PRESSLEY and ANNETTE PRESSLEY, his wife, are the present owners of the lands hereinafter described in Section 1, and WHEREAS, the properties described in Section 1 below created an enclave within the incorporated boundaries of the City of Zephyrhills, • WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said enclaved properties into the City limits of the City of Zephyrhills, WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills on the 8th day of July, A.D.,2002, and the Board of County Commissioners of Pasco County on the 15th day of October, A.D., 2002. • WHEREAS, STEVEN R. PRESSLEY and ANNETTE PRESSLEY, his wife were notified of the public hearing for annexation by regular mail and registered mail, return receipt of the lands described in Section 1, and WHEREAS, the Board of County Commissioners of Pasco County and the City Council of the City of Zephyrhills approves the annexation of said lands and the inclusion of said lands within the corporate limits of said City, WHEREAS, the Planning Commission has recommended approval of the annexation: NOW, THEREFORE,BE IT ENACTED AND ORDAINED by the City Council ofthe City of Zephyrhills, Florida, as follows: SECTION 1: That the following described enclaved lands, lying and being situate in-Pasco County, Florida, to-wit: ; 02-26-21-0040-00B00-0220 Lots 22 to 26,both inclusive of Block B, OAK PARK ADDITION TO ZEPHYRHILLS,as per map or plat thereof recorded in Plat book 3, page 53, of the Public Records of Pasco County, Florida, AND ALSO the following described land: Begin at the Southeast cornerof-Lot 26,Block B, OAK PARK, a subdivision in Section 2, Township 26 South, Range 21 East,.and thence run East 5,0 feet, thence North 120 feet, thence West 50 feet, thence South 120 feet to the-Point of Beginning. LESS and EXCEPT the following: The West 30 feet of the South 145 feet of the Southeast 1/4 of the Southeast 1/4 of Section 2, Township 26 South, Range 21 East, LESS,and EXCEPT,the South 33 feet for right-of-way. be, and the same are hereby annexed to and included within the boundaries of the City of Zephyrhills, Florida, a municipal corporation. That said lands are now unincorporated and lie in the same county as said City, and when annexed would form a compact addition to the incorporated territory of said City. That the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said properties into the City limits of the City of Zephyrhills, so as to rectify the enclave. SECTION3: That the City ofZephyrhills,Florida,has been given authority by the legislature of the state of Florida, pursuant to Florida Statute 171.046(2)(a) and pursuant to the Charter of the City of Zephyrhills, to annex contiguous areas, which have created an enclave in said City and to extend the city limits or territorial boundaries upon the entry of an interlocal agreement with Pasco County, Florida, together with the approval of the City Council of the City of Zephyrhills, of said annexation duly expressed by Ordinance. SECTION 4: That it is the intention of the City Council of the City of Zephyrhills, Florida, to annex the above-described lands, which had previously created an enclave to said City within its territorial limits and the boundary lines of said City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5: That this Ordinance shall be published in a newspaper of general circulation for two (2) consecutive weeks and that proof of publication of this Ordinance shall be filed herein. SECTION 6: That upon the filing of the Proof of Publication and final adoption of.this Ordinance,a copy of same shall be filed with the Clerk of the Circuit Court ofPasco County,Florida, and a copy will be forwarded to the Department of State, Tallahassee, Florida. SECTION 7: This Ordinance shall become law upon being passed by the City Council of the City of Zephyrhills after two (2)readings and execution by the presiding officer and the clerk of that body in accordance with Florida Statute 171.046(2)(a).
