AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ZEPHYRHILLS, FLORIDA, A
MUNICIPAL CORPORATION, AMENDING
CHAPTER 6 OF THE LAND DEVELOPMENT
CODE OF THE CITY OF ZEPHYRHILLS,
FLORIDA SECTION 6401 ACCESSORY
BUILDINGS AND STRUCTURES BY AMENDING
SUBSECTION (A) ZONING OF ACCESSORY

SUBSECTION (T) ACCESSORY BUILDING AND
STRUCTURES IN OFFICE PROFESSIONAL AND
RESIDENTIAL ZONING DISTRICTS; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Zephyrhilis, Florida, sitting
in regular meeting that:
Section 1: That Chapter 6, Land Use Regulations, Section 6401. Accessory
Buildings and Structures (A). Zoning of Accessory Structures of the Zephyrhills Land
Development Code is hereby deleted and shall henceforth read as follows:

(A) Zoning of Accessory Structures.

A. Zoning of Accessory Structures. All accessory uses to a principal use shall
be located in a zoning district that permits the principal use. Structures up to 625 square
feet and no more than 16 feet in height, at the maximum point of roof pitch, from the grade,
shall be allowed or permitted uses in residential and office professional districts. Structures
more than 625 or in excess of 16 feet to the peak of the roof, as measured from the grade,
shall be listed as conditional uses in residential and office professional districts. Conditional
use requests shall include requirements and/or data pertaining to height, increased setbacks
and landscaping plans around the perimeter of the building.
Section 2: That Chapter 6, Land Use Regulations, Section 6401. Accessory
Buildings and Structures (J). Accessory Buildings and Structures in Office Professional
and Residential Zoning Districts of the Zephyrhills Land Development Code is hereby
created and incorporated and shall henceforth read as follows:

J. Accessory Buildings and Structures in Office Professional and Residential
Zoning Districts. Accessory buildings and structures located in Office Professional and
Residential Zoning Districts that exceed one hundred and fifty (150) square feet, shall be
constructed of masonry, wood frame, aluminum or vinyl. Aluminum or vinyl shall be
residential grade materials. Construction shall be consistent with the existing architecture
of the principal building and the adjacent properties. Metal fabricated type structures that
are designed and intended for industrial/commercial use are prohibited.

Section 3: The provisions of this Ordinance are severable, and if any section,
sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or
ineffective, this holding shall not affect the validity of the remaining portions of the
Ordinance, it being expressly declared to be the City Council's intent that it would have
passed the valid portions of this Ordinance without the inclusion of any invalid portion or
portions.
ection 4: This Ordinance shall become effective immediately upon its passage.
