TRANS ORTATION IMPACT/UTILITIES IMPACT AND RESOURCE RECOVERY FEES: The undersigned understands
that Tra sportation Impact Fees and Recourse Recovery Fees may apply to the construction of new buildings, change of
use in e isting buildings, or expansion of existing buildings, as specified in Pasco County Ordinance number 89-07 and
90-07, s amended. The undersigned also understands, that such fees, as may be due, will be identified at the time of
permitti g. It is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to
receivin a "certificate of occupancy" or final power release. If the project does not involve a certificate of occupancy or
final po er release, the fees must be paid prior to permit issuance. Furthermore, if Pasco County Water/Sewer Impact
fees ar due, they must be paid prior to permit issuance in accordance with applicable Pasco County ordinances.
CONST UCTION LIEN LAW(Chapter 713, Florida Statutes, as amended): If valuation of work is $2,500 00 or more, I
certify t at I, the applicant, have been provided with a copy of the "Florida Construction Lien Law—Homeowner's
Protecti n Guide" prepared by the Florida Department of Agriculture and Consumer Affairs. If the applicant is someone
other th n the"owner", I certify that I have obtained a copy of the above described document and promise in good faith to
deliver i to the"owner" prior to commencement.
CONT CTOR'S/OWNER'S AFFIDAVIT: I certify that all the information in this application is accurate and that all work
will be �one in compliance with all applicable laws regulating construction, zoning and land development. Application is
hereby made to obtain a permit to do work and installation as indicated. I certify that no work or installation has
comme ced prior to issuance of a permit and that all work will be pertormed to meet standards of all laws regulating
constru tion, County and City codes, zoning regulations, and land development regulations in the jurisdiction. I also
certify t at I understand that the regulations of other government agencies may apply to the intended work, and that it is
my res onsibility to identify what actions I must take to be in compliance. Such agencies include but are not limited to:
- Department of Environmental Protection-Cypress Bayheads, Wetland Areas and Environmentally Sensitive
Lands, Water/Wastewater Treatment.
- Southwest Florida Water Management District-Wells, Cypress Bayheads, Wetland Areas, Altering
Watercourses.
- Army Corps of Engineers-Seawalls, Docks, Navigable Waterways.
- Department of Health & Rehabilitative Services/Environmental Health Unit-Wells, Wastewater Treatment, �
Septic Tanks.
- US Environmental Protection Agency-Asbestos abatement.
- Federal Aviation Authority-Runways.
I under tand that the following restrictions apply to the use of fill:
- Use of fill is not allowed in Flood Zone"V" unless expressly permitted.
- If the fill material is to be used in Flood Zone "A", it is understood that a drainage plan addressing a
"compensating volume" will be submitted at time of permitting which is prepared by a professional engineer
licensed by the State of Florida.
- If the fill material is to be used in Flood Zone "A" in connection with a permitted building using stem wall
construction, I certify that fill will be used only to fill the area within the stem wall.
- If fill material is to be used in any area, I certify that use of such fill will not adversely affect adjacent
properties. If use of fill is found to adversely affect adjacent properties, the owner may be cited for violating �
the conditions of the building permit issued under the attached permit application, for lots less than one (1) ,
acre which are elevated by fill, an engineered drainage plan is required. �
If I am he AGENT FOR THE OWNER, I promise in good faith to inform the owner of the permitting conditions set forth in I
this affidavit prior to commencing construction. I understand that a separate permit may be required for electrical work,
plumbir�g, signs, wells, pools, air conditioning, gas, or other installations not specifically included in the application. A
permit �ssued shall be construed to be a license to proceed with the work and not as authority to violate, cancel, alter, or
set asi �e any provisions of the technical codes, nor shall issuance of a permit prevent the Building Official from thereafter
requiri g a correction of errors in plans, construction or violations of any codes. Every permit issued shall become invalid
unless he work authorized by such permit is commenced within six months of permit issuance, or if work authorized by
the per it is suspended or abandoned for a period of six(6) months after the time the work is commenced. An extension
may b requested, in writing, from the Building Official for a period not to exceed ninety (90) days and will demonstrate
justifia le cause for the extension. If work ceases for ninety (90) consecutive days, the job is considered abandoned.

