AN ORDINANCE OF THE CITY OF
ZEPHYRHILLS, FLORIDA, A MUNICIPAL
CORPORATION, APPROVING A SMALL SCALE ( —
FUTURE LAND USE MAP AMENDMENT TO THE
CITY'S COMPREHENSIVE PLAN, ADOPTING
I THE FUTURE LAND USE CLASSIFICATION OF =_=
RESIDENTIAL SUBURBAN AND MIXED USE "'—
FOR THE TERRITORIES HEREINAFTER
DESCRIBED CONSISTENT WITH THE GOALS,
OBJECTIVES, AND POLICIES OF THE ADOPTED
COMPREHENSIVE PLAN AS REQUIRED BY THE, IL- z,

WHEREAS, Townview Medical Arts Center Partnership, being the owner.of land

hereinafter described in Section 1-Parcel (a)(b) has requested Future Land Use Map
designation and rezoning of the below described land; and I x M
WHEREAS, Kevin L. Ryman and Tammy L. Ryman, his wife and Nelson L. ,)3^'z
Ryman and Dottie A. Ryman, his wife, being the owners of land hereinafter described in lUi i

Section 1-Parcel (c) has requested Future Land Use Map designation and rezoning of the 3
below described land; and
WHEREAS,the City Council of the City of Zephyrhills approves the annexation of c;;
said lands within the corporate limits of the City of Zephyrhills on October 14, 2002; and
WHEREAS, the Planning Commission sitting as the local planning agency, did,

pursuant to Chapter 163.3174, Florida Statutes, hold a public hearing on October 1, 2002
to consider said proposed Future Land Use Map designation and rezoning; and
WHEREAS, the City Council of the City of Zephyrhills agrees to a formal adoption
of a small scale amendment to the Future Land Use Map (FLUM) of the Zephyrhills'
Comprehensive Plan to designate the hereinafter described real property, consistent with all
comprehensive plan goals, objectives and policies which shall pertain and be applicable to
said lands; and
WHEREAS, the City Council of the City of Zephyrhills agrees to formal adoption
of the rezoning to designate the hereinafter described real properties.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of

SECTION I: That the following described lands , lying and being situate in Pasco
County, to-wit; x

Parcel (a)
A Tract of land lying in a portion of the South 1/2 of Section 34, Township 25 South,
Range 21 East, Pasco County, Florida: Being further described as follows: Begin at the
Northwest corner of Lot 19, Oak Run Subdivision, Phase I, as per the map or plat thereof ,
recorded in Plat Book 37, Pages 128 and 129, Public Records of Pasco County, Florida; .p t
thence along the Northerly and Westerly boundary of Lots 19 through 28 of said subdivision
the following six courses:
(1) S., 89° 57' 54"E., a distance of 210.00 feet; (2)N., 62° 15' 38" E., a distance of 33.40
feet; (3)N., 25° 46' 16"East a distance of 206.69 feet; (4)Northerly 26.80 feet along the
arc of a curve to the left(said curve having a radius of 60.00 feet, delta angel of 25° 35' 44"
and a chord bearing a distance of North 12° 58'24" East, 26.58 feet); (5)North 00° 10' 32"
East, a distance of 105.52 feet; (6)Northerly 143.28 feet along the arc of a curve to the
right (said curve having a radius of 240.00 feet, delta angel of 34° 24' 20" and a chord
bearing a distance of North 17° 16' 42" E., 141.16 feet); thence departing said Northerly
and Westerly boundary,North 89° 58' 44" W., a distance of 621.17 feet; thence South 25°
22' 00" E., a distance of 497.56 feet; thence South 58° 47' 24" E., a distance of 35.51 feet
to the Point of Beginning.

