AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA AMENDING ORDINANCE NO. 732 —_
ESTABLISHING STANDARDS RELATING TO THE
MANAGEMENT OF STORM SEWER SYSTEM
DISCHARGES AND ENHANCING THE QUALITY OF
SURFACE AND GROUND WATER RESOURCES; —_
REVISING THE DEFINITION OF CONSTRUCTION _=
ACTIVITIES; REVISING EXEMPTIONS TO INCLUDE
DISCHARGES FROM VARIOUS PUMPSAND DRAINS;
PROVIDING FOR REPEALER, SEVERABILITY, AND AN

WHEREAS, Ordinance No. 732 was adopted on September 27, 1999, by the City j
Council to implement the City's stormwater management program; and 73

WHEREAS, the United States Environmental Protection Agency(EPA)has recently amended its
regulations developed under the National Pollutant Discharge Elimination System (NPDES) m
permit program; and m
WHEREAS, it is necessary for the City to amend its stormwater ordinance to incorporate the -
new federal changes to the regulations.
NOW, THEREFORE, BE IT ORDAINED by the City of Zephyrhills,Florida, as follows:
SECTION 1. Definitions.

Section 2-1 of Ordinance No. 732 is hereby amended to revise the definition of"Construction

Activities" as follows: 01
G. CONSTRUCTION ACTIVITIES – Includes such activities as clearing, grading, and (Dvi")
excavation activities on all construction sites regardless of size. 2 0

Section 6-1(A) of Ordinance No. 732 is hereby amended as follows: NN0

The following activities shall be exempt from the requirements of this Ordinance:
A. Discharges from:
• Water line flushing;
• Landscape irrigation;
• Uncontaminated ground water infiltration (as defined at 40 CFR 35.2005(20)) to
separated storm sewers;
• Uncontaminated pumped ground water;
• Discharges from potable water sources;
• Air conditioning condensate;
• Irrigation water;
• Springs;
• Lawn watering;
• Individual residential car washing;
• Flows from riparian habitats and wetlands;
• Street wash waters;
• Discharges or flows from emergency fire fighting activities;
• Foundation drains;

• Water from crawl space pumps;
• Footing drains; and
• Dechlorinated swimming pool drains.
SECTION 3. Severability. -
It is declared to be the intent of the City of Zephyrhills, Pasco County, Florida, that if any
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
sentence, clause or provision, and shall not be affected by such holding.
SECTION 4. Inclusion in Code.

It is the intent of the City of Zephyrhills that the provisions of this Ordinance shall become and p3
be made a part of the City of Zephyrhills Code, and that the sections of this Ordinance may be co
renumbered or relettered and the word "ordinance" may be changed to "section", "article",
"regulation", or such other appropriate word or phrase in order to accomplish such intentions. N 110