,ARTICLE 2. - TNE WURK AND CQMPLETION TtME. The Contractor agrees to furnish ail fabar,
materi fls, equipment, permits, licenses, and services for the proper completion of the above-identified property
in acco cfance with the Bid Docurnents and Specifications. The Contractor agrees that materials supplied are
guaran eed to be as specified. All work shal( be satisfactarily completed within ninety (90) calendar days after
the No�ice to Proceed is issued. All work shal! be completed in a workmanlike manner according to standard

ac,r,eptable standards, work deemed to be below standards will be rebid and deducted from final payment.
This action can prevent the contractor from bidding on any further work or projects. Substantial completion of
the rehab is determined when the job write-up is 100% completed. If the rehab is not substantially completed
by the due date, the contractor can not submit a bid for new projects. Upon substantial completion, the
contrac or has seven (7) days to complete the punch list items and fourteen (14) days to submit Final Release
of Lien � from the contractors, sub-contractors, the notice to owner and all construction required documents. If
the con�ractor does not meet the fourteen (14) days for the Lien Release, he will not be able to bid on any new
project�until final paperwork has been submitted. The premises will be unoccupied during the course of
constru tion.
ARTICLE 3. - TIME OF COMMENCEMENT: No work shall be commenced by the Contractor until
he/she has received a written Notice to Proceed from the Community Development Division. The Notice to
Proceed will be issued within thirty(30) days from the date of the Contractor signing this Contract, or if it is not,
the ConItractor has the option of withdrawing his bid and proposal. Work shall begin no later than seven (7)
days after the Notice to Proceed is issued. If work is not substantially completed within agreed upon time
period, Contractor will be penalized One Hundred and 00/100 Dollars ($100.00) per day liquidated damages on
new co struction and Fifty and 00/100 Dollars ($50.00) per day liquidated damages on rehabilitation projects
for eve working day until substantial completion, unless approval for extension has been agreed upon in
writing y Owner, Contractor, and the Community Development Division. This provision is contingent upon
strikes, accidents, Acts of God, or other events beyond the control of Pasco County and the Contractor.
�ARTICLE 4. - PAYMENT: The Contractor will be paid according to the draw schedule as stated in the
Program Policy Statement for the County's rehabilitation program after the Community Development Division
conducts an inspection certifying that the work has been completed according to the contract. Final payment
due thE Contractor will be made after the Contractor has furnished the Owner, in care of the Community
Develo�-ment Division, satisfactory release of liens or claims for liens by subcontractors, laborers, and material
supplie�s for completed work or installed materials. All such releases must be notarized. Payments will be
made in accordance with Florida Statutes, Chapter 218.735-74, Local Government Prompt Payment Act
consid�red due upon receipt by the Clerk of the Circuit Court and paid upon approval by the Board of County
Commissioners. Within thirty (30) days of completion of the contract, the contractor shall submit the request
for fina payment along with the required documentation for payment. The County shall not be responsible for
any re uests after the 30 days.
ARTICLE 5. - CONTRACTOR'S INSURANCE: The Contractor shall be responsible for all damages to
person or property that occur on the job site or adjacent thereto as a result of his fault or negligence in
conneo ion with this contract. The Contractor shall, prior to commencing work, furnish evidence of required
compr hensive liability insurance. The Contractor shall also furnish evidence of coverage in accordance with
Florida Workers' Compensation Laws. Contractor shall furnish Community Development Division with new,
update or renewed insurance coverage to continue to bid on projects.