A Tract of land lying in a portion of the South 1/2 of Section 34, Township 25 South,
Range 21 East, Pasco County, Florida: Being further described as follows: Begin at the
Southwest corner of Lot 18, Oak Run Subdivision, Phase 1, as per the map or plat thereof
recorded in Plat Book 37, Pages 128 and 129, Public Records of Pasco County, Florida:
Thence along the westerly boundary of said subdivision the following five courses:
(1)N., 00° 10' 32" E., a distance of 115.00 feet (2)N., 27° 14' 17" E., a distance of 56.22
feet; (3) N., 00° 02' 26" E., a distance of 30.00 feet; (4) S., 89° 57' 54" E., a distance of
42.00 feet; (5)N., 00° 02' 26" E., a distance of 85.00 feet; thence departing said Westerly
boundary North 58° 47' 24" W., a distance of 35.51 feet; thence North 25° 22' 00" W., a
distance of 594.21 feet;thence S., 64° 38' 00" W., a distance of 115.00 feet; thence 218.63
feet, along the arc of a concave to the Southeast (said curve having a radius of 50.00 feet,
delta angel of 250° 31' 44" and a chord bearing a distance of South 29° 22' 08" W., 81.65
feet); thence 14.43 feet along the arc of a curve concave to the Southwest (said curve
having a radius of 25.00 feet, delta angel of 33° 04" 40", and a chord bearing a distance of
79° 21' 24" E., 14.23 feet); thence South 64° 38' 00" W., a distance of 114.85 feet to a
Point on the centerline of the former Seaboard Coastline Rail Road Right-of-Way: Thence
S., 25° 22' 00" E., along said former center line, a distance of 733.68 feet to a point on the
South boundary of the North 1/2 of the South 1/2, Section 34: Thence S., 89° 57' 53" E.,
along said South boundary, a distance of 136.20 feet to the Point of Beginning.
Parcel (c)
Zephyrhills Colony Company Lands(Plat Book 1, Page 55) a portion of Tract 8, described
as:
Commencing at the Northeast corner of the NW 1/4 of the NW 1/4 of Section 2, Township
26 South, Range 21 East, Pasco County, Florida; thence West 200.00 feet; thence South
parallel with the Easterly line of the NW 1/4 of the NW 1/4 of the NW 1/4 of Section 2,
25.00 feet for a Point of Beginning;thence continue S., 200.00 feet; thence W., 200.00 feet;
thence N., 200.00 feet;thence East 200.00 feet to the Point of Beginning..LESS the North
5.00 feet thereof for road right-of-way.
SECTION 2: That said lands are contiguous to the present city limits of the City
of Zephyrhills. That said lands are now unincorporated and lie in the same county as said
city, and when annexed,would form a compact addition to the incorporated territory of the
City of Zephyrhills. That the owners of said lands contained in said area to be annexed has
given written consent to have such are annexed and the City Council of the City of r
Zephyrhills does hereby approve the annexation for said annexation duly expressed by
Ordinance. j
SECTION 3: That the City Council of the City of Zephyrhills, Florida;has been
given authority by legislature of the State of Florida under Chapter 69-139, Laws of Florida,

1969, to zone territorial boundaries upon receipt of a written consent of the land owner,

together with the approval of the City Council of the City of Zephyrhills of said zoning duly . •

expressed by Ordinance. •
SECTION 4: That the City Council of the City of Zephyrhills_is of the opinion that
the residential suburban Future Land Use designation, for parcels (a).and (b) above would_
promote the general welfare and encourage proper development within the City.'" -
SECTION S: That the City Council of the City of Zephyrhills is--of the opinion-that
the mixed use Future Land Use designation, for parcel(c) above would promote the general
welfare and encourage proper development within the City.
SECTION 6: That the City Council of the City of Zephyrhills is of the opinion that
R2 zoning, for parcels(a)and(b) above would promote the general welfare and encourage
proper development within the City.
SECTION 7: That the City Council of the City of Zephyrhills is of the opinion that
C2 zoning, for parcel (c) above would promote the general welfare and encourage proper
development within the City.
SECTIONS_ That due public notice of hearing on such proposed zoning was given
by the City council of the City of Zephyrhills on November 14, 2002 and November 21,
2002, as required by Chapter 166.041, Florida Statutes.
SECTION 9: That a public hearing on this proposed FLUM amendment and zoning
before the Zephyrhills'Planning Commission was held on April 16, 2002.
SECTION 10: That the Zephyrhills' Planning Commission recommended
approval of said FLUM amendment and zoning.
SECTION 11: That all ordinances or parts of ordinances in conflict herewith
be, and the same are hereby repealed to the extent of such conflict.
SECTION 12: That if any section, sentence, clause or phrase of this ordinance is
held to be invalid or unconstitutional by a Court of competent jurisdiction, then said holding
shall in no way affect the validity of the remaining portions of this ordinance.
SECTION 13: This Ordinance shall become effective immediately upon its passage.
SECTION 14:Barring appeal, the FLUM amendment shall take effect as provided
in Chapter 163.3187, Florida Statutes.
The foregoing Ordinance No. 835-o).was read and passed on its first reading in
open and regular meeting by the City Council of the City of Zephyrhills, Florida, on this
