A RESOLUTION RELATING TO ZONING; APPROVING A
CONDITIONAL USE FOR AN ACCESSORY STRUCTURE ON
PROPERTY ZONED ER ESTATE RESIDENTIAL; FINDING m=
CONFORMITY WITH THE COMPREHENSIVE PLAN; PROVIDING AN �=
EFFECTIVE DATE. (0_

WHEREAS, an application filed by Michael Denmark for a conditional use to allow an �—
accessory structure being a garage measuring 25' x 35' to be constructed on property with the
parcel ID No. 03-26-21-0010-04400-0010; and
WHEREAS,the subject property zoning is ER(Estate Residential) and an accessory structure of
the size requested is permitted only as a conditional use pursuant to the City's zoning ordinance,
and consists of approximately 1.22 acres; and
WHEREAS,the Site Plan Review Committee and the Planning Commission recommended
approval of the conditional use with the following condition(s).

a.) The accessory structure (garage) shall be of residential grade construction and match
the existing residential structure on the property; K)m
b.) The accessory structure (garage) shall be utilized for residential storage purposes only
and shall not be utilized for any commercial or industrial uses; X
c.) The accessory structure shall meet all setbacks as required by the zoning district;
d.) The holder of the conditional use permit shall be authorized to utilize the site or location
of the uses only in the manner specified therein. Any substantial expansion, alteration
or change in the conditional use authorized by the written approval must be reviewed V
by City Council in the same manner in which the original conditional use was reviewed; '� m
e.) Alteration or change of a conditional use shall be deemed to exist where a substantial
modification of any of the standards provided in general condition d) (above) results
from activity associated with the conditional use or where any substantial change of
circumstances or conditions arises; and
f.) The subject conditions and stipulations shall become part of the written approval and
must be conformed to or followed by the applicant or any successor in interest. o

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE N o
CITY OF ZEPHYRHILLS,FLORIDA:
Section 1. The foregoing findings and conditional use petition are incorporated herein by
reference and made a part hereof. (Di

Section 2. The conditional use/accessory structure, specifically a Garage measuring 25' x 35'

located on property with the parcel ID No. 03-26-21-0010-04400-0010 is hereby approved. ,..ao
Section 3. The conditional use is approved for the benefit of the applicant only and for the use as
specified within the application only, subject to the conditions herein. The character or benefit o
of this conditional use shall not be changed or transferred without City Council approval by M
resolution.
Section 4. The City Council does hereby expressly find that the provisions of this resolution are
in conformity with the Comprehensive Plan of the City of Zephyrhills, as amended.