ARTICLE 6. - SUBCONTRACTS: All subcontractors shall be bound by the terms and conditions of
this co tract insofar as it applies to their work, but this shall not relieve the Contractor from the responsibility to
the O ner for the proper completion of all work to be executed under this Contract, and he7she shall not be
releas�d from this responsibility by any subcontractual agreement he may make with others. The Contractor
shall b� required to furnish to the Owner and Community Development Division in writing, a list of the names of
the su�contractors proposed for the principal portions of the work at this contract signing. The Contractor shall
not errf ploy any subcontractor to whom the Owner or the Community Development Division may have a
� reasonable objection. A current form for listing subcontractors is available on the Community Development
Division website. The notice to proceed will not be issued until the required sub list has been completed for this
contract and submitted to the Community Development Division.

A,RTICLE 7. - GENERAL RESPONSIBILITIES OF THE CONTRACTOR:
7.1 The Contractor shall be licensed and supervise and direct the work using his best skills
and attention.
7.2 The Contractor shall provide the Owner and Comrnunity Development Division with
evidence that he/she has secured and paid for all licenses and permits necessary for the
proper execution of the work; and, upon completion of the job, shall provide evidence
that all work has been inspected and approved by the appropriate building inspectors.
7.3 The Contractor shall not employ on the work any unfit person or anyone not skilled or
licensed, if appropriate, in the task assigned to him.
7.4 The Contractor shall be responsible for the acts and omissions of all his employees, and
all subcontractors, their agent and employees, and all other persons performing any of
the work.
7.5 The contractor shall seek approval from Community Development Division prior to
substituting any materials or products deemed "EquaP' to the specific materials or
products listed in the most recent Bid Specifications or Work Write-Up.
7.6 The Contractor shall not assign this contract without written consent of the Owner and
the Community Development Division. Any request for assignment must be addressed
to the Community Development Division.
7.7 The Contractor at all times shall keep the premises free from accumulation of waste
materials or rubbish caused by this work.
7.8 The Contractor shall permit the- Community Development Division to examine and
inspect the construction work under this contract at any reasonable time.
7.9 The Contractor shall furnish the Owner and the Community Development Division with
the names, addresses, and telephone numbers of the firms to be contacted for service to
the various appliances or other equipment that was installed or repaired under this
contract. ,
7.10 The Contractor shall indemnify and save harmless the County, its agents and
employees, and the Owner from liability for any injury or dariiages to persons or property
resulting from the Contractor's prosecution of work pursuant to the provisions of this �
contract. �
7.11 The contractor shall be responsible to submit all requests for payments, change orders,
release of liens, subcontractor list, etc., on the most current forms obtained from the
Community Development Division website for contractors.
7.12 All products and materials used in the rehabilitation of Community Development Division
projects shall be made by American manufacturers, if available, and_ meet the latest
- energy and water conservation requirements.

RTICLE 8. - GENERAL RESPONSIBILITIES OF THE OWNER:
8.1 The Owner shall permit the Contractor to use, at no extra cost, existing utilities such as
light, heat, power, and water necessary for the proper execution and completion of the
work.
8.2 The Owner and occupants shall cooperate with the Contractor to facilitate the perfor-
mance of the work and are responsible for the removal or protection of rugs, furniture,
and clothing, if necessary.
8.3 The Owner and occupanYs shall be responsible for the proper use and care of the
property including all equipment and appliances. ,
8.4 The Owner shall provide the Contractor with access to the property during normal
working hours on normal working days.
,RTICLE 9. - GENERAL RESPONSIBILITIES OF THE COMMUNITY DEVELOPMENT DIVISION:
9.1 The Community Development Division shall provide general administration of the
contract, but it is understood by all parties that the County is not a party to this Contract.
, 9.2 The Community Development Division shall make frequent inspections of the work while
it is in progress to determine if it is proceeding in accordance with the contract docu-
ments.
9.3 The Community Development Division shall have the authority to reject work which does
not conform to the contract documents.
�RTICLE 10. - CONTRACT DOCUMENTS: This contract consists of the Bid Proposal,, the Work
Write-U , including any drawings or plans, the General Bid Specifications, and any insurance policies specified
in Articl 5 above.
