PgS.Co CO1's'iTY Ct,iERY 12/02/K T.: :5 pw 1 cf OR PK � 1E. _�'' 233 WHEREAS, SYLVIA TADLOCK, is the present owner of the lands hereinafter described in Section 1, and WHEREAS, the properties described in Section 1 below created an enclave within the incorporated boundaries of the City of Zephyrhills, WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said enclaved properties into the City limits of the City of Zephyrhills, WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills on the 8th day of July, A.D., 2002, and the Board of County Commissioners of Pasco County on the 15th day of October, A.D., 2002. WHEREAS, SYLVIA TADLOCK was notified of the public hearing for annexation by regular mail and registered mail, return receipt of the lands described in Section 1, and WHEREAS, the Board of County Commissioners of Pasco County and the City Council of the City of Zephyrhills approves the annexation of said lands and the inclusion of said lands within the corporate limits of said City, . WHEREAS, the Planning Commission has recommended approval of the annexation. y. NOW, THEREFORE,BEITENACTEDAND ORDAINED bytlie City Council,ofthe City • of Zephyrhills, Florida, as follows: =_ SECTION 1: That the following described enclaved lands, lying-and being situate_in;Pasco County, Florida, to-wit: • r:- 10-26-21-0010-06400-0090 That portion of Tract 64,ZEPHYRHILLS COLONY COMPANY LANDS in Section`10 Township 26 South, Range 21 East, as per plat thereof recorded in Plat Book 1, page 55, Public Records of Pasco County, Florida, being described as follows: Commencing at the SE corner of Tract 64;run North 110 feet along the East line of said Tract 64 for a Point of Beginning;thence run West 147.59 feet parallel with the South line of said Tract 64; thence North 40.25 feet paiallet'with•the East line of said Tract 64; thence Southeasterly 147.61 feet to a point on thetast line of said Tract 64;'said point lying 35.75 feet North of the Point of Beginning; thence South 35.75 feet along the,East line of said Tract 64 to the Point of Beginning. . SECTION 2: Said lands are contiguous to the present city limits of the City of Zephyrhills. That said lands are now unincorporated and lie in the same county as said City, and when annexed would form a compact addition to the incorporated territory of said City. That the City of Zephyrhills and Pasco County have entered into an interlocal agreement to annex said properties into the City limits of the City of Zephyrhills, so as to rectify the enclave. SECTION3: That the City of Zephyrhills,Florida,has been given authority by the legislature of the state of Florida, pursuant to Florida Statute 171.046(2)(a) and pursuant to the Charter of the City of Zephyrhills, to annex contiguous areas, which have created an enclave in said City and to extend the city limits or territorial boundaries upon the entry of an interlocal agreement with Pasco County, Florida, together with the approval of the City Council of the City of Zephyrhills, of said annexation duly expressed by Ordinance. SECTION 4: That it is the intention of the City Council of the City of Zephyrhills, Florida, to annex the above-described lands, which had previously created an enclave to said City within its territorial limits and the boundary lines of said City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5: That this Ordinance shall be published in a newspaper of general circulation for two (2) consecutive weeks and that proof of publication of this Ordinance shall be filed herein. SECTION 6: That upon the filing of the Proof of Publication and final adoption of this Ordinance,a copy of same shall be filed with the Clerk of the Circuit Court ofPasco County,Florida, and a copy will be forwarded to the Department of State, Tallahassee, Florida. SECTION 7: This Ordinance shall become law upon being passed by the City Council ofthe City of Zephyrhills after two(2)readings and execution by the presiding officer and the clerk of that body in accordance with Florida Statute 171.046(2)(a).
