AN ORDINANCE OF THE CITY I COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, APPROVING A SMALL SCALE FUTURE
LAND USE MAP AMENDMENT TO THE CITY'S COMPREHENSIVE
PLAN; CHANGING THE FUTURE LAND USE MAP DESIGNATION
FOR THE TERRITORY HEREINAFTER DESCRIBED FROM CITY
FUTURE LAND USE MAP DESIGNATION RC/OPEN SPACE TO CITY
FUTURE LAND USE MAP DESIGNATION CITY MU, CONSISTENT
WITH THE GOALS, OBJECTIVES, AND POLICIES OF THE ADOPTED
COMPREHENSIVE PLAN, AS REQUIRED BY THE GROWTH
MANAGEMENT ACT OF 1985; AMENDING THE ZEPHYRHILLS LAND
DEVELOPMENT CODE TO CHANGE THE ZONING ON LAND
HEREINAFTER DESCRIBED FROM CITY ZONING CATEGORIES
CITY RC TO PLANNED UNIT DEVELOPMENT ("PUD"), IN
ACCORDANCE WITH PROVISIONS OF SECTION 166.041, FLORIDA
STATUTES; PROVIDING FOR CODIFICATION, CONFLICT,
SEVERABILITY,AND AN EFFECTIVE DATE.
WHEREAS, the District School Board of Pasco County, the owner of land hereinafter
described in Section 2 below, did petition on the 10 day of May, 2016 for rezoning of said land;
and
WHEREAS, the City Council has been given authority by the State of Florida pursuant
to Chapter 163, Florida Statutes, to amend the 'uture Land Use Map of the City's territorial
boundaries upon receipt of written consent of the land owners, together with the approval of the
City Council of said Future Land Use Map amendment duly expressed by Ordinance; and
WHEREAS, the City Council has been given authority by the State of Florida pursuant
to Chapters 166 and 163, Florida Statutes, to rezone property within the City limits upon receipt
of written consent of the land owner, together with the approval of the City Council of said
rezoning duly expressed by Ordinance; and
WHEREAS, due public notice of hearing on the proposed rezoning was given by the
City Council on May 25, 2017, as required b ' the Zephyrhills Land Development Code, as

amended, and Chapters 163 and 166, Florida Statutes; and
WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a
public hearing on the 19th day of July 2016 to consider said proposed rezoning; and
WHEREAS, the Future Land Use Map Amendment meets the criteria of a small-scale
Map amendment for the proposed FLUM amendment in application of the School Board of
Pasco County are consistent with the goals, objectives and policies of the Comprehensive Plan;
and
WHEREAS, the property immediately east of the subject property will be transferred to
the City of Zephyrhills and turned into a functioning park("City Park"); and
WHEREAS, the City Council has determined that the Planned Unit Development
("PUD") zoning category would be appropriate; and would promote the general welfare, and
encourage proper development within the City.
NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL
OF ZEPHYRHILLS,FLORIDA, AS FOLLOWS:
Section 1: The above Whereas clauses are hereby adopted and incorporated herein.
Section 2: The following described lands, lying and being situated in Pasco County,to wit:

the Future Land Use Map designation is City MU and is hereby rezoned as a Planned Unit
Development ("PUD")'with p•referred or permissible uses as listed below and included within
the boundaries of the City of Zephyrhills, Florida subject to the followingconditions:
1) A boundary survey with legal description of the subject 1.79 acres shall be
provided to the City to be included in the Ordinance;
2) The following are the PUD preferred or permissible uses for the parcel: Staff
recommends approval this petition with the following preferred and permissible uses as a
Planned Unit Development: Restaurant/Cafe / fast food (with drive through allowed); Retail,
Coffee/Smoothie/Ice Cream/Yogurt shop; Bakery; Gym; Health/Nutrition Shop; Biking/Hiking
Equipment and Accessory Store.
3) There will be park connectivity between one acre site and Hercules (pedestrian,
ability for drive way passage)
4) Future property owners shall collaborate with the City and the CRA to master
plan the following conditions:
a. Park connectivity between one acre site and the future City Park (pedestrian,
ability for drive way passage);
b. Buffering on the park side and screening of the drive through (screening/fencing,
etc. —similar to drive through at Panera Bread);
c. Outdoor lighting that is environmentally based and compatible to park; and
d. Outdoor seating that will be on the side closest to the future City Park;
5) Future property owner shall be required to provide a site environmental report and
address any necessary environmental permitting as required;
6) Future development shall comply with the City's basins of special concern
ordinance;
7) Future development shall comply with the current City Code of Ordinances,
including landscaping and-bike rack requirements;
8) Future uses that involve storage shall require a report submitted to the City and
signed by a professional engineer or geologist licensed in Florida detailing the impact of the
proposed development on the ground water and impacts to well number five;
9) Future subsequent traffic studies will be required to address transportation
concurrency and site access at the time a future site plan is submitted. The future developer shall
be required to obtain necessary permit(s) from Pasco County and FDOT;
be the same is hereby designated on the Future Land Use Map and rezoned and included within
the boundaries of the City of Zephyrhills, Florida.
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the
extent of such conflict.
Section 4: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid
or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect
the-validity-of-the-remaining-portions-af-this-ordinance— — --
Section 5: This ordinance shall take effect as provided in the City Charter and Chapter 163,
Florida Statutes.
The_foregoing Ordinance No. 1328-17 was read and passed on the first reading in an open and
'regular-meeting of the City Council of the City of Zephyrhills, Florida, on this 22nd day of May,
2017.
