AN ORDINANCE OF THE CITY OF
ZEPHYRHILLS, FLORIDA, A MUNICIPAL
CORPORATION, ADOPTING A SMALL SCALE
AMENDMENT TO THE COMPREHENSIVE PLAN
TO EXCLUDE THEREFROM TERRITORIES AND
111 AMEND THE FUTURE LAND USE MAPS IN
ACCORDANCE WITH CHAPTER 163.3187

WHEREAS,the City of Zephyrhills, Florida, is adopting an amended Future Land-Use map
and a small scale amendment to the Comprehensive Plan of said City, to exclude a certain parcel of
land previously excluded from the corporate limits of the City of Zephyrhills with said parcel and
owners itemized below:
1. Jerry H.Moates,Sr. and Lisa L. Moates, his wife and Jerry H. Moates, Jr., and Linda
L. Moates, his wife, which parcel contains approximately 5.90 acres and is located on the East side
of 16th Street and North of Daughtery Road. Previous Land Use: City Residential.
WHEREAS,the City also is amending all maps of said Comprehensive Plan to exclude, said
deannexed property;
WHEREAS, by City of Zephyrhills Ordinances No': 741-00 , the above-referenced real
property was excluded from the municipal boundaries of the City of Zephyrhills; real property being
more particularly described as follows:
Tract 111, LESS the North 200.00 feet and the East 15.00 feet; and Tract 114, LESS the South
60.00 feet and LESS the East 15.00 feet of the North 75.00 feet, in Section 35, Towiiship 25 South,
Range 21 East,ZEPHYRHILLS COLONY COMPANY LANDS, as per plat recorded in Plat Book
1, page 55, Public Records of Pasco County, Florida. Containing 5.90 acres MOL.
Parcel No.: 35-25-21-0010-11100-0010 and 35-25-21-0010-11400-0000
WHEREAS,the Zephyrhills City Council has requested the Zephyrhills Planning Commission,
as the local planning agency of the City, to recommend exclusion of this property from the City's
Comprehensive Plan; and
WHEREAS; based on the recommendation of the Planning Commissicato the Zephyrhills
City Council, said Council has prepared a small scale amendment co the City's Comprehensive Plan
and is hereby transmitting it to the Department of Community Affairs,andsuch other agencies as
required by Section 163.3184, Florida Statutes; and
HEREAS,the City Council of'the City of Zephyrhills desires to thereby formally adopt the
small scale amendment to the City's Comprehensive Plan.
BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows:
SECTION I: The following small scale amendment to the Comprehensive Plan of the City
of Zephyrhills is hereby proposed:

(a) All maps depicting land use, traffic circulation, public facilities, recreational sites, and
housing have been amended to exclude, the deannexed property more particularly described above.
Copies of the maps as hereby amended are attached as Exhibit "A" to this Ordinance and are hereby
incorporated by reference.
(b) All necessary data and analyses with references to the deannexed property is included
within the description herein. All prior reviews of the property are included and labeled Exhibit "A".
SECTION 2: All goals, objectives, policies and other planning provisions applicable to
properties within the City of Zephyrhills as shown and set forth in the Comprehensive Plan of the City
of Zephyrhills are hereby expressly made applicable and pertinent to the real property described
herein.
SECTION3: The above small scale amendment shall be forwarded to the State of Florida,
Department of Community Affairs for their appropriate review and comment.
SECTION 4: The provisions of this Ordinance are severable, and if any section, sentence,
clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall
not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be
the City Council's intent that it would have passed the valid portions of this Ordinance without the
inclusion of any invalid portion or portions.
SECTION 5: This Ordinance shall become effective immediately upon its passage.
The foregoing Ordinance No.'1 -oo was read and passed on its first reading by the City
Council of the City of'Zephyrhills, Florida, on this .2T0' day of , A.D., 2000.
