A RESOLUTION RELATING TO ZONING; APPROVING A
CONDITIONAL USE TO ALLOW A DAYCARE CENTER ON PROPERTY
ZONED C2, COMMUNITY COMMERCIAL; FINDING CONFORMITY
WITH THE COMPREHENSIVE PLAN; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, an application was filed by Belkys Barrios for a conditional use to allow a daycare
center ol? 'fo "city with"the parcel ID No."34-25-21-0150-00000-0010, and
WHEREAS,the subject property zoning is C2 (Community Commercial) and a daycare center
is classified as a conditional use pursuant to the City's zoning ordinance, and consists of
approximately 4.35 acres; and
WHEREAS,the Site Plan Review Committee and Planning Commission recommended
approval of the conditional use with the following conditions:
1. The holder of a conditional use permit shall meet all requirements of the State
Department of Children and Family for daycare centers and all additional requirements
imposed by the City of Zephyrhills.
2. A crossing-guard shall be present on site at all pick-up and drop-off to ensure safe
crossing of the frontage road.
3. Alterations to the interior and exterior of the building and site specific to the daycare
center shall be depicted on a set of drawings to be submitted to and reviewed by the
City.
4a.) The holder of a conditional use permit shall be authorized to utilize the site or location
of the use only in the manner specified in the written approval and conditions specified
therein. Any substantial expansion, alteration or change in the conditional use
authorized by the written approval must be reviewed by the City Council in the same
manner in which the original conditional use was reviewed;
4b). An expansion, alteration or change of a conditional use shall be deemed to exist where
a substantial modification results from activity associated with the conditional use or
where a substantial change or circumstances or conditions arises;
4c). The conditions and stipulations shall become part of the written approval and must be
conformed to and followed by the applicant or any successor in interest;
4d). The conditional use approval shall run with the lessee of subject property and;
4e). The applicant shall obtain any and all necessary licenses/permits from the State of
Florida and the building department as well as a commercial business check from the
building department.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS, FLORIDA:
Section 1. The foregoing findings are incorporated herein by reference and made a part hereof.
Section 2. A daycare center on property more particularly described as located on property with
the parcel ID No. 34-25-21-0150-00000-0010 is hereby approved.
Section 3. The conditional use is approved for the benefit of the applicant only and for the use as
specified within the application only, subject to the conditions herein. The character or benefit
of this conditional use shall not be changed or transferred without City Council approval by
resolution.

Section 4. The City Council does hereby expressly find that the provisions of this resolution are
in conformity with the Comprehensive Plan of the City of Zephyrhills, as amended.
The foregoing Resolution No. 749-17 was read and passed, following a public hearing, in an open
and rulMi+Plimt4ng of the City Council of the City of Zephyrhills, Florida, on this 11t day of
