HomeMy WebLinkAbout733-17 Conditional Use Crews (Accessory Structure) 2017105391 RESOLUTION NO. 733-17 A RESOLUTION RELATING TO ZONING; APPROVING A CONDITIONAL USE TO AN ACCESSORY DWELLING UNIT ON PROPERTY ZONED L1 SINGLE FAMILY RESIDENTIAL; FINDING CONFORMITY WITH THE COMPREHENSIVE PLAN; PROVIDING AN EFFECTIVE DATE. WHEREAS, an application was filed by Jamie Crews for a conditional use to allow an NII' accessory dwelling unit being a residential structure to be constructed on property with the parcel ID No. 19-26-22-0000-00400-0010; and WHEREAS,the subject property zoning is L1 (Light Industrial) and an accessory dwelling unit i rmJ� zk! is permitted in conjunction with the permitted industrial use only as_a conditional use pursuant to the City's zoning ordinance, and consists of approximately 7.95 acres; and, - ' WHEREAS,the Site Plan Review Committee and the Planning Commission recommended �-m approval of the conditional use with the following condition(s). a.) The holder of the Conditional Use permit cannot object to future industrial uses on parcels surrounding the subject property; b.) The accessory dwelling unit will remain as part of the original parent parcel in conjunction with the permitted industrial use and shall not be separated; c.) The holder of the Conditional Use permit shall be authorized to utilize the site/location of the use only in the manner specified in written approval and conditions specified therein. Any substantial expansion, change, or alteration in the future will require approval from City Council; d.) Alteration or change of a Conditional Use shall be deemed to exist where a substantial modification of any of the standards provided in condition C (above) results from activity associated with the conditional use or where a substantial change R N of circumstances or conditions arise; and e.) Conditions and stipulations must be part of written approval and conform to or followed by the applicant or any successor in interest.' i v NOW THEREFORE, BE IT RESOIJVED-BY-THE-CITY-COUNCIL OFfTHE CITY OF ZEPHYRHILLS,FLORIDA: 0 Section 1. The foregoing findings and conditional use petition are incorporated herein by ~3 reference and made a part hereof. r Section 2. The conditional use/accessory dwelling unit, specifically a single family residence A located on property with the parcel ID No. 19-26-22-0000-0040-0010 is hereby approved. Section 3. The conditional use is approved for the benefit of the applicant only and for the use as specified within the application only, subject to the conditions herein. The character or benefit of this conditional use shall not be changed or transferred without City Council approval by resolution. Section 4. The City Council does hereby expressly find that the provisions of this resolution are in conformity with the Comprehensive Plan of the City of Zephyrhills, as amended.