RTICLE 11. - CHANGES IN THE WORK: Except in an emergency endangering life or property, no
change in the work shall be made by the Contractor unless he has received a prior written order signed by the
Owner nd�authorized representatives of the Community Development Division. The contract sum and the
contrac time may be changed only by Change Order. No extra costs will be paid to the Contractor when he
has ne lected to properly evaluate the extent of the construction work. Change orders need to be in line with _
bidding amounts or pricing.
ARTICLE 12. - GUARANTEES AND WARRANTIES: The Contractor shall guarantee to correct any
work th t fails to conform to the contract documents and shall correct such defects due to faulty materials,
equipm nt, or workmanship which appear during the progress of the work or within a period of one year from =
the dat of final inspection and acceptance or such longer periods of time as may be specified by law or by
terms any special guarantees required by the contract documents. The provisions of this Article apply to
work d ne by subcontractors as well as, work done by the Contractor. Furthermore, the Contractor shall
furnish'the Owner, in care of the Comrriunity Development Division, with all manufacturers' and suppliers'
written guarantees and warranties covering materials and equipment furnished under the contract. These
docum nts are to be neatly organized and bound in a file type folder and submitted with Yhe final pay request. -
If a wa ranty item malfunctions or breaks, the Contractor shall contact the Owner within 24 hours to schedule
the rep ir or replacement of the item. The warranty item should be repaired or replaced within.seven (7) days.

�,RTICLE 13. - TERMINATION OF CONTRACT BY THE OWNER: If the Contractor defaults or
neglects to carry out the work in accordance with the contract documents or fails to perform any provisions of
the contract, the Community Development Division or the Owner acting through the Community Development
- Division Imay, after seven (7) days' written notice, terminate this contract and finish the work by whatever
method he deems expedient. If the unpaid balance of the contract sum exceeds the expense of finishing the
work, such excess shall be paid to the Contractor; but if such expense exceeds such unpaid balance, the
Contractor shall pay the difference to the Owner or the Community Development Division. Failure to pay the
unpaid balance will result in disbarment from bidding on future Community Development Division projects.
IRTICLE 14. - TERMINATION OF CONTRACT BY THE CONTRACTOR: If the Owner fails to
perform �any applicable provisions of the contract, the Contractor may, upon seven (7) days' written notice to
the Ow er and the Community Development Division, terminate the contract, and recover from the Owner
paymen�for all work satisfactorily completed and all other such remedies as are otherwise specified by law.
ARTICLE 15. - GENERAL CONDITIONS:
15.1 The Work Write-Up shall take precedence over the basic specification and, when in
conflict, the material, equipment, or workmanship called for in the "Work Write-Up" will
be required. -
15.2 The Drawinqs of floor plans are diagrammatic only, illustrating the general intention of
the Owner; they do not show all the work required, exact dimensions, or construction
details.
15.3 The 2010 Bid Specifications are detailed in a separate booklet available to the Owner
and the Contractor from the Community Development Division. -
15.4 Workmanship shall be done in accordance with the standards of.the several trades
known as a "workmanlike manner."
15.5 Materials shall be new, in good condition, and of standard grade unless otherwise
agreed in writing before their delivery to the job.
15.6 Re airs shall be made by the Contractor to all surfaces damaged by the Contractor
resulting from his or his subcontractor's work under this contract at no additional cost
to the Owner. Where "repair of existing work" is called for by the contract, the feature
is' to be placed in "equal to new condition" either by patching or replacement; all
damaged, loose, or rotted parts shall be removed and replaced, and the finished work
shall match adjacent work in design and dimension.
15.7 Bids or Proqosals will be submitted at Bidder's risk and the Owner or the Community
Development Division reserves the right to reject any or all bids or proposals. All bids
or proposals are to be typed - not hand written.
� 15.8 Buildinq Codes -All work to be done shall be subject to the regulations of local building
codes as interpreted by the applicable City or County building department/division
whether or not covered by the specifications and drawings for the work.
