MAN PASCO COLN!Y '2:1_E K l':10V02 02 0 :55pm 1 t1 OR b�; 51 1 PG WHEREAS, COOL STREAM HOLDING TRUST, is the-present owner of the lands hereinafter described in Section 1, and WHEREAS, the properties described in Section 1 below created an enclave within the incorporated boundaries of the City of Zephyrhills, WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said enclaved properties into the City limits of the City of Zephyrhills, WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills on the 8th day of July, A.D., 2002, and the Board of County Commissioners of Pasco County on the 15th day of October, A.D., 2002. WHEREAS, COOL STREAM HOLDING TRUST was notified of the public hearing for annexation by regular mail and registered mail, return receipt of the lands described in Section 1, and WHEREAS, the Board of County Commissioners of Pasco County and the City Council of the City of Zephyrhills approves the annexation of said lands and the inclusion of said lands within the corporate limits of said City, • . WHEREAS, the Planning Commission has recommended approval of.the=annexation NOW, THEREFORE,BE ITENACTEDAND ORDAINED bythe City Council ofthe City of Zephyrhills, Florida, as follows: - ' f- , SECTION 1: That the following described enclaved lands, lying and being situate inPasco County, Florida, to-wit: ,'-•-' ' 03-26-21-0010-08100-0000 All that part of Tract 81 lying East of the right of way of U.S.Highway#301, in Section 3, Township 26 South, Range 21 East, ZEPHYRHILLS COLONY COMPANY LANDS;.accordingto map or plat thereof recorded in Plat Book 1, page 55, Public Records of Pasco County, Florida.' . Together with that portion of the alley showing on said plat lying East of same;:said alley having been closed and vacated by Resolution of the Board of County Commissioners,ofPasco•Co`un`ty,Florida, dated April 27, 1971 and recorded in Official Record Book 541,Page 11,8,Public Records--ofPasco County, Florida. be, and the same are hereby annexed to and included within the boundaries-of the City of Zephyrhills, Florida, a municipal corporation. That said lands are now unincorporated and lie in the same county as said City, and when annexed would form a compact addition to the incorporated territory of said City. That the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said properties into the City limits of the City of Zephyrhills, so as to rectify the enclave. SECTION3: That the City of Zephyrhills,Florida,has been given authority by the legislature of the state of Florida, pursuant to Florida Statute 171.046(2)(a) and pursuant to the Charter of the City of Zephyrhills, to annex contiguous areas, which have created an enclave in said City and to extend the city limits or territorial boundaries upon the entry of an interlocal agreement with Pasco County, Florida, together with the approval of the City Council of the City of Zephyrhills, of said annexation duly expressed by Ordinance. SECTION 4: That it is the intention of the City Council of the City of Zephyrhills, Florida, to annex the above-described lands, which had previously created an enclave to said City within its territorial limits and the boundary lines of said City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5: That this Ordinance shall be published in a newspaper of general circulation for two (2) consecutive weeks and that proof of publication of this Ordinance shall be filed herein. SECTION 6: That upon the filing of the Proof of Publication and final adoption of this Ordinance, a copy of same shall be filed with the Clerk of the Circuit Court of Pasco County,Florida, and a copy will be forwarded to the Department of State, Tallahassee, Florida.
