JI D SIITo t i '- t UN1 CL RK 12/02IZ. �i�:5.,� 'LK 515i PG 22g WHEREAS,DAVID H.PAYSON and SUZANNE M.SANVILLE,are the present owners of the lands hereinafter described in Section 1, and WHEREAS, the properties described in Section 1 below created an enclave within the incorporated boundaries of the City of Zephyrhills, WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said enclaved properties into the City limits of the City of Zephyrhills, WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills on the 8th day of July,A.D.,2002, and the Board of County Commissioners of Pasco County on the 15th day of October, A.D., 2002. WHEREAS, DAVID H. PAYSON and SUZANNE M. SANVILLE were notified of the public hearing for annexation by regular mail and registered mail,return receipt of the lands described in Section 1, and WHEREAS, the Board of County Commissioners of Pasco County and the City Council of the City of Zephyrhills approves the annexation of said lands and the inclusion of said lands within the corporate limits of said City, WHEREAS, the Planning Commission has recommended approval of the annexation: NOW, THEREFORE,BE IT ENACTED AND ORDAINED by the City Council'ofthe City of Zephyrhills, Florida, as follows: SECTION 1: That the following described enclaved lands, lying and being situate in Pasco County, Florida, to-wit: 10-26-21-0010-06400-0050 The North 55 feet of the North 120 feet of the West 175 feet of the South 2/5ths of Tract 64, in Section 10, Township 26 South, Range 21 East, as per plat thereof of ZEPHYRHILLS COLONY COMPANY LANDS, recorded in Plat Book 1, page 55, Public Records of Pasco County, Florida. TOGETHER with an easement over the East 14 feet of the South 215 feet of the West 175 feet of said Tract 64. and The South 105 feet of the North 160 feet of the West 175 feet of the South 2/5ths of Tract 64, in Section 10, Township 26 South, Range 21 East, as per plat thereof of ZEPHYRHILLS'tOLONY COMPANY LANDS, recorded in Plat Book 1, page 55, Public Records of Pasco County, Florida. LESS the South 6.00 feet of the West 161 feet thereof; SUBJECT to an Easement over'the East 14 feet thereof;TOGETHER with an easement over the East 14,the South 145'feet of the West 175 feet of the South 2/5ths of Tract 64, in Section 10, Township 26 South,Range 21 East,ZEPI_IYRHILLS COLONY COMPANY LANDS, as per map or plat thereof recorded in Plat Book 1,page 55,Public Record and Return to: City Clerk's Office - „g 5335 8th Street ; E, Zephyrhills, FL 33540 y� OR al 5153 pi, 249 Records of Pasco County, Florida. 2 f 10-26-21-0010-06400-0060 The South 6.00 feet of the North 160.00 feet of the West 161.00 feet of the South 2/5ths of Tract 64, in Section 10, Township 26 South, Range 21 East, as per map or plat of the ZEPHYRIIILLS COLONY COMPANY LANDS, as the same is recorded in Plat Book 1, page,55, Public Records of Pasco County, Florida. be, and the same are hereby annexed to and included within the boundaries.Of the,City of Zephyrhills, Florida, a municipal corporation. SECTION 2: Said lands are contiguous to the present city limits of the City of Zephyrhills. That said lands are now unincorporated and lie in the same county as said City, and when annexed would form a compact addition to the incorporated territory of said City. That the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said properties into the City limits of the City of Zephyrhills, so as to rectify the enclave. SECTION3: That the City of Zephyrhills,Florida,has been given authority by the legislature of the state of Florida, pursuant to Florida Statute 171.046(2)(a) and pursuant to the Charter of the City of Zephyrhills, to annex contiguous areas, which have created an enclave in said City and to extend the city limits or territorial boundaries upon the entry of an interlocal agreement with Pasco County, Florida, together with the approval of the City Council of the City of Zephyrhills, of said annexation duly expressed by Ordinance. SECTION 4: That it is the intention of the City Council of the City of Zephyrhills,Florida, to annex the above-described lands, which had previously created an enclave to said City within its territorial limits and the boundary lines of said City are hereby redefined andextended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5: That this Ordinance shall be published in a newspaper of general circulation for two (2) consecutive weeks and that proof of publication of this Ordinance shall be filed herein. SECTION 6: That upon the filing of the Proof of Publication and final adoption of this Ordinance, a copy of same shall be filed with the Clerk of the Circuit Court of Pasco County,Florida, and a copy will be forwarded to the Department of State, Tallahassee, Florida. SECTION 7: This Ordinance shall become law upon being passed by the City Council of the City of Zephyrhills after two (2)readings and execution by the presiding officer and the clerk of that body in accordance with Florida Statute 171.046(2)(a).
