AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS, FLORIDA, PROVIDING
FOR REGULATIONS OF PARKING OF SEMI
TRACTORS, TRUCKS, TRAILERS, COMMERCIAL
VEHICLES AND RECREATIONAL VEHICLES IN
RESIDENTIAL NEIGHBORHOODS. JED PITTMAN, PASCO COUNTY CLERK

WHEREAS,the City Council of the City of Zephyrhills has determined that it is in the best
interest of the citizens of the City of Zephyrhills to provide for regulations of parking of trucks,
trailers, commercial vehicles and recreational vehicles in residential neighborhoods.
NOW THEREFORE, be it ordained by the City Council of the City of Zephyrhills,
Florida, sitting in regular session, as follows:
SECTION 71-20. Application of Article: This article shall apply to all vehicles both
motorized and non-motorized.
SECTION 71-21. Purpose: It is the purpose of this subchapter to prohibit the parking of
the semi tractor, large trucks and trailers in residential areas, limit the number of commercial
vehicles and regulate the size and location of recreational vehicles parked within residential areas.
Parking of such vehicles is deemed to be aesthetically unattractive, a generator of unreasonable
emissions,and noise and is hereby declared to be a public nuisance.
SECTION 71-22. Definitions: For purposes of this subchapter,the following definitions
shall apply unless the context clearly indicates or requires a different meaning. aw
Commercial Vehicles means any truck,van or other vehicle used primarily for commercial
purposes or displaying lettering,characters or pictures for benefit of,or advertising of, any business
or commercial concern. ,
Dwelling Unit meians any single family home, condominium, duplex, apartment or town
house or any other unit as an individual or single family dwelling.
Large Trucks means any cargo or panel vehicle, truck or van with a manufacturer's rated
load capacity in excess of one and one half(1 1/2)tons.
Recreational Vehicles means any unit primarily designed for temporary living quarters for
recreational camping, or travel use,whether either it has its own motive power or is mounted on or
drawn by another vehicle. Recreational vehicles shall include travel trailers, camping trailers,truck
campers,motor homes, private motor coaches and fifth-wheel trailers as defined in Section 71-26.
Residential Area means any residentially zoned area within the city,withinwhich residential
r-- use is a permitted or conditional use.
Semi Tractor means any motor vehicle designed and used primarily for drawing other
vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and
load so drawn.
Trailer means any vehicle with or without motive power designed for carrying persons or
property and for being drawn by a motor vehicle. Trailer shall not include recreational vehicles.•Record and Return to:

Tow Truck or Wrecker means any self-powered vehicle manufactured with the capacity to
be utilized or which is actually utilized for the purpose of towing or transporting automobiles,trucks
or buses.
SECTION 71-23. Parking of Semi Tractor, Trailers or Trucks: It shall be unlawful to
park or stand any semi tractor in any area,including the public streets and right-of-ways and private
property, within a residential area with the city. It shall be unlawful to park or stand any trailer or
truck which has a manufacturer's rated loaded capacity in excess of one and one half(1 1/2) tons at
any time in any area,including the public streets and right-of-ways and private property within any
residential area within the city.
The parking of such semi tractors,trailers or such in residential areas is hereby declared to
be a public nuisance.
This prohibition is not to apply to any truck or semi truck that is temporarily loading or
unloading.
SECTION 71-24. Parking of Commercial Vehicles in Residential Areas;Exceptions: No
person shall park, or cause Ito be parked, or allowed to have-parked, whether on private property or
upon the public right-of-way, in any residentially zoned area of the city, more than one (1)
commercial vehicle for each residential dwelling owned or occupied by said person. Said
commercial vehicles may not have manufacturer's rated load capacity more than one and one-half
(1 1/2)tons in weight. No person shall park a commercial vehicle in any residentially zoned area
of the city unless said person owns or occupies the residential dwelling at which said vehicle is

There will be excepted from above the following:
i. Any emergency vehicle, vehicle necessary for service by any public utility, or
commercial vehicles necessary for service to any dwelling, during the time said service is
actually being performed.
ii. Any commercial vehicle of any size which is parked in a.closed garage.
SECTION 71-25. Parking of towtrucks and wreckers in residential areas: It shall be
unlawful for any person, his employee or agent to park, stop or have standing any towtruck or
wrecker in any residentially zoned area of the city.
It shall be unlawful for any owner or tenant to have parked, stopped or have standing on his
residential property any towtruck or wrecker.
Any towtruck or wrecker actually performing towing or wrecking services to any motor
vehicle shall be exempt from the above during the time said services are being performed;pro vided,
that said services are pursued in a reasonable and diligent manner.
This section shall supersede Section 71-23 in regards to all towtrucks and wreckers.
SECTION 71-26.Parking of Recreational Vehicles: Any recreational vehicle parked in a
residential area,must either be part in a closed garage or placed in the rear yard and comply with rear
line and side line set backs for the residential zoning district where it is parked. Rear yard shall be
defined as that portion of the lot located behind that point of the structure furthest from the front

property line. Any recreational vehicle parked within a residential area, within the city limits, shall
have a current registration with the Department of Motor Vehicles and display current license plates.
SECTION 71-27. Commercial Parking Lots in Residential Zones: Nothing contained in
this subchapter shall be deemed or construed to allow the use of property situated in a residential
area for any commercial parking lot. It shall be unlawful for any person to use property in a
residential area for parking lot purposes,except in conjunction with or as an accessory use to the use
of such property for residential or other permitted uses.
SECTION 71-28. Violations and Fine Schedule: Any violation of this ordinance shall
constitute a class 5 violation,pursuant to the City of Zephyr Bilis Uniform Fine Sch Jule. •
SECTION 71-29. Severability: In the event any section,paragraph, subsection, sentence,
clause, phrase, or word of this ordinance shall for any reason be held unconstitutional, invalid or
ineffective, the same shall not repeal, nullify or in any way affect any other section, paragraph,
subsection,sentence, clause for portion of this ordinance irrespective of any other section,paragraph,
subsection, sentence, clause' or portion thereof. •
SECTION 71-30. Effective Date: The Ordinance shall become effective and enforced on
the /0ay of t.t/1..a A.D., 1997,upon second reading and signing by the Mayor.