15.9 Cleanup and removal from the site of all debris and waste materials resulting from his
work shall be the responsibility of the Contractor. Materials and equipment that have
been removed and replaced as part of the work shall belong to the Contractor and
shall be removed from the site.

15.10 Trade Names are used in the basic specification to establish quality and type of
. material required; exact material to be used on a specific property will be described in
the "Work Write-Up"for the particular property.
15.11 Adiacent Property- When adjacent property is affected or endangered� by any work�
done under this contract, it shall be the responsibility of the Contractor to take
whatever steps are necessary for the protection of the adjacent property and to notify
the Owner thereof of such hazards.
15.12 Payroll Records of employee's hours worked and. wages paid on construction jobs
shall be made available to the Community Development Division, if requested.
15.13 'The Use of Lead-Based Paint on applicable surfaces of any residential structure
undergoing Federally assisted construction or construction under any program with
federal assistance is prohibited. Any surface which contains lead-based paint shall be
considered an immediate health hazard.
15.14 The recognized amount of the contract is the Proposal page of the Bid, which is signed
by the Contractor. The prices that are detailed in the work write-up are for information
only.
, RTICLE 16. - ARBITRATION: The Contractor and Owner agree, that in cases of apparent
irreconc�lable differences arising in connection with contract performance or terms of the contract during the
progres�s of the construction, to submit the matter to the Community Development Division for binding
arbitrati �n.
, RTICLE 17. - LIEN WAIVERS: Contractor agrees to protect, defend, and indemnify the Community
Development Division and the Owner from any claims for unpaid work, labor, or materials with respect to
Contrac�or's performance. Final payment shall not be due until the Contractor has delivered to the Owner, in
care of�Community Development Division, complete release of all liens for work completed arising out of
Contrac or's performance or a receipt in full covering all labor and materials for which a lien could be filed or a
bond s �tisfactory to the Owner indemnifying him against any lien. All notice to owners must have a release of
lien for inal payment. (Form Enclosed in Contract).
ARTICLE 18. - PROHIBITION OF KICKBACKS: The Contractor nor any of its officers, partners,
owners, agents, representatives, employees, or parties in interest has in any way colluded, conspired,
connived, or agreed, directly or indirectly with any other Bidder, firm, or person to submit a collusive or shall
Bid in connection with the Contractor for which the attached Bid has been submitted or to refrain from bidding
in conn� ction with such contract, or has in any manner, directly or indirectly, sought by contract or collusion or
commu ication or conference with any other Bidder, firm, or person to fix any overhead, profit, or cost element
of the Bid price or the Bid price of any other Bidder, or to secure through any collusion, conspiracy,
conniv nce, or unlawful contract, any advantage against the Pasco County Community Development Division,
or any �erson interested in the proposed contract; and,
he price or prices quoted are fair and proper and are not tainted by any collusion, conspiracy,
conniv nce, or unlawful contract on the part of the Bidder or any of its agents, representatives, owners,
employees, or parties in interest, including this affiant.
IRTICLE 19. - INTEREST OF MEMBERS OFFICERS EMPLOYEES OF PUBLIC BODY MEMBERS
OF LO�CAL GOVERNING BODY, OR OTHER PUBLIC OFFICIALS: No member, officer, or employee of
Pasco County, or its designees or agents, no member of the governing body of the locality in which the
progra� is situated, and no other public official of such locality or localities who exercises any functions or
responsibilities with respect to the program during his tenure.or for one (1) year thereafter, shall have any

interest,•direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in
connection with the program assisted under the Contract.
�RTICLE 20. - PROHIBITION OF BONUS OR COMMISSION: The assistance provided under this
Contrac�� shall not be used in payment of any bonus or commission for the purpose of obtaining County
approva of the application for such assistance.
ARTICLE 21. - LOCAL EMPLOYMENT: To the greatest extent possible, the Contractor agrees to hire,
train, an�d subcontract to individuals and firms that live or are located in Pasco County and the Tampa Bay
Area.
