Sign Standards 3 Is ORDINANCE NO.: 812-02 AN ORDINANCE OF THE CITY COUNCIL OF !3=== THE CITY OF ZEPHYRHILLS, FLORIDA, A MUNICIPAL CORPORATION, AMENDING CHAPTER 11 (SIGN STANDARDS)—SECTION 11010 (DEFINITIONS ) — SECTION 11110 (APPLICABILITY)—SECTION 11200 (EXEMPT M= SIGNS)—SECTION 11300 (PROHIBITED SIGNS)— SECTION 11432 (SIGNS IN NONRESIDENTIAL AREAS)—SECTION. 11700 (BOARD, OF ADJUSTMENT APPROVAL) OF THE LAND DEVELOPMENT CODE OF THE CITY OF I 0o ZEPHYRHILLS, FLORIDA; AND PROVIDING mc5'•- FOR AN EFFECTIVE DATE. N 6 BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, sitting in regular meeting that: :4 Section 1: That Chapter Eleven, (Sign Standards)-Section 11010 (Definitions) of n& -0 ,s • the Zephyrhills Land Development Code is hereby amended to provide for additional definitions, and said additional definitions shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11010-Definitions Sign, electronic variable message any electric sign which displays alternating 0 s�T{ messages, either for commercial advertising, traffic control, or information. An electronic ' variable message display does not flash or animate static information. The only movement a is the changing of information against the solid colorless background. Electronic variable k ^' ? message signs are permitted in C-2, C-3, and LI zoning districts. Ie Sign,freestanding shall mean a sign that is secured to the ground, and which is not j ') affixed to a building. Freestanding signs include monument and pylon signs. -10 ; In Sign monument shall mean a freestanding sign where the entire sign bottom is permanently attached to a foundation or footing and supported by the ground. Sign,pylon shall mean a freestanding sign that is supported by a structure extending from and permanently attached to the ground by a foundation or footing, with a minimum 8 foot clearance between the ground and the bottom of any sign area. Section 2: That Chapter Eleven, (Sign Standards)-Section 11110 (Applicability) of the Zephyrhills Land Development Code is hereby amended to provide for additional language and said additional language shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11110-Applicability I. Any conflict between this code and the Historical Preservation Ordinance, the more restrictive, shall apply. Section 3: That Chapter Eleven, (Sign Standards)-Section 11200 (Exempt Signs) of the Zephyrhills Land Development Code is hereby amended to provide for additional language and said additional language shall henceforth read as follows: Record and Return to: City Clerk's Office 5335 8th Street Zephyrhills, FL 33540 CHAPTER ELEVEN-Sign Standards- SECTION 11200-Exempt Signs 13.' Downtown Portable Signs, also commonly referred to as A-frame signs, and measuring`no more than`2 feet by 3 feet, may be permitted in the stipulated downtown district provided that no sign is placed on city or state right-of-way or sidewalk in a location I ,, that would impede traffic, pedestrians, wheelchairs or those otherwise physically impaired; to Go that the signs meet the standard for size and appearance; that all signage be removed from the sidewalk at the close of business; and that all sign requests be approved by the Main Street Zephyrhills Design Committee for review and approval prior to placement.' Section 4: That Chapter Eleven, (Sign Standards)-Section 11300 (3.)Prohibited Signs) of the Zephyrhills Land Development Code is hereby deleted and shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11300(3)-Prohibited Signs 3. Signs with visible moving, revolving, or rotating parts or visible mechanical movement of any description or other apparent visible movement achieved by electrical, electronic, or mechanical means, except for electronic variable message signs and traditional barber poles. Section 5: That Chapter Eleven, (Sign Standards)-Section 11300 (12)Prohibited Signs),of the Zephyrhills Land Development Code_is hereby deleted and shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11300(12)-Prohibited Signs 12. Signs with lights that flash, blink or flicker. Electronic variable message signs shall not be considered flashing signs. Section 6: That Chapter Eleven. (Sign Standards)-Section 11300 (18) Prohibited Signs) of the Zephyrhills Land Development Code is hereby amended to incorporate (18) and shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11300(18)-Prohibited Signs 18. A-frame signs. . Exception:. Downtown A-frames as approved by the Main Street Zephyrhills design committee and sanctioned on a case-by-case basis in the downtown district. Section 7: That Chapter Eleven, (Sign Standards)-Section 11432 (3) (Signs in Nonresidential Areas) of the Zephyrhills Land Development Code is hereby deleted and shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11432(3)-Signs in Nonresidential Areas- 3. The maximum area per sign face for freestanding signs shall be one square foot of sign area for each lineal foot or street frontage. A:maximum of twenty percent (20%) of the total sign area of a permitted freestanding sign can be electronic variable „, 7c message. This calculation takes into consideration total sign structure area and any free space between main sign face and electronic variable message center. In the case of a pylon ' rst' sign the support structure will not be included as part of the sign area. Section 8: That Chapter Eleven, (Sign Standards)-Section 11432 (8) (Signs in Nonresidential Areas)of the Zephyrhills Land Development Code is hereby deleted and shall henceforth,read as follows -Cr) CHAPTER ELEVEN-Sign Standards- SECTION 11432(8)-Signs in Nonresidential Areas- 8. Freestanding signs shall maintain a minimum ground clearance of eight feet measured from the crown of the road unless there is a minimum setback of 20 feet from the property line. Freestanding signs with eight feet minimum ground clearance may have a minimum setback from the property line of 5 feet to the leading edge of the sign. Section 9: That Chapter Eleven, (Sign Standards)-Section 11700 (City Council Approval)of the Zephyrhills Land Development Code is hereby deleted and shall henceforth read as follows: CHAPTER ELEVEN-Sign Standards- SECTION 11700-Board of Adjustment Approval- 1. Any sign types, styles or signs with technological capabilities not specifically mentioned or addressed within this Ordinance, shall require approval from the Board of Adjustment. 2. The Board of Adjustment will address all variance requests. Section 10: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions. Section 11: This Ordinance shall become effective immediately upon its passage.
