SPC,suppliecs,and insurance carriers shall not be responsible for the any loss or use of any facility or any intecior or exterior damages of any kind resulting fi•om lealcs,should they occur. SPC and its insurance carciers are not responsible for any walls,siding or i window leaks,those are to be repaired by others, nor is the contractor responsible for the disconnecting,reconnecting,reworking of replacing of any satellite dishes,cables, lightning protection,electrical lines, lightning, plumbing, etc. This worl<needs to be done by others and paid by the owner. SPC, insurance carriers are not responsible for Freon lines,electrical conduit/lines, plumbing or any other lines that are installed too close to the roof sheathing and or not instafled properly to building code. SPC shall not be held liable or responsible for any injuries to anyone other than its employees on the job site nor can SPC be held respons�ble for any damages or injuries by anyone falling through the roof , due to rotten or damaged roof decicing. I5. ROOF DRAINAGE. A roof drainage is determined by the design and original construction of the building, SPC does not guarantee that water will not remain on a flat roof. Any damage due to ponding water is not the responsibility of SPC or its insurance carriers. It is the responsibility of the Customer to notify SPC of any known roof drainage problems on the low slope or flat roof areas. If after the Contractor removes the roof inembrane,the roof deck is found to not have the repaired slope for positive drainage, a tapered insulation system wifl be ' installed to the roof deck to help enhance proper drainage. This will be billed at an additional charge and Customer agrees to pay SPC his normal free charged to rectify the problem. It is agreed by Customer that this work will be done immediately in order to watertight the roof as quickly as possible due to the roof being a low slope or flat roof. If the substrate roof condition results in ponding pursuant to the Florida Building Code and modifications are required to correct the roof so ponding will not occur. � 16. ROOF DECKING. If we discover that roof decl<ing is not properly nailed to code,we will bring it up to current building code. Replacement of roof decicing will be made not to exceed four sheets of plywood.Over four will be charged to the customer. 17. WARRANTY WORK. SPC is responsible under warranty to repair or replace at the company's discretion the roofing membranes and associated flashings which are causing the leak. SPC is not responsible for any damage from normal loss of granules from the roof. Work done or attempted to be done,on this roof by someone other than SPC or authorized agents relieves the warrantor from any further obligation. All damages to embodied work in our contract caused by others will be repaired by us and charged to you at scheduled rates. Failure to keep gutters,down and roof clean may void the warranty. SPC will provide a five year labor against leaks or workmanship and on steep, slope shingle,tile and metal roof.One year warranty due to workmanship on flat roof Roof repairs have six months warranty. 18. LECAL FEE AND COLLECTLON. Customer agrees to pay all collection fees and charges whether or not a suit is necessary including but not limited to all legal and attorney's fees as well as filing fees and interest of any miscellaneous costs incurred to collect the debt should the homeowner default in payment of any agreed upon installment payments due hereunder the entire principal balance shall at the option of SPC make it become immediately due and payable without notice.A finance charge of 18% APR or the highest rate permissible by law will be added to the balances over 10 days past due after completed worl<or passed inspection. 19. FLORIDA STATUT�725.06. For and in consideration of$10 given by SPC to Customer and already reflected in the Agreement price, the Customer shall defend, indemnify,and hold SPC, its officers,directors, agents and employees(indemnitee/indemnitees)harmless from and against and al] claims,demands, losses,damages liabilities, expenses,costs, including attorney's fees,costs and expenses of investigation, penalties, interest and amounts paid m settlement incurred or to be incurred by SPC arising out of relating to, or resulting from 1.personal in�uiy 2. wrongful death,3. property damages, including claims for those damages caused partly or wholly as a result of the negligence or wrongful acts of any of the indemnitees if the damages claimed relate to or arise out of, or are connected with the Agreement or the actions necessary to perform same. The Customer's duty under this provision is limited to a total of ONE MILLION AND NO/000($1,000,000) dollars for all damages, including costs and attorney's fees per occurrence for any single claim or suit.This Agreement shall be governed by the laws of the State of Florida. Venue of any litigation or arbitration arising out of this Agreement shall be in Hillsborough County unless parties hereto mutually agree otherwise. All material is guaranteed as specified. All work shall be completed in a worlcmanlike manner according to standard practices and all local building codes. The following additional provisions are expressly incorporated into this contract. 1. LICENSES,PERMITS,SAFET'Y RULES, BUILDING CODES,ZONING,COMPANY INSURANCE AND OTHER LAWS. SPC shall be liable to customer for obtaining building permits and inspections. We recommend that gutters may be removed and re-installed by the gutter company although we cannot guarantee against incide►ital damages. SPC �s not qualified or ficensed as an inspector or abatement contractor for hazardous materials of for pests(including but not limited to termites). Should any hazardous substances or pests be suspected to be present on the premises, it is the Customer's responsibility to arrange and pay for inspection and treatment. SPC cannot certify or warrant your • building,free ofhazardous materials or pests. SPC and insurance carrier shall not be held liable for any damage due to termites,wood boars,o� any wood destroying organisms after the work has been completed. SPC disclaims all liability for all claims,disputes,rights, losses,damages, causes of action or controversies(claims)pertaining to Mold or mildew including claims arising out or relation to detection, cemoval, disposal or remediation of Mold or Mildew,whether those claims arise in law, equity,contract,warranty,tort or federal or state statutory claims,and whether those claims are based on the acts or omissions of SPC or individuals or entities under Contractor's control. The Customer is solely I�able and responsible for all damages actual or consequential caused by mold or mildew. 9. ADDYTIONAL WORK. This proposal does not cover the furnishing or erection of any wood work, painting,cutting, patching,electrical or etc that might be required for the erection of the work covered in this contract unless specifically mentioned above. Additional layers or roofing under the original roof will be$25.00 per square per layer and is not part of the original contract. SPC has the discretion to take the necessary precaution to the flashing or skylight replacement to ensure a complete watertight roof system. The customer agrees to pay the SPC for his nonnal fees foc skylight replacement. The agreement price shall be equitably adjusted upon notice thereof from the SPC to the Customer. MATERIALS. CONTRACTOR LIABILITY. SPC or its insurance carriers shall not be responsible for conditions which depart from conventional building designs, �ncludin�but not limited to damaged decking, insulation, trusses, walls, siding foundations,driveways, sidewallcs, ceilings, slcylights,plumbing,electrical,air conditioning or lines, drains and othec roof mounted equipment. SPC and its insurance carriers shall not be held responsible for any damages that may occur during construction pro�ect: damaged,cracl<ed, or broken driveway or sidewalks, lawns, gardens,damage to plants,floral or scrubs,garage doors,foundations, othec structures, buildings or portions thereof,sprinkler systems,wells, or any damage to septic tanks or drain fields. The Customer shall provide access for heavy equ�pment. Magnets will be used around the property, during the roofing project and after the completion of the roof, but due to the nature of the industry,some fasteners/nails may remain trapped in the grass or bttshes. SPC,suppliers and insurance carriers shall not be responsible for the damage to the interior of buildings due to normal vibration associated with the roofing process.