,RTICLE 22. - MINORITY AND WOMEN BUSINESS ENTERPRISE: To the greatest extent possible,
the Cor�tractor agrees that he will, if it is necessary, subcontract work to minority- and women-owned
busines es.
, RTICLE 23. — SECTION 3: HUD ACT OF 1968: The Section 3 preference requirement applies to
any contract in excess of $100,000.00. The purpose of Section 3 is to ensure that employment opportunities
generat� d by HUD financial assistance, shall to the greatest extent feasible, be directed to low- and very low-
income�persons, particularly those who are recipients of government assistance for housing and to business
concerns that provide economic opportunities to low- and very low-income persons. If this contract is in
excess �f$100,000.00 the following language is applicable, and shall be included in any subcontracts:
Section 3 Clause: All section 3 contracts shall include the followirig clause (referred to as the Section 3
Clause)
� 3.1 The work to be performed under this contract is subject to the requirements of Section 3 of the
Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3
requires that, to the greatest extent feasible, opportunities for training and employment be given
lower-income residents of the project area, and contracts for work in connection with the project
be awarded to business concerns, which are located in or owned in substantial part by persons
residing in the area of the project.
3.2 The parties to this contract agree to comply with HUD's regulations in 24 Part CFR 135, and all
applicable rules and orders of the Department issued thereunder prior to the execution of this
contract. As evidenced by their execution of this contract, the parties to this contract certify that
they are under no contractual or other impediment, which would prevent them from complying
with the Part 135 regulations.
3.3 The contractor agrees to send to each labor organization or representative of workers with .
which the contractor has a collective bargaining agreement or other contract or understanding, if
any, a notice advising the labor organization or workers' representative of the contractor's
commitments under this Section 3 Clause and shall post copies of the notice in conspicuous
places at the work site where both employees and applicants for training and employment
positions can see the notice. The notice shall describe the Section 3 preference, shall set forth
minimum number and job titles subject to hire, availability of apprenticeship and training
' positions, the qualifications for each; and the name and location of the person(s) taking
applications for each of the positions; and the anticipated date the work shall begin.
23.4 The contractor agrees to include this Section 3 Clause in every subcontract for work in
connection with the project and agrees to take appropriate action, as provided in an applicable
provision of the subcontract or in this Section 3 Clause, upon a finding that the subcontractor is
in violation of regulations in 24 Part CFR 135. The contractor will not subcontract with any
subcontractor where the contractor has notice or knowledge that the subcontractor has been
found in violation of the regulations in 24 Part CFR 135.

"3.5 The contractor will certify that any vacant employment positions, including training positions,
. that are filled (1) after the contractor is selected but before the contract is executed, and (2) with
persons other than those to whom the regulations of 24 CFR Part 135 require employment
opportunities to be directed, were not filled to circumvent the contractor's obligations under 24 ,
CFR Part 135.
3.6 Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination
of this contract for default, and debarment or suspension from future HUD assisted contracts.
RTICLE 24. - USE OF DISBARRED CONTRACTORS: The Contractor agrees not to hire, employ, or
award s�bcontracts to, or otherwise engage the services of, any subcontractor during any period of debarment,
suspension, or placement in ineligibility status of 24 C.F.R., Part 24. Use of such subcontractors may require
the Con ractor to repay the County any funds paid to such persons and/or face disbarment from bidding on
future C mmunity Development Division projects.
, RTICLE 25. - HOLD HARMLESS: The Contractor and Owner covenant and agree to indemnify
Pasco �ourity and all of its officers and agents from any and all liability, claims, actions, suits, or demands by
any per on, firm, or corporation for injuries, death, or property damage arising out of or in connection with the
work to e perFormed by the Contractor.
RTICLE 26. - ADDITIONAL WORK: The Owner agrees not to have any other Contractor do any
other w rk on the property during the period of this contract. This does not include the Owner doing work on
their ow behalf.
