applimnt has notified all other uh7ity users in the ares covered by the permit and takes futl responsibility for any damage ineurred by prior installations aa a
r�ult of his opera[ions in order that they may safe gusrd their interesfs.
8. It is ezpressly stipulated that this permit is a license for permissive use only and that the placing of facilities upon public property pursuant to
this pumit shall not operate to create or to vest any property rig6t in said holder.
9. W henever the City decides to fuAher exploit the Cily Rights of Way,aoy or all said poles,wires,pip�,ca6les,or other facilities and
appurtenances autharized hereunder,shall be immediately removed froro said Rights of Way,or reset or relocated therean as required 6y the City Building
OfTicial at the espense of the holder of this permiL
10.T6e holder shall save and keep the City 6armless fram any and sll damagcs,claims,or injuries that may occur by reason of the eonstrudion,
maintenance,and operation of said Caeility.
11.The holder shall complete the requested work within days or this permit shall beeame null and void In the event the work
requested is not completed upon the espiration date of this permiG the City shall have the right to complete such work and to c6arge the halder of the permit
for all costs incurred in completing said work
12.The holder shall post a cash or surety bond with the City Manager in t6e sum of$ dollars to guarantee performance of the
obligations herein,and to guaraotee maintenance of the right-of-way described herein for a period oPone(1)yeer following completion of the requested
installation.In the event a surety bood is posted,the surety bond s6a11 be made payable to the City and s6a11 obligate the surety to 6old the City harmless iv
the eveut the holder of this permit should fail to meet any of its obligations hereunder.The 6ond s6a11 also indemnify the�ty for aIl court cosfs and
reasonable attorneys fecs in the evea[legal action is required to collect oo said bond.
