect the validity of the remaining portions of this ordinance.
Section 7: - This_Ordinance shall become effective upon passage on the second reading and
signing by the City Council President. -
The foregoing Ordinance No. 1327-17 was read and passed on the first reading in an open and
regular meeting-of the City Council of the City of Zephyrhills, Florida, on this 24th day of April,
2017. -
